Jacqueline began teaching Legal Writing and Lawyering Skills at the Benjamin Cardozo School of Law in Manhattan and working on her first book in her limited spare time. Finally deciding to embrace her passion and pursue writing full time, Jacqueline returned to school and earned her MFA from Sarah Lawrence College. When not writing, Jacqueline is an avid reader of all things fiction. She loves to exercise, watch movies with her family, listen to music, make lists, and dream about exotic vacations. She lives in Westchester, New York with her husband, four children and two very bossy canines. Since ChatGPT came on the scene, numerous incidents have surfaced involving attorneys submitting court filings riddled with AI-generated hallucinations—plausible-sounding case citations that purport to support key legal propositions but are, in fact, entirely fictitious. As sanctions against attorneys mount, it seems clear there are a few kinks in the tech. Even AI tools designed specifically for lawyers can be prone to hallucinations. In this episode, we look at the potential and risks of AI-assisted tech in law and policy with two Stanford Law researchers at the forefront of this issue: RegLab Director Professor Daniel Ho and JD/PhD student and computer science researcher Mirac Suzgun. Together with several co-authors, they examine the emerging risks in two recent papers, “Profiling Legal Hallucinations in Large Language Models” (Oxford Journal of Legal Analysis, 2024) and the forthcoming “Hallucination-Free?” in the Journal of Empirical Legal Studies. But when she became an attorney, she says, she realized that there was no single equivalent style guide when it came to legal writing—and she had to adjust to using the Oxford comma. As a professor of legal writing at the University of Miami, she also began to notice a contrast between the classic 19th and 20th century court opinions her students were being given to read and the style of writing coming out of the U.S. Supreme Court in the 21st century. Standards were changing at the highest court of the land, but the wider legal community wasn't necessarily aware of it. Barton spent five years analyzing more than 10,000 pages from Supreme Court opinions, and The Supreme Guide to Writing is the result. In this episode of the Modern Law Library, Barton and the ABA Journal's Lee Rawles discuss her findings, and what some of the bigger surprises were. One of her biggest takeaways is that the justices are not a conservative bunch when it comes to writing style. For example, during most of Justice Antonin Scalia's tenure on the court, he was a strident opponent of contractions—can't, don't, shouldn't were always cannot, do not, should not. But in his final years, Scalia did sprinkle in a few contractions, and his replacement, Justice Neil Gorsuch, is “King of the Contractions,” Barton says. The justices were willing to depart from grammar rules if adhering to them caused stilted writing, Barton found. Chief Justice John Roberts uses commas based on cadence rather than simply following strict English grammar guidance. All the justices showed a marked preference for active verbs and shorter, simpler phrases. They have adapted to using pronouns that match litigants' gender identities, and to using the singular “they” rather than “he or she.”  The Supreme Guide to Writing notes when the court shows unanimity in a usage rule, and when there is disagreement. While each justice shows internal consistency with how they show a possessive when a singular noun ends in “s,” there is no group consensus on apostrophe-s versus a single apostrophe. In this episode of NucleCast, host Adam interviews Pat Rhodes and Dave Jonas, who have been writing a series of articles on nuclear issues. David S. Jonas is a partner at the law firm of Fluet, Huber & Hoang (FH+H). His practice includes corporate transactions, employment law, government contracts, trial and appellate litigation, international law, administrative/regulatory compliance and investigations. He has extensive experience in national security issues and is recognized as one of a handful of experts worldwide in nuclear nonproliferation law. He was a career member of the Senior Executive Service and served as General Counsel of the National Nuclear Security Administration (NNSA) where he negotiated numerous multilateral and bilateral international agreements to include the U.S. – India Civil Nuclear Agreement. He also served as General Counsel of the Defense Nuclear Facilities Safety Board.Prior to his civilian service, he was a career Marine Corps officer where he held a wide variety of command and staff billets. He served as nuclear nonproliferation planner for the Joint Chiefs of Staff negotiating multiple international agreements and has worked extensively with the International Atomic Energy Agency, the Conference on Disarmament, and the United Nations. He is one of the only judge advocates to have commanded two units, including a company in an infantry regiment, the 5th Marines. He argued the case of Davis v. United States, 512, U.S. 452 (1994) at the U.S. Supreme Court becoming the first judge advocate in the history of the Army, Navy, Marine Corps and Air Force to do so. He received the U.S. Court of Appeals for the Armed Forces Award for Excellence in Legal Writing and was selected as the Outstanding Career Judge Advocate in the Marine Corps. He concluded his military service as a lieutenant colonel. Patrick Rhoads had a thirty-eight-year career as an engineer with the National Nuclear Security Administration. He started with Naval Reactors as an ensign in the Navy and worked his whole career in the uses of nuclear energy for national security missions. His career included nuclear design, construction, and operations. Late in his NNSA career, he led many nuclear construction activities, including billion-dollar acquisitions, and served as the Chief of Staff in three different organizations. After retiring from NNSA in 2020, he joined the National Strategic Research Institute as the Director of Nuclear Research. Artificial intelligence is here and it's getting more sophisticated and more ubiquitous every day.  Indeed, the legal community seems to be largely embracing A/I with open arms.  But the jury is still out whether this somewhat terrifying new technology is going to be our savior or our destroyer.  Therefore, helping us get set for sentencing this week are two great gentlemen:  a lawyer (Patrick Barone) and communications expert (Dr. Randy Olson) to debate the pros and cons of A/I in life, and in law.   IN THIS EPISODE:  Using A/I as an editor in legal writing; Using A/I to help a client prepare to allocute at sentencing; Using A/I to summarize voluminous discovery and creating summaries for clients; A/I's limitations; The concept of “prompt engineering” and it's importance in generating the best A/I results; The importance of infusing meaning into our sentencings, our stories, and our lives.   OTHER LINKS:  We spent a fair amount of time discussing the "ABT" Narrative template. David S. Jonas is a partner at the law firm of Fluet, Huber & Hoang (FH+H). His practice includes corporate transactions, employment law, government contracts, trial and appellate litigation, international law, administrative/regulatory compliance and investigations. He has extensive experience in national security issues and is recognized as one of a handful of experts worldwide in nuclear nonproliferation law. He was a career member of the Senior Executive Service and served as General Counsel of the National Nuclear Security Administration (NNSA) where he negotiated numerous multilateral and bilateral international agreements to include the U.S. – India Civil Nuclear Agreement. He also served as General Counsel of the Defense Nuclear Facilities Safety Board.Prior to his civilian service, he was a career Marine Corps officer where he held a wide variety of command and staff billets. He served as nuclear nonproliferation planner for the Joint Chiefs of Staff negotiating multiple international agreements and has worked extensively with the International Atomic Energy Agency, the Conference on Disarmament, and the United Nations. He is one of the only judge advocates to have commanded two units, including a company in an infantry regiment, the 5th Marines.He argued the case of Davis v. United States, 512, U.S. 452 (1994) at the U.S. Supreme Court becoming the first judge advocate in the history of the Army, Navy, Marine Corps and Air Force to do so. He received the U.S. Court of Appeals for the Armed Forces Award for Excellence in Legal Writing and was selected as the Outstanding Career Judge Advocate in the Marine Corps. He concluded his military service as a lieutenant colonel.
