Nora Freeman Engstrom is a professor of law who says that in three-quarters of cases one or more of the parties lacks legal representation. Worse yet, often the litigants are involved in high-consequence civil cases where there is no right to a lawyer and costs are prohibitive. On Sept. 11, 2001, then-Captain Luis Valcarcel of the Court System's Department of Public Safety happened to be in Albany attending a meeting on, of all things, emergency preparedness when the country was attacked by terrorists. He was viewing the events unfold on live television, watching as a large plane approached the World Trade Center, and knowing full well that his brother was inside that building. Over his 47 years with the courts, Chief Valcarcel witnessed the growth of a newly unified court system that evolved under the nine Chief Judges under which he served. He ushered in new eras in security and helped make the Department of Public Safety the robust, cutting edge force that is today. But nothing compares to the moment he saw the plane hit the World Trade Center where his brother was working. A new polls says America's trust of the country's judicial system is at a record low. AP correspondent Donna Warder reports.
According to the U.S. House Judiciary Committee, as of late 2023, the U.S. immigration court system faced a backlog of more than 3 million pending cases. This number has more than doubled since 2019 and continues to grow, placing immense pressure on the system. Immigration judges are currently being asked to handle an average of 4,500 cases each and so struggle to manage their caseloads effectively. This backlog includes a mix of individuals seeking asylum, appealing deportation orders, or addressing other immigration-related issues. To get some insight into the challenges the system faces we talk with a retired Immigration Judge who spent 24 years hearing cases.

Families are under attack by our family court system. Two parents say their children were put in harm's way when the judge placed them with the abusive parent. Nearly every six days in the US, a child is killed amid a custody dispute. Families are under attack by our family court system. Twenty-two-year-old RJ says he and his siblings were in a 15-year tug of war between his mother and father. RJ says he was collateral damage of a broken system that failed him. In this episode, we focus on the North Carolina judicial system reforms of the 1960s. These reforms created a unified court system that included newly created District Courts, Court of Appeals, and the Administrative Office of the Courts (NCAOC). In the interview, former NCAOC Director and Supreme Court of North Carolina Associate Justice Franklin Freeman interviews two men who helped implement these reforms: Judge James Dickson Phillips, Jr. and Senator Lindsay C. Warren, Jr."The effect of the implementation of the District Court was to abolish all of the courts beneath the Superior Courts – county courts, city courts, and the justice of the peace system," said Warren on the podcast. "The worst thing about the justice of the peace system was that their compensation came from fees they assessed, but in a criminal case they could not assess a fee unless a defendant was convicted." In certain situations, plaintiffs in federal court are able to basically pick which judge hears their case by choosing which district and division they file in. Critics of this “judge shopping” say it has led to cases that overturned government policies, like the Texas case that suspended FDA approval of the abortion drug mifepristone before it was advanced to the Supreme Court. In March, a federal judicial panel issued a policy to try to stop judge shopping in cases like this, but it's not a hard and fast rule. Paul R. Gugliuzza, a professor at Temple University Beasley School of Law, joins us to explain exactly how judge shopping is possible, what this policy aimed to do and why it might not work, and how this all adds to Americans' lack of faith in our justice system. But in 2020, California passed the Racial Justice Act, a groundbreaking law that allows criminal defendants to argue that racism may have played a role in how the justice system handled their case and ask for the court to provide a remedy.
