In a change of pace for our show, we do not cover a legaltech startup in this episode. Instead, we take a look at The Effectiveness Project, which is a legal technology collaboration through the Legal Technology Core Competencies Certification Coalition and a variety of legal technology vendors. The Effectiveness Project is an international working group of legal professionals, with support from LTC4, collaborating to establish best practices and baseline skills for creating effective legal documents. They are focusing, at present, on what is called Document Competency. The first release from The Effectiveness Project, is the Document Competency Best Practices Guide. This guide is free and can be downloaded right now. See the link below. The Best Practices Guide was created with the understanding that the legal document-creation process is highly individualized. As such, The Effectiveness Project sought to provide guidance that is specific, yet flexible. To meet that goal, the Best Practices Guide is divided into drafting stages so it can be used as a modular part of a workflow. On our 25th episode of The Geek In Review, Marlene Gebauer and Greg Lambert sit down and talk with Ivy Grey, Director of Business Strategy for WordRake. Ivy's recent Above the Law article, “Curiosity Is The Foundation For Innovation” discusses the disconnect between employers who think they promote creativity in their employees, versus employees who think that their bosses actually stifle creativity in the workplace. Ivy breaks down the nuances between creativity and innovation. Ivy points to law firms like Reed Smith, who are actually giving their attorneys and others (approved) time to come up with creative processes, and letting the employees build upon these ideas. The key is to allow people to think and be creative, and imagine possibilities that don't even exist. On that note, we'd like to point out that Baker McKenzie announced the hiring of a couple of creative and curious rock stars, fellow geek, Casey Flaherty as their new Director of Legal Project Management, and Geek in Review interviewee Jae Um, as their Director of Pricing Strategy. Hope they are ready for long memos filled with emojis! Greg flew through Dallas Love Field this week during a Herb Kelleher celebration. Southwest's original CEO was well known for creative marketing, and Greg was a little disappointed that he didn't get a free bottle of Chivas when we got off the plane. For a great story of how Southwest got its start, check out the Business War's Podcast on Clearing the Runway. Information Inspirations Microsoft Assistant General Counsel, Jason Barnwell, wrote a timely piece called "Bricklayers and Architects." His own experiences on being able to come up with a creative process to streamline and M&A deal back when he was an associate at a BigLaw firm, dovetails nicely with Ivy Grey's discussion. That great idea which would have saved a lot of time in creating the closing binders??? Stifled. Why? The billable hour. We are all way too familiar with the phrase Fake News, but what do you know about Deepfakes? Pew Research discusses how well fake videos, created with artificial intelligence, are causing issues with understanding what is real, and what is fake. ABA Model Rule 1.1 states that a lawyer shall provide competent representation to a client. While this duty has existed for a while, the more recent addition of Comment 8 to Rule 1.1 makes it essential for lawyers to “keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology[.]” This demands a shift in the way lawyers approach their understanding and use of technology in their legal practices. Joining me today to discuss the intersection of technology and ethics is Ivy Grey, bankruptcy attorney, legal tech writer, and creator of American Legal Style for PerfectIt, which is a legal specific proofreading program for lawyers that runs within Microsoft Word.  What You’ll Learn in This Episode: What ABA Model Rule 1.1, specifically comment 8, requires of lawyers Why it is no longer efficient or even acceptable for lawyers to be luddites What the ABA Model Rule 1.1, Comment 5 add to the discussion? And the Tools we Use Each Day  In Episode 112 we talk with Ivy Grey, lawyer, Legal Tech Designer and Legal Tech author. For Ivy, the transition from lawyer to legal tech designer wasn’t difficult; growing up in Silicon Valley she naturally uses technology for efficiency.    Similarly, she’s embraced writing about technology with the goal of making the duty of technology competence accessible to all lawyers by focusing on the technology lawyers use every day; tools like Microsoft Word and the Microsoft suite of products.   Implementing legal technology shouldn’t be total upheaval; it’s about palatable changes that allow technology to impact how we work.
