John Bingham is a Professor in the BYU Marriott School of Business, and has served as Fellow in the Sorensen Center for Moral and Ethical Leadership at BYU, and as associate dean at the BYU Marriott School. John teaches organizational behavior and strategic human resource management courses to Executive MBA, MBA, and undergraduate students, and he has won numerous teaching awards, including the Student Choice Faculty Award. And his research has been published in top management journals and been featured internationally in news outlets. In this episode we discuss the following: John teaches students how to thrive. And the first thing he teaches are the myths of happiness: status, wealth, beauty, power. The motivation to pursue those things and the comparisons we make to others, can lead us to feel hollow and empty. The 14th Amendment clearly, unquestionably, inarguably, and ETERNALLY states that an insurrectionist can't serve in an elected federal or state office, or a lot of other offices, and it doesn't allow anybody to overrule the Constitution because the 14th Amendment already HAS a means for disqualified traitors to appeal – the drafters OF the 14thAmendment BUILT THAT REMEDY IN - and they have already designated two bodies to overrule disqualification under special circumstances, and those bodies are the United States House of Representatives and the United States Senate and if they each vote by two-thirds to let Trump back on the ballot, he's back on the ballot. That is, for all practical purposes, IN the Constitution! And if they DON'T, he's not. That is also, for all practical purposes, in the Constitution! And we KNOW this because it was written, principally, by Congressman John Bingham, a Radical Republican who not only was one of the House Managers for the IMPEACHMENT of President Johnson, but earlier Bingham had been the Assistant Judge Advocate General during the trial of the accomplices of the man who murdered Lincoln, John Wilkes Booth. And if John Bingham's attitude towards insurrectionists wasn't clear enough from the 14thAmendment and the completely justified slow roasting of President Andrew Johnson – just a reminder: the eight co-conspirators charged in the Lincoln Assassination that the co-author of the 14th Amendment PROSECUTED included Mrs. Mary Surratt who ran the boarding house where the conspirators met, and the stagehand at Ford's Theater who did nothing more than hold Booth's horse while he went in and murdered the president. They HANGED half of the defendants – including the woman who ran the boarding house. Three of the other four were given life sentences. The guy who held the horse got six years at hard labor. They DID make a concession to Mrs. Surratt. While they were preparing to hang her and the others they let her sit in a chair. The authors of the 14th Amendment weren't EFFING AROUND. Procedural due process When the government seeks to burden a person's protected liberty interest or property interest, the Supreme Court has held that procedural due process requires that, at a minimum, the government provide the person notice, an opportunity to be heard at an oral hearing, and a decision by a neutral decision-maker. For example, such a process is due when a government agency seeks to terminate civil service employees, expel a student from public school, or cut off a welfare recipient's benefits. The Court has also ruled that the Due Process Clause requires judges to recuse themselves in cases where the judge has a conflict of interest. For example, in Caperton v A T Massey Coal Company (2009), the Court ruled that a justice of the Supreme Court of Appeals of West Virginia had to recuse himself from a case involving a major contributor to his campaign for election to that court. Incorporation. While many state constitutions are modeled after the United States Constitution and federal laws, those state constitutions did not necessarily include provisions comparable to the Bill of Rights. In Barron v Baltimore (1833), the Supreme Court unanimously ruled that the Bill of Rights restrained only the federal government, not the states. However, the Supreme Court has subsequently held that most provisions of the Bill of Rights apply to the states through the Due Process Clause of the Fourteenth Amendment under a doctrine called "incorporation". Whether incorporation was intended by the amendment's framers, such as John Bingham, has been debated by legal historians. According to legal scholar Akhil Reed Amar, the framers and early supporters of the Fourteenth Amendment believed that it would ensure that the states would be required to recognize the same individual rights as the federal government; all these