(CERTAIN INFORMATION NOT AVAILABLE TO THE PUBLIC) The respondent Frédérick Silva was charged with four counts of murder and one count of attempted murder based on incidents that occurred on February 21, 2017, and December 20, 2018. On November 22, 2019, the prosecution laid five charges by direct indictment. On August 2 and October 15, 2021, respectively, the Superior Court dismissed Mr. Silva's motion for a stay of proceedings and Garofoli motion. It also made orders under s. 648(1) of the Criminal Code, R.S.C. 1985, c. C-46 (Cr. C.), prohibiting publication, broadcasting and transmission in relation to the two judgments. Further to those judgments, and by consent of the parties, Mr. Silva was tried by a judge alone, without a jury, on four of the five counts. On November 16, 2021, he formally recognized that the prosecution had discharged its burden on each essential element of the four offences through a nolo contendere proceeding. On January 27, 2022, Mr. Silva was convicted on the four counts. The parties agreed that the last count, which was for second degree murder, would be separated from the indictment and that Mr. Silva would have a trial by judge and jury on that count in May 2022. Before the trial began, La Presse brought a motion to lift the orders prohibiting publication, broadcasting and transmission in relation to the two judgments. On March 11, 2022, the Superior Court dismissed the motion. On May 6, 2022, Mr. Silva filed a nolo contendere proceeding on the last count, leading to the cancellation of the jury trial. He began his career as a pharmacist and field management with CVS Health, then became an MTM pharmacist with Humana Healthcare, before initially joining the WVU School of Pharmacy by developing MTM and managed care pain management programs. Dr. Garofoli created and coordinated the West Virginia Expert Pain Management Panel, which developed the West Virginia Safe & Effective Management of Pain (SEMP) Guidelines. He is currently a Clinical Assistant Professor and Director of Experiential Learning for the WVU School of Pharmacy, along with being a Clinical Pain Management Pharmacist at the WVU Medicine Center for Integrative Pain Management and Pain Fellowship Faculty for the WVU School of Medicine. Mark is a 2021 TEDx Talk presenter and a recipient of the WV GenerationRx Award. This Podcast Series is about Pharmacists & Physicians collaborating on the proper & humane usage of pain managment strategies, the usage of opioids, and evidence-based medication therapy management practices.  Each day, more than 130 people die from opioid overdoses. Opioids are a class of drugs that include prescription pain relievers like oxycodone. They also include illegal drugs like heroin. In 2019, 1.6 million Americans had an opioid addiction. This is also known as opioid use disorder. Yet effective medications—like buprenorphine, methadone, and naltrexone—are prescribed to only a fraction of people with opioid use disorder. Patients often receive such medications in an opioid treatment program. Methadone, for example, can only be given in a certified treatment program. Primary care physicians can apply for a waiver to prescribe buprenorphine. However, less than 10% of U.S. primary care providers have a buprenorphine waiver. Given the limited number of patients that each physician can treat, involving pharmacists in opioid treatment may improve access. We review the clinical implications of seeing chronic pain as a brain disease. We also cannot assume that the changes associated with chronic pain on neuroimaging are causal. When considering the significance of neuroimaging results, it is important to remember that ‘‘disease'' is a concept that arises out of clinical medicine, not laboratory science. Mark's Bio: Dr. Mark Garofoli is a Clinical Assistant Professor and Director of Experiential Learning for the West Virginia University (WVU) School of Pharmacy, along with being a Clinical Pain Management Pharmacist at the WVU Medicine Center for Integrative Pain Management. Dr. Garofoli received his PharmD at the University of Pittsburgh School of Pharmacy in 2004 and his MBA from Strayer University in 2008. He is board certified in Geriatric Care (BGCP) along with being a certified pain educator (CPE). Dr. Garofoli began his career with CVS Health in community pharmacy and field management, then worked as a Humana Healthcare MTM clinical pharmacist, which lead him to developing and coordinating the WVU Opioid-Centered MTM program and the Safe & Effective Management of Pain Program and guidelines (www.sempguidelines.org). Mark has been a consultant in the field of pain management on many different avenues such as being a grant reviewer for the CDC, an expert witness in multiple criminal and civil court cases, numerous interviews and articles locally and nationally, and was the recipient of the West Virginia GenerationRx Award. Mark’s professional passion lies within interprofessional live and online education across the country, most notably with PAINWeek (www.painweek.org) and www.freece.com (including two certificate training programs: a 20+ hour Pain Management Specialty Pharmacist certificate and a 20+ hour Substances of Abuse Specialty Pharmacist certificate). Hope, RPh is a Clinical Education Specialist and Continuing Education Administrator with the PharmCon team in Myrtle Beach, SC and a 1999 graduate from the Medical University of South Carolina in Charleston. Kevin has served as an adjunct faculty member for the South Carolina College of Pharmacy, having coordinated and instructed the college's ‘authorized user’ program for nuclear pharmacy. Dr. Garofoli is also the coordinator of the West Virginia Expert Pain Management Panel, which developed the West Virginia Safe & Effective Management of Pain (SEMP) Guidelines (www.sempguidelinesorg). In December our tasting committee has awarded five wines with five diamonds: Vin Santo di Montepulciano Dolce Sinfonia 2007 of Bindella, Rosso Conero Riserva Selezione Gioacchino Garofoli 2007 and the wines Verdicchio dei Castelli di Jesi Podium 2010, Serra Fiorese 2007 and Selezione Gioacchino Garofoli 2006, all made by Gioacchino Garofoli winery. The latter - masterpiece of wine maker Carlo Garofoli - has been awarded by our tasting committee as the best wine of December 2012.
