This is the follow-up episode to the one published on Feb. 6 previewing the oral arguments in the Colorado ballot case, Trump v. Anderson. The U.S. Supreme Court ruled that a state may not disqualify a candidate for federal office under Section 3 of the 14th Amendment, whose Reconstruction-era framers sought to bar anyone from holding office who had violated their oath by engaging in insurrection. In doing so, the Supreme Court restored Donald J. Trump to the Colorado ballot. But the conservative majority also invented a rule that only Congress has the power to disqualify by passing legislation, something that has no constitutional basis. In this episode, University of Maryland constitutional scholar Mark Graber explains where the Supreme Court mangled U.S. history. Graber also provides a definition of insurrection based on his exhaustive research of centuries of relevant cases.

On Monday March 4th, the Supreme Court reversed Colorado's decision to remove President Trump from the ballot. The Court unanimously held that individual states cannot bar insurrectionists from holding federal office under Section 3 of the Fourteenth Amendment. Five Justices went further, ruling that Congress alone may enforce Section 3. In this episode, constitutional scholars Mark Graber of the University of Maryland Law School and Michael McConnell of Stanford Law School join Jeffrey Rosen to discuss the Court's 9-0 decision to avoid a chaotic “patchwork” of state-level ballot eligibility decisions and the 5-4 majority's view that Section 3 requires Congress to act before an insurrectionist may be disqualified from office. Zachary sets the scene with his poem entitled, "The Court Has Stopped the Count" Sanford Levinson, who holds the W. St. John Garwood and W. St. John Garwood, Jr. Centennial Chair in Law, joined the University of Texas Law School in 1980. Previously a member of the Department of Politics at Princeton University, he is also a Professor in the Department of Government at the University of Texas. Levinson is the author of approximately 400 articles, book reviews, or commentaries in professional and popular journals--and a regular contributor to the popular blog Balkinization. He has also written six books: Constitutional Faith (1988, winner of the Scribes Award, 2d edition 2011); Written in Stone: Public Monuments in Changing Societies (1998); Wrestling With Diversity (2003); Our Undemocratic Constitution: Where the Constitution Goes Wrong (and How We the People Can Correct It)(2006); Framed: America's 51 Constitutions and the Crisis of Governance (2012); An Argument Open to All: Reading the Federalist in the 21st Century (2015); and, with Cynthia Levinson, Fault Lines in the Constitution: The Framers, Their Fights, and teh Flaws that Affect Us Today (forthcoming, September 2017). The Diagnostic Error in Medicine Conference 2015 has finally come!  We have been looking forward to attending this conference for a while now.  This comes on the heels of the freshly published Institute of Medicine Report on diagnostic error, an initiative which was prompted by SIDM, with Mark Graber at the helm.  These three episodes, 6, 7, and 8 are our end-of-day reflections on the presentations we have heard. The differential diagnosis is at the heart of analytic thinking for the diagnostician.  Dr. Mark Graber agrees.  As the founder of the Society to Improve Diagnosis in Medicine, he should know.  It can overcome many of the biases we are prone to when we limit ourselves only to diagnosis by pattern recognition.  We discuss some simple approaches to generating a differential diagnosis and developing a problem representation.
