Private Military Contractors and The Rise & Fall of the Mozart Group w/ David Isenberg

On this edition of Parallax Views, David Isenberg, a long time independent researcher into the subject of PMCs (private military companies) and PMSCs (private military and security companies) and bloggers at the Isenberg Institute of Strategic Satire, joins us to discuss his article "The Rise and Fall of the Mozart Group". The Mozart Group was founded amidst the 2022 Russian invasion of Ukraine by two former U.S. Marine colonels, Andrew Milburn, at one time the Deputy Commander of Special Operations Command Central, and Andrew Bain, who since leaving the military has become a Ukraine-based businessman. Composed of Western military veterans, the Mozart Group sought to assist in efforts during the war by serving as a private military company that offered military training and evacuations. Named in part as a cheeky reference to Russia's infamous Wagner Group, the Mozart Group, in Isenberg's word, "positioned itself as the reverse, good-guy version" of said group (though, as Isenberg notes in the beginning of our conversation the Wagner Group and the Mozart Group are different in terms of the actions they take and should not be considered simple Western Vs. Russian versions of each other). Although the Wagner Group garnered a great deal of positive press in the past year as a humanitarian group helping Ukraine, it has since shuttered it's operation amidst a thorny lawsuit between co-founders Bain and Milburn. In said lawsuit, Milburn has been accused of misrepresenting the Mozart Group as a non-profit, 501(c)3 charity to journalists despite it being registered as a for-profit LLC. (limited liability company) business. The complex lawsuit also includes complaints Milburn soliciting for donations/funding that went into Milburn's personal or other accounts rather than the Mozart Group. Another issue that comes up with regards to the lawsuit is Milburn hiring a Ukrainian woman he met on a dating app to work for the Mozart Group and paying her a $90,000 annual salary that far exceeded that of other Ukrainian-based employees. On the other hand, Milburn-supporter Jeffrey Carr of the Inside Cyber Warfare Substack, recently accused Andrew Bain of having ties to Russia and the Taliban as well as war profiteering. In this conversation, Isenberg offers his thougths on both the lawsuit against Milburn as well as his thoughts on the accusations Carr made against Andrew Bain. Isenberg also discusses some juicy details that he can't discuss in-too-much detail at this time that did not make it into the article and indicate that the Mozart Group was seeking to move away from its specific work in regards in Ukraine and becoming a more broadly-focused private military company. We'll also discuss more broadly the problems/issues surrounding private military companies; lack of regulation/oversight in regards to PMCs; Star Trek and the Ferengi Rule of Acquisition No. 34: “War is good for business"; Erik Prince, Blackwater, and the Iraq War; the Mozart Group vs. the Wagner Group; war profiteering; the problem with mixing charity work and military functions together under one roof; why David doesn't use the term "mercenaries" when talking about PMCs; should Ukraine be concerned about working with PMCs?; was Bain trying to expand the Mozart Group into working in other regions where their services weren't wanted?; and more!

Jeffrey Carr has been an internationally-known cybersecurity adviser, author, and researcher since 2006. He is the founder and organizer of Suits & Spooks (now Safe House Global), a “collision” event to discuss hard challenges in the national security space. | Jeffrey has contracted with the CIA's Open Source Center's Eurasia Desk as a Russia SME (2010), and has provided cyber intelligence briefings to the DIA, the FBI, and the Chief of Naval Operations Strategic Study Group. He has been a frequent lecturer at the U.S. Air Force Institute of Technology and the U.S. Army War College, and was a technical peer reviewer for Tallinn 2.0, the second edition of the Tallinn Manual on the International Law Applicable To Cyber Operations. - The first S&S gathering, ten years ago, was based on the concern that social media was becoming a dangerous tool for disinformation...how right that was | - With September's event we're focusing on Ukraine's defense against the Russian invasion | - Gazprom, the Russian oil company, has had at least three unexplained explosions in recent months...this is a perfect example of "multi-modal warfare" | - Adversaries no longer require physical access to damage the enemy's resources | - "Robot surgery" has caused many more injuries and deaths than the medical industry is talking about...what if these basic malfunctions could be weaponized? 00:34 We have an interesting balancing, you know, there's checks and balances baked into the system of liberty, freedom, freedom of capitalism or freedom or controls in a capitalized a capitalistic controlled system like you're describing, the Soviets discovered that central control is extremely cumbersome, but effective control. And in the end, you know, they collapse from the weight of trying to control everything. 4:07 The US doesn't have a choice anymore, and hasn't had a choice for a number of years, where it must go outside of his borders, to hire talent. 5:04 We have not emphasized science and math, in our educational system here, and other countries have. So we're relying on those individuals with those skills from outside of the US. Same with getting the necessary components, right to supply our, our products, or having even having products made overseas, that for whatever reason, you know, we can't afford the labor or we can't afford some other aspect of it. 10:26 There are costs to that distrust, massive costs downstream, we're going to find we're finding already, no man is an island. This is fundamentally the same as interpersonal relationships. 19:41 Your news feed should have a mix of points of view. So that it gets you to think well, how can two things be true? Well, probably it cannot. So how do you discern what's real and what isn't? And because in that happens when you have a variety of points To view, on the other hand, social media does not do that it does the exact opposite. 25:06 I think it has to come down to individuals making informed choices about what they do and why they do it. And what the repercussions are if they don't do it. And then hopefully they'll, you know, make the right choice.