rights were likely understood as falling within the "privileges or immunities" safeguarded by the amendment. By the latter half of the 20th century, nearly all of the rights in the Bill of Rights had been applied to the states. The Supreme Court has held that the amendment's Due Process Clause incorporates all of the substantive protections of the First, Second, Fourth, Fifth (except for its Grand Jury Clause) and Sixth Amendments, along with the Excessive Fines Clause and Cruel and Unusual Punishment Clause of the Eighth Amendment. While the Third Amendment has not been applied to the states by the Supreme Court, the Second Circuit ruled that it did apply to the states within that circuit's jurisdiction in Engblom v Carey. The Seventh Amendment right to jury trial in civil cases has been held not to be applicable to the states, but the amendment's Re-Examination Clause does apply to "a case tried before a jury in a state court and brought to the Supreme Court on appeal". The Excessive Fines Clause of the Eighth Amendment became the last right to be incorporated when the Supreme Court ruled in Timbs v Indiana (2019) that right to apply to the states. Cruel and unusual punishments. General aspects. The Constitution was amended to prohibit cruel and unusual punishments as part of the United States Bill of Rights as a result of objections raised by people such as Abraham Holmes and Patrick Henry. While Holmes feared the establishment of the Inquisition in the United States, Henry was concerned with the application of torture as a way of extracting confessions. They also feared that the federal government would misuse its powers to create federal crimes as well as to punish those who committed them under the new Constitution and thus use these powers as a way to oppress the people. Abraham Holmes, a member of the Massachusetts Ratifying Convention for the federal constitution, for example noted in a letter from January 30, 1788 that the new Constitution would give the U.S. Congress the power "to ascertain, point out, and determine, what kind of punishments shall be inflicted on persons convicted of crimes." He added with respect those who would belong to the new government under the new Constitution: "They are nowhere restrained from inventing the most cruel and unheard-of punishments, and annexing them to crimes; and there is no constitutional check on them, but that racks and gibbets may be amongst the most mild instruments of their discipline." Relying on the history of the Eighth Amendment and its own case law the Supreme Court stated in Ingraham v Wright (1977) that the Cruel and Unusual Punishments Clause was designed to protect those convicted of crimes. The Supreme Court consequently determined in Ingraham that the Cruel and Unusual Punishments Clause limits the criminal process in three ways: "irst, it limits the kinds of punishment that can be imposed on those convicted of crimes, for example, Estelle v Gamble, supra; Trop v Dulles, supra; second, it proscribes punishment grossly disproportionate to the severity of the crime, for example, Weems v United States, supra; and third, it imposes substantive limits on what can be made criminal and punished as such, for example, Robinson v California, supra." In Louisiana ex rel. Francis v Resweber, (1947), the Supreme Court assumed arguendo that the Cruel and Unusual Punishments Clause applied to the states through the Due Process Clause of the Fourteenth Amendment. In Robinson v California, (1962), the Court ruled that it did apply to the states through the Fourteenth Amendment. Robinson was the first case in which the Supreme Court applied the Eighth Amendment against the state governments through the Fourteenth Amendment. Before Robinson, the Eighth Amendment had been applied previously only in cases against the federal government. Justice Potter Stewart's opinion for the Robinson Court held that "infliction of cruel and unusual punishment is in violation of the Eighth and Fourteenth Amendments." The framers of the Fourteenth Amendment, such as John Bingham, had discussed this subject: Many instances of State injustice and oppression have already occurred in the State legislation of this Union, of flagrant violations of the guaranteed privileges of citizens of the United States, for which the national Government furnished and could furnish by law no remedy whatsoever. Contrary to the express letter of your Constitution, "cruel and unusual punishments" have been inflicted under State laws within this Union upon citizens, not only for crimes committed, but for sacred duty done, for which and against which the Government of the United States had provided no remedy and could provide none.

