The privacy Americans should enjoy over their financial information has been in steady decline for more than 50 years. Regulatory frameworks, such as the Bank Secrecy Act and the Securities and Exchange Commission's Consolidated Audit Trail, grant government access to Americans' financial transactions. As financial services have become increasingly digitized, the volume of financial records to which the government has easy—and often unfettered—access has grown exponentially. And proposals for a central bank digital currency, which involve the government becoming more intimately involved in Americans' use of money, have the potential to further erode the ability to transact without government surveillance. As policymakers are confronted with questions about evolving technologies, the question of financial privacy must not be shunted to the side. It is time to rethink financial privacy. Does financial convenience have to come at the cost of financial privacy? Does the Constitution provide the protections needed to limit government access to financial information? Can decentralization provide privacy-protecting solutions? Join us for an outstanding program featuring leading policymakers and experts discussing financial privacy at Cato's Center for Monetary and Financial Alternatives annual conference. Hosted on Acast. This Day in Legal History: King Louis XVI ExecutedOn January 21, 1793, King Louis XVI of France was executed by guillotine in Paris after being convicted of treason during the French Revolution. His trial was conducted by the National Convention, a revolutionary body tasked with dismantling the monarchy and establishing a republic. Accused of conspiring against the French people and aiding foreign powers to suppress the revolution, Louis faced mounting evidence, including secret correspondence discovered in the Tuileries Palace. The Convention voted on his fate, and the verdict was close: 387 deputies supported his execution, while 334 opposed or suggested alternatives, such as imprisonment or exile. This slim margin highlighted deep divisions within the revolutionary government. On January 20, Louis was sentenced to death without delay. The following day, he was brought to the Place de la Révolution (now Place de la Concorde), where a large crowd gathered to witness the historic event. Before his execution, Louis attempted to speak to the crowd but was drowned out by drum rolls. Moments later, the guillotine fell, marking the end of his reign and symbolizing the revolutionary shift in France from monarchy to republic. His death intensified political upheaval, leading to the radicalization of the revolution and the Reign of Terror. It also caused shockwaves across Europe, as monarchs in neighboring countries viewed the event as a direct threat to their own thrones. The trial and execution of Louis XVI remain pivotal moments in legal history. They demonstrated the rise of the concept of sovereign accountability—placing a king on trial as a common citizen, judged by a revolutionary tribunal. This marked a turning point in the relationship between rulers and their subjects, challenging the divine right of kings and setting a precedent for constitutional governance.U.S. President Donald Trump announced the creation of the Department of Government Efficiency (DOGE), an advisory group intended to propose significant cuts to the federal government, including eliminating agencies and reducing federal jobs by 75%. Co-led by Tesla CEO Elon Musk and former presidential candidate Vivek Ramaswamy, the group has no formal power to implement its proposals. Legal challenges emerged immediately after the announcement, with groups like National Security Counselors and Citizens for Responsibility and Ethics in Washington arguing the initiative violates federal advisory committee regulations. Critics question DOGE's legal status and operational transparency, with additional lawsuits filed by unions and public health organizations. Meanwhile, Ramaswamy appears to be stepping away from the initiative to pursue a gubernatorial campaign in Ohio. Advisory groups aimed at government efficiency have a mixed history; a similar effort under President Ronald Reagan produced limited results. Observers remain skeptical of DOGE's potential impact, given its vague structure and controversial proposals.Trump creates "DOGE" advisory group, attracting instant lawsuits | ReutersIn his final hours as president, Joe Biden issued a series of preemptive pardons, including for family members and critics of incoming President Donald Trump. The pardons protected prominent figures such as Gen. Mark Milley, Dr. Anthony Fauci, and members of Congress involved in the January 6 investigation. Biden also pardoned his siblings and their spouses, citing a desire to shield them from potential politically motivated retaliation by Trump. The move, unprecedented in scope, aimed to prevent the reputational and financial damage of investigations Biden described as baseless and partisan.Biden's decision was