In intelligence we're always questioning our assumptions | - Critical thinking requires an understanding of the at least 60, distinct, "logical fallacies" humans tend to slip into | - Safehouse.Global was originally called "Suits and Spooks" | - Safehouse is a series of convocations designed to bring disparate voices to the table and improve shared understanding for better national security solutions | - It's only through expanding our view that we can recognize real threats to security...for example, the Chinese and American governments are both "experiments" in national structures - but ours is not working as effectively as theirs, in real time. 1:32 We need to be a better people, we as human beings, we as Americans need to be more open minded more according to our ideals, the the idea of diversity, the idea of honoring dissent, discussing with respect debating things effectively. And that's where it's important to bring in different voices and different perspectives. So we'll be talking about an organization, a series of events that were formerly called suits and spooks. 5:29 So, in order to help determine what's true, or what's, you know, objectively provable, you have to invite alternative views. That's the only way that that you'll be able to discover what's hiding behind your particular set of biases. 20:18 So the system that we have in place for determining what is secure and and what is not secure is it's really, it's really never secure. It's only what degree of insecure Are you willing to accept? 26:27 That's the price we paid. When we adopted the internet. And we adopted moving everything to the cloud, right? The benefit, the benefits are many. Downside, you're more vulnerable now than ever before.

In this second of a two-part interview, we continue our conversation with Jeffrey Carr, a trailblazing general counsel who describes his career as decades spent on the radical fringe of reforming legal services delivery. Many of his ideas for revamping legal departments, once viewed as radical, have now become mainstream.  As general counsel at FMC Technologies in the early 2000s, Carr disrupted how legal departments hire and compensate outside counsel, creating models that today are considered standard operating procedure at many companies.  After retiring from FMC in 2014, he went on to work with Valorem Law, one of the earliest law firms to focus on making alternative fee arrangements the norm. Valorem became the progenitor of ElevateNext, the law firm affiliate of the global law company Elevate. Carr returned to a GC role in 2019 at Univar Solutions, where he sought to build the law department of the future. Now retired, he teaches, writes, and pursues his hobby of driving race cars.  Last week, in part one of the interview, Carr spoke with host Bob Ambrogi about how he landed on the “radical fringe” of reforming legal services, and he discussed some of the trailblazing initiatives he created at FMC, including the Alliance Counsel Engagement System, or ACES, a method of hiring outside counsel so unique that he was encouraged to patent it. In this second installment of the interview, Carr discusses another of the initiatives for which he is known, the Litigation Value Challenge, which came to be emulated by the Association of Corporate Counsel and many of its members. Carr and Ambrogi also dive into his recent post at Bill Henderson's Legal Evolution blog, Four Waves of Change in #LawLand, in which he lays out his framework for making the legal system better.  Thank You To Our Sponsors This episode of LawNext is generously made possible by our sponsors. Ray McGovern discusses the lasting impact of the “Russiagate” conspiracy, which Democrats have continued to push throughout President Trump’s entire first term. McGovern reminds us that according to recorded testimony released only this year, CrowdStrike (the technology tasked with investigating the DNC email leak) admitted all the way back in 2017 that they had no evidence for the allegation that Russian agents had perpetrated any sort of hack. That means that a narrative that has continued to dominate the mainstream media and Democratic political discourse for three years was known to have absolutely no basis in fact. McGovern fears that the very same tactics used to rein in Trump could be turned around and used on Biden, were he to defeat Trump later this year. Although McGovern strongly opposes the Trump presidency, he regrets the fact that a Biden victory would most likely mean that this whole scandal gets swept under the rug. Carr discusses Crowdstrike's history of bad calls, including having to recently rewrite a report on alleged Russian hacking in Ukraine. The Ukrainian government as well as other cybersecurity experts heavily disputed Crowdstrikes initial claims. Carr also offers a broader view of the cybersecurity industry and why firms like Crowdstrike are incentivized to often make specious claims concerning attribution of a hack. For firms like Crowdstrike, there's no financial downside in pretending to be able to attribute a hack as the nature of cyber makes it hard to prove or disprove an attribution.