https://www.larchitect.org/ Today's conversation is centered around a post-industrial site on the north-eastern edge of Paris, known as Chapelle Charbon, that is soon to become a new public park for the city of Paris. As a former rail depot, the 6.5 hectare (or 16 acre) site will be developed in several phases over the next decade. As part of this process, the design firm Taktyk was commissioned to design a temporary park called La Parc de 12 Saisons or The 12 Seasons Park, that evolved over a three-year period between 2017 and 2020. Around the same time that Taktyk began their work, two other curious site explorers stepped into the scene, driven by an artistic interest in the sonic qualities of the terrain, giving voice to a historic space that had been essentially forgotten about for decades. The story begins with a serendipitous encounter between three people: Sébastien Perfornis of the landscape design firm Taktyk, John Bingham-Hall from the artistic organization Theatrum Mundi and Alexandra LaCroix, director of the opera company MPDA. We met in person in the office of Theatrum Mundi in the 8th arrondissment of Paris at the beginning of March 2020. Taktyk was represented by landscape architect Yara Falaka. Richard John Bingham was born on December 18th 1934 in London, and has earned an episode on this podcast because he just disappeared after a really weird set of circumstances that ended in the murder of Sandra Rivett and the hospitalization of Veronica Lucan. Although humble about his own abilities, Paul was proficient enough to play representative junior soccer for a couple of years along with his club soccer with Woonona (and school soccer with Woonona High School).His senior career started with Fairy Meadow under 18s in the Illawarra Premier League in 1977 while he was still dual registered with his junior club Woonona. The first couple of years at Fairy Meadow allowed him to play with his brother and good friend Dean Gardiner. Added to this his U18 team had success winning the Kass Cup a couple of times.Paul was approximately 16 and a half years old when he joined the Bellambi Rosellas after being asked to come across by his former high school teacher John Frew. Here he played first grade under John Frew and other experienced senior players such as Rob Banks, Tony Gill and Geoff Farrar. He learnt a lot at Bellambi and after this he joined Wollongong United with his brother, Dean and the Sattin brothers in 1981.Here in State League 2nd division he was coached by Mike Johnson, a coach that had an enormous influence on his football career as well as his life. Mike was an intense man and it was fascinating to hear Paul discuss his time with Mike. For several years he played with Wollongong United/Wollongong Macedonia along with many team mates. His time at this club was highlighted by the state league derbies between Fairy Meadow, another intense coach in John Bingham and Paul’s ability to play alongside very good friends.In 1989 Paul went across to Fairy Meadow Italia under Glenn Fontana in the state league for a year. Unfortunately Fairy Meadow folded at the end of that year and this was a sad event for Paul and the Illawarra. Next he went to Bellambi Rosellas for a second stint as a player under Steve Quirk. After a couple of seasons he then moved on to Coniston Makedonija with former team mate, friend and now coach Harry Sattin in 1992. They had a successful year as Coniston won the league championship and were grand finalists.In 1993 he joined Fernhill SC as their coach Larry Gaffney rang him and at the time it suited Paul’s personal life. Paul played at Fernhill for a few seasons and amongst playing with a great club, he discusses former team mate Scott Chipperfield and very good friend and team mate Claudio Cellini. It was very insightful to hear Paul’s thoughts on both men who have contributed a lot for our game in the Illawarra.Paul thought he had retired from first grade football in 1998 after finishing with Fernhill and he started to play with an amateur team. But he was mistaken as Woonona Sharks coach Ian Cirson saw him play for the amateur team in the pre-season Corrimal Leagues Knock out in 1999. Ian liked what he saw and called Paul up and at the age of 37 Paul played 1 year in premier league at the club where he started his football career thirty years prior.For me the interview with Paul was fantastic as I learnt a lot about him, especially the Macedonia days where he played at a high level with his brother and 5 to 6 very good friends. Paul has longevity and a passion for the game in the Illawarra. He played at a high level across two decades, with strong and successful teams (and coaches). Publicly I would like to pay my respects to him as he allowed me the time to speak with him for over two hours. I hope you enjoy the interview as much as I enjoyed recording it.

