Thursday, May 11th, 2023   Judge Victoria Pratt was Chief Judge in Newark Municipal Court in New Jersey and the author of The Power of Dignity. She is currently the Executive Director of Odyssey Impact, an interfaith non-profit driving social change through innovative storytelling and media. We discuss procedural justice, municipal court reform, and increasing the public's trust in the justice system.    Tough-on-crime laws are ineffective. Punishing people for wrongdoing does not change behavior. Judge Pratt asserts her authority when she understands the people who appear in court before her. People obey the law when they are treated with respect and dignity, because then they view the people who impose rules and laws as legitimate authorities. Judge Pratt has a written a book called The Power of Dignity: Transforming Criminal Justice which delves into her work in and out of the courtroom. Having looked for alternatives to the criminal justice system for many years, Judge Pratt is an advocate of community solutions and going deeper than your average courtroom. Her TED talk, "How Judges Can Show Respect," has been viewed over thirty million times and is well worth a watch. In this podcast episode we speak about the many ways in which the justice system needs to change and how judges and police officers need a tangible link to their communities in order to understand the people in which they deal with. This week's guest is Judge Victoria Pratt. Driven. Innovative. Inspiring. These are a few of the words used to describe Judge Victoria Pratt who has gained national and international acclaim for her commitment to reforming the criminal justice system. During her tenure as the Chief Judge in Newark Municipal Court in Newark, New Jersey, she spent years gaining a deep understanding of how justice could be delivered to court participants in a manner that increased their trust in the legal system and changed their behavior. While presiding over Newark Community Solutions, the Community Court Program, she used creative problem solving to provide alternatives to jail to low-level offenders. These alternatives included community service, individual and group counseling sessions, and her signature assignment of introspective essays. Called a pioneer in procedural justice, her respectful approach, and treating individuals with dignity has had a positive effect on court participants' court experience, how the community viewed the court and how court players viewed their roles. Her TED Talk, How Judges Can Show Respect, has gone viral. It has been translated into 11 languages, received over one million views and the Facebook clip has received an astounding 21 million views. A fierce advocate committed to reform, Pratt has worked with jurisdictions across the nation, and as far as Ukraine, England, Trinidad and Tobago, and Mexico. In that role she facilitates workshops and presentations on alternative sentencing for juveniles and adults, as well as procedural justice. As a nationally recognized expert in procedural justice and alternative sentencing, Judge Pratt has been asked by numerous professional organizations to share her story and philosophy. Pratt's work has been featured in The Guardian newspaper, The Simple Idea that Could Transform U.S. Criminal Justice, and Rutgers Magazine, Asking for a Little Respect, both written by Pulitzer prize winning author Tina Rosenberg. The United States has one of the biggest populations of incarcerated individuals in the world. According to the Sentencing Project, the number of people sent to prisons and jails had already increased by over 500% over the last 4 decades.And yet, a growing body of literature shows that as many as 20% of those incarcerated are wrongfully convicted. Worse, the country has a high recidivism rate. At least 65% are rearrested, while 50% go back to prisons and jails.What causes this? Research on procedural justice suggest that when court users perceive the justice process to be fair, they are more likely to comply with court orders and to follow the law in the future— regardless of whether they “win” or “lose” their case. Today we have an in-depth discussion about the implications of procedural justice by interviewing Judge Victoria Pratt, a nationally acclaimed judge and professor at Rutgers Law School whose TED Talk, How Judges Can Show Respect, has over one million views. We begin the interview by discussing Judge Pratt’s motivation for pursuing a judgeship (21:15), her experiences as the Chief Judge in Newark Municipal Court (24:00), and her innovative approach to justice in the courtroom (27:10).