influenced by Trump's public threats to target his adversaries upon taking office. Critics, including Trump's allies, condemned the pardons as an abuse of executive power, while recipients like Milley and Fauci expressed gratitude for the protection. Biden emphasized that the pardons did not imply guilt but were a safeguard against potential retribution. Some legal experts questioned the effectiveness of the pardons, noting they only apply to federal criminal charges and could make recipients more vulnerable to testimony demands in other proceedings. Biden acknowledged the controversial nature of the decision but deemed it necessary under what he called "exceptional circumstances." The pardons have sparked debate over their implications for future presidential clemency.Biden issues preemptive pardons for Trump critics and Biden family members | CNN PoliticsJames McHenry, a long-time immigration attorney with the U.S. Justice Department, has been appointed as acting attorney general while awaiting Senate confirmation of President Donald Trump's nominee, Pam Bondi. Previously, McHenry led a Justice Department unit focusing on immigration during Trump's first term.Additionally, Emil Bove, formerly Trump's defense attorney, has been named acting deputy attorney general. The White House also appointed Brian Driscoll as acting FBI director following the retirement of the FBI's deputy director, Paul Abbate. Driscoll previously led the FBI's Newark office. The number of homeless in the United States has grown by a third during the Biden years despite steady economic growth since the end of the pandemic. So how did this happen? Why did a rising tide not only fail to lift all boats, but now threatens to drown an even greater number of Americans living on the margins -- and under bridges, on sidewalks and in their cars? Jimmy speaks with Food Not Bombs founder Keith McHenry about the history of homelessness, why the problem remains so entrenched in the U.S. and why purported attempts to solve it have failed so spectacularly. Jimmy and McHenry then discuss where the tens of billions of dollars that have been allocated to solve the homelessness crisis really went since they're obviously not being used as intended by the voting public.

They discuss the joys of small business growth, vital entrepreneurial habits, and strategies for team building, encompassing wins, blunders, and invaluable advice. And a snapshot of the final five Grow A Small Business Questions: What do you think is the hardest thing in growing a small business? Mike McHenry believes the hardest part of growing a small business is managing people. He emphasizes that while people are the greatest asset, they can also be the biggest challenge. Success comes from hiring for cultural fit over skill alone, fostering trust, and building a supportive and aligned team culture. He stresses that having the right people who follow effective processes is essential for delivering outcomes and sustaining growth. What's your favourite business book that has helped you the most? Mike McHenry's favorite business book is "The E-Myth Revisited" by Michael Gerber. He appreciates its focus on the importance of systems and processes in creating scalable and successful businesses. Mike considers it a foundational read for anyone starting or running a business, highlighting how it teaches entrepreneurs to understand their customers deeply and build businesses that feel personal and supportive. Are there any great podcasts or online learning resources you'd recommend to help grow a small business? Mike McHenry recommends exploring sales-focused podcasts and resources like Simon Sinek's insightful YouTube content, which emphasizes people and leadership challenges in the modern era. While he doesn't follow specific podcasts regularly, he values recommendations from trusted contacts and seeks out learning opportunities that align with his interests. What tool or resource would you recommend to grow a small business? Mike McHenry highlights culture as the most critical "tool" for growing a small business. He emphasizes creating a people-first environment where empathy, respect, and collaboration are central. Building strong relationships with employees and customers fosters trust and engagement. Additionally, he recommends developing clear systems and processes to deliver consistent outcomes. McHenry advises asking, "What do I want people to say about my business when I'm not in the room?" and aligning your actions to achieve that reputation. What advice would you give yourself on day one of starting out in business? Mike McHenry's advice to himself on day one of starting out in business is: "Don't panic. It's going to be okay." He stresses the importance of staying calm, focusing on the bigger picture, and forgiving yourself for mistakes, as they are part of the journey. He encourages new entrepreneurs to approach business as a game, focus on their intent, and trust that things will work out with perseverance and a people-first mindset.