Additionally I would like to say thank you to the people who contribute, comment and reminisce on the social media pages.This episode’s interviewee John Bingham was born in 1949 in Ilkeston in the United Kingdom and started playing football with friends in his street at the age of 4. The spark that drove him to play football professionally was supporting and watching Nottingham Forrest as a boy and seeing the best players in the World at the City Ground.John Bingham played football at primary school and high school. In high school he was chosen in the local representative team and during one of these representative games a scout from Charlton Athletic saw John play and asked him to go down to London for a trial. Charlton Athletic then offered him an apprentice professional contract at the age of 15 and this is where his professional career started.In this first few years of his professional football career in England, John’s talent gave him the opportunity to trial for the England Youth team and after several trials, John at 18 years of age was selected for his country and played friendlies against Birmingham City, Sunderland and 2 internationals against France. Additionally at this point in time he moved to Manchester City, one of the biggest clubs in England at the time. And he was signed by one of Manchester City’s greatest managers Joe Mercer. After a surreal experience training amongst internationals and playing in the reserves team for two years John moved on.John then played for Oldham Athletic, Mansfield Town, Chester and Stockport County. In 1973 Jim Kelly, who had played and coached in Australia with South Coast United, asked John if he wanted to sign a 15 month contract with Safeway United in Australia. John then came out to Australia in June 1973.John then played for Safeway United, Balgownie, Wollongong City and Fairy Meadow. He then went on to be a successful player-coach at Berkeley, Shellharbour Workers and Wollongong Macedonia.At the end of 1986 John’s personal life had changed, which meant that John now had different life goals and coaching had dropped off his radar and in 1987 John stayed in the game by playing with Warilla Wanderers. He then went onto play with Fairy Meadow Italia, had a second coaching stint with Wollongong Macedonia and played with Corrimal Rangers.John saw out his footballing days playing church league down in Kiama as a striker. John was tremendous to interview and I respect him for giving up his time and going through his footballing journey. I thoroughly enjoyed interviewing John and I hope you enjoy listening to this episode!

John Bingham was one of the most influential but least known visionaries of the post-Civil War Constitution. Dubbed “the James Madison of the 14th Amendment” by Justice Hugo Black, Bingham drafted a constitutional provision that changed the course of American history by ensuring that states were duty-bound to uphold their citizens’ constitutional rights. A moderate Republican and dedicated supporter of abolition before the Civil War, Bingham spearheaded the Reconstruction-era efforts to guarantee citizenship to all people born in the United States, regardless of race, and to extend the Constitution’s promise of equality to all American citizens. Gerard Magliocca is the Samuel R. Rosen Professor at the Indiana University Robert H. McKinney School of Law and the author of the definitive biography of Bingham. Kurt Lash is the E. Claiborne Robins Distinguished Chair in Law at the University of Richmond School of Law and the author of the book The Fourteenth Amendment and the Privileges or Immunities of American Citizenship. He is the TRLS June Book Club author, for his book, Super Mind: How to Boost Performance and Live a Richer and Happier Life Through Transcendental Meditation. Rosenthal has SAD himself and talks about his experiences with the disorder. He talks a bit about the signs/symptoms of SAD versus when you have the “winter blues.” When meditating, you get fluxes of alpha waves, especially in the frontal areas of the brain, that are soothing. Rosenthal talks about brain coherence, which means different parts of the brain experience the same wavelengths at the same time. This is associated with the brain collaborating and being more efficient. He explains the difference between mindfulness and medita Kari talks about the “Jon Kabat-Zinn” way of meditation and Deepak Chopra and Oprah's meditation class. Kari talks about mindfulness stress-based reduction training. Transcendental meditation can help in the following ways: connecting body and mind, building a better brain, being in the zone, having internal growth, asking yourself, “Who do I want to be?”, being engaged with relationships or work, accepting losses, and so on. Rosenthal points out two particular chapters: Meditate and Grow Rich and Meditate and Grow Happy. Kari mentions one story in Transcendence: Healing and Transformation Through Transcendental Meditation with Ray Dalio. They discuss sleep and transcendental meditation. He speaks to practicing transcendental meditation and running. During transcendental meditation, according to Rosenthal, the brain delivers you gifts from your subconscious. Rosenthal speaks to how parts of the government/the National Institutes of Health (NIH) are using transcendental meditation. They are mostly a source of insoluble fiber. Serena reviews the difference between soluble and insoluble fiber. She also defines what a “standard American diet” looks like. When transitioning from a standard American diet to a more nutrient-rich diet, many people have issues increasing their fiber intake. As you increase vegetables, steam them or chop them up finely to break down the cellulose/fiber to help digest them with less intolerance. Gratitude Jar (Woot! Woot!) John Bingham, known as Lord Lucan, was a charismatic noble with expensive tastes and a gambling habit who separated from his wife in 1972 and lost custody of his children in 1973. On November 7th, 1974 someone killed the children's nanny and attacked Binghams's wife. The Lord was heard from briefly the following day and then disappeared. Where did he go?
Never heard of John Bingham? That's a shame. He shouldn't be mysterious at all. For while Thomas Jefferson claimed that "all men are created equal," John Bingham actually wrote equality into the Constitution. What a novel idea.
