The question of whether the Fulton County trial of Donald Trump and his co-defendants will be removed to federal court is now before the Eleventh Circuit Court of Appeals, and it's on its way to the Supreme Court. Judge Steve Jones of the District Court in the Northern District of Georgia denied Mark Meadows' motion for removal. He has now also denied an emergency stay of that ruling, and so the question goes to the appeals court in the federal system, even as the underlying criminal case percolates along in Fulton County court in Georgia. To discuss it all, Lawfare Editor-in-Chief Benjamin Wittes sat down with Lawfare Legal Fellow Anna Bower, Lawfare Senior Editor Alan Rozenshtein, and Lee Kovarsky of the University of Texas Law School, who recently wrote a piece on the subject for Lawfare. They talked about the right standard for removal and whether Meadows should be yanked out of Fulton County court, what the Eleventh Circuit and the Supreme Court are likely to do with it, how long they are going to take, and whether the federal litigation will screw up the timing of the Fulton County prosecution.Support this show http://supporter.acast.com/lawfare. On July 19, 2023, historian and bestselling author, Kevin R. C. Gutzman, presented the 2023 Hazel and Fulton Chauncey Lecture. Before the consecutive two-term administrations of Presidents Bill Clinton, George W. Bush, and Barack Obama, there had only been one other trio of its type: Thomas Jefferson, James Madison, and James Monroe. Kevin R. C. Gutzman's The Jeffersonians is a complete chronicle of the men, known as The Virginia Dynasty, who served as president from 1801 to 1825. The three close political allies were tightly related: Jefferson and Madison were the closest of friends, and Monroe was Jefferson's former law student. Their achievements were many, including the founding of the opposition Republican Party in the 1790s, the Louisiana Purchase, and the call upon Congress in 1806 to use its constitutional power to ban the importation of enslaved people beginning on January 1, 1808. Gutzman's new book details a time in America when three presidents worked toward common goals to face challenges and strengthen our republic in a way we rarely see in American politics today. Kevin R. C. Gutzman is Professor of History at Western Connecticut State University and a faculty member at LibertyClassroom.com. He has his law degree from the University of Texas Law School and his Ph.D. in American history from the University of Virginia. His books include Thomas Jefferson—Revolutionary; James Madison and the Making of America; Virginia's American Revolution; Who Killed the Constitution? (with Thomas Woods); and The Jeffersonians: The Visionary Presidencies of Jefferson, Madison, and Monroe. The term shadow docket refers to the decisions and orders of the Supreme Court outside of the traditional cases. Shadow docket cases generally lack the formal briefings, oral arguments, and reasoned, lengthy opinions of the merits cases. Over the last few years, the Court has increasingly used these decisions to address high-profile and politically-charged issues such as immigration, election disputes, pandemic restrictions, and abortion bans.In this interview, Prof. Steven Vladeck (University of Texas Law School) breaks down this shift in power at the High Court and offers detailed analysis and a critique of the increased use of the shadow docket and what it might mean for the Court's already-tarnished prestige.  (1hr)

Gutzman's THE JEFFERSONIANS: The Visionary Presidencies of Jefferson, Madison, and Monroe (St. Martin's Press) is a complete chronicle of the men, known as The Virginia Dynasty, who served as president from 1801 to 1825 and implemented the foreign policy, domestic, and constitutional agenda of the radical wing of the American Revolution, setting guideposts for later American liberals to follow. The three close political allies were tightly related: Jefferson and Madison were the closest of friends, and Monroe was Jefferson's former law student. Their achievements were many, including the founding of the opposition Republican Party in the 1790s; the Louisiana Purchase; and the call upon Congress in 1806 to use its constitutional power to ban slave imports beginning on January 1, 1808. Of course, not everything the Virginia Dynasty undertook was a success: Its chief failure might have been the ineptly planned and led War of 1812. In general, however, when Monroe rode off into the sunset in 1825, his passing and the end of The Virginia Dynasty were much lamented. On August 8, the FBI searched Mar-a-Lago, former President Donald Trump's home in Palm Beach, Florida. They seized 11 sets of documents, some of which were labeled “top secret.” Later in the week, a federal judge unsealed the search warrant, which stated that Trump was being investigated for possibly violating the Espionage Act and two other criminal statutes. John Yoo of the University of California at Berkeley and Steve Vladeck of the University of Texas Law School join host Jeffrey Rosen to talk about the raid, the investigation, and the constitutional questions that arise out of it. Whether it is investing in startups, running public companies, or navigating major world crises, this week's guest is all about keeping things right side up. It isn't only companies that he aims to keep afloat. This week's guest has been featured in Forbes, Inc., Yahoo Finance, Newsweek, and Bloomberg to name a few. Investor, entrepreneur, and skilled navigator of both the ocean and the boardroom, Mark Watson is this week's guest on “The Jake Dunlap Show.” Mark is a natural born leader, and from a young age always aspired to be a businessman. However, his reality was much different, as his parents divorced at age 7. His mother couldn't afford jeans, so he wore polyester pants and had subsidized school lunch. After studying Finance at Southern Methodist University, Mark went to The University of Texas Law School before tackling multiple finance and general counsel roles. After achieving his own childhood goal of being a successful businessman, he decided to help other entrepreneurs meet their goals. Mark is a true believer that all of your skills will come together. Over the years, Mark embodied the notion of being an entrepreneur differently, and is a true believer that all skill will come together. He was even fortunate enough to share some boardroom bonding time with his Dad, who he credits for tutoring him in the world of business. In 1998, Mark sensed that technology was going to significantly transform business and the economy, so he started Aquila Capital Partners to support and invest in companies that leverage potentially transformative technologies. It is their mission to support the next generation of entrepreneurs building purpose-driven, innovative technology-enabled companies. Please enjoy this week's episode with Mark Watson. Mark's Social Links:Website: https://markewatsoniii.com/ https://www.aquilacapitalpartners.com/Facebook: https://www.facebook.com/markewatsoniiiTwitter: https://twitter.com/markewatsoniiiLinkedIn: https://www.linkedin.com/in/markewatsoniii/  Jake Dunlap:Personal Site - http://jakedunlap.com/LinkedIn - https://www.linkedin.com/in/jakedunlap/Twitter - https://twitter.com/JakeTDunlapInstagram - http://instagram.com/jake_dunlap _Facebook - https://www.facebook.com/JakeTDunlap/ Skaled:Website - https://skaled.com/LinkedIn - https://www.linkedin.com/company/skaledYouTube - https://www.youtube.com/channel/UCsw_03rSlbGQkeLGMGiDf4Q
