In this episode Ben and Heather are joined by barrister Rhys O'Brien, a specialist in complex family law matters, to talk about how the Court deals with Domestic Violence (Family Violence).  They cover a wide range of topics, including the following: The difference between how a Family Law Court and a Criminal Court view domestic violence. Apprended Violence Orders (AVOs) Does there need to be an AVO in place before the Family Court considers domestic violence claims? What evidence does the Family Court need to satisfy itself that domestic violence is an issue? Will the court require Family Dispute Resolution (mediation) in domestic violence cases? How do accusations of domestic violence affect Parenting Order decisions? Can domestic violence claims impact a Court's decision about a financial settlement? Also discussed was the Family Law Amendment Bill that has been passed through Parliament and will take effect in May 2024 and includes a "streamlined" parenting framework simplifying the "best interests factors".  This legislation may impact how the Court deals with domestic violence issues when deciding children's matters.

7Nicole Strattman Nicole has been employed with the County of Orange Social Services Agency (SSA) since 1999. She is a Licensed Clinical Social Worker who holds a Master's degree in Social Work from the University of Southern California. She is currently the manager for the Resource Families: Recruitment, Development and Support program in Children and Family Services. Nicole has worked in a variety of programs at SSA which have included assignments investigating child abuse as well as representing SSA in Family Law Court. In 2014, Nicole began working alongside the Orange County Human Trafficking Task Force to create an enhanced collaborative response model, treating trafficked children as victims and ensuring the child welfare system had the services to meet the victim's needs. She is a California Department of Social Services "Above and Beyond" award recipient and has received recognition from California State Senator Ling Ling Chang and California Congresswoman Katie Porter for her commitment to end Human Trafficking and the Commercial Sexual Exploitation of Children (CSEC). Nicole was a key advocate in bringing in a therapy dog into youth's court hearings, which was profiled on local news station, KTLA in Los Angeles as well as the nationally syndicated show CW's Dogs of the Year. As an expert in the field, she has traveled across the state as a presenter and trainer on CSEC and Human Trafficking as it relates to Child Welfare, where she has trained social workers, victim advocates, mental health practitioners, law enforcement and international delegations from countries, such as Egypt and Vietnam.

Kate is an Accredited Mental Health Social Worker (Australian Association of Social Workers) and a Play Therapist. She began her Social Work career in frontline Child Protection - assessing risk to children, working with children and families to reduce risk, and where necessary, placement of children in out-of-home care. Kate is trained and experienced in forensic risk assessments and investigative interviewing and has presented evidence in Children's Court, Family Law Court, and Criminal Court. She has managed a team of child protection workers before going into private practice.She graduated from Trinity College Dublin (TCD) in 2001 with a Bachelor's In Social Work. Kate completed a Post Graduation Diploma qualifying her as a Play Therapist in 2006 awarded by Play Therapy International (PTI) and the University of Canterbury. Action Radio Show - 12/12/19 - Show Notes: Introduction:  We are getting to the point now with Action Radio that people are calling in a lot earlier and a lot more often.  I love it.  I started to introduce Michael Volpe's topic in the second hour, with the incredible abuse and injustice of Family Law Court, CPS, the police, and various experts.  Shortly Anthony called in, then Michael a new caller joined us, then Josie, and this took us all the way up to 30 minutes in when Wendy and her Art Report was due to start, so we put that off until 45 minutes in, and then got to Michael Volpe at the top of the second hour after the Trump 2020 update. 30:00 - When Wendy Arthur joined in. 45:00 - When the Art Report began and our discussion ended.   1:01:30 - Michael Volpe began outlining the details of three heartbreaking cases of children being awarded to the wrong parent, with tragic results.  The main story involved Kara, a woman who lost her two year old son to her ex. in whose care the child was at the time.  Michael gave us all the details of the case, and then Kara joined us, and you'll hear one of the few times I was speechless, trying to express my horror at her loss. 1:31:50 - After a couple of announcements Kara joined us and told us the start of her story.  There is so much too this I invited both Michael and Kara to pick up the story next Thursday the 19th for a Part 2 of this tragic story, and complex mystery.   Cell Phone plus auxiliary cord to Vehicle Audio = Action Radio on your Radio!
