    Slam the Gavel welcomes Randy Hayes, Cynthia Misfud and Holly Hayes to the show to explain what has happened to their mother who has been placed in a Guardianship through a family member. Their niece had absconded with their mother on May 1, 2021 and Cynthia then filed for guardianship not knowing how corrupt it really is. Her Mother's Guardian ad Litem refused to talk to Cynthia or her brothers and never came to see her home where her mother lived for over two years. This niece had her mother sign a revocation of Cynthia's Power of Attorney after having dementia for 5 years.      However, the niece also notarized it. Now they have been isolated from their mother for over a year now, including 27 family members.     The siblings went to New York State Capital on May 23, 2021 to introduce a new bill called Karilyn's Law that would prevent isolation of family in a guardianship. The niece got personal protection order against the family so she could isolate their mother. She even tried to have Cynthia arrested when she was at the hospital with her son who has a brain condition and had just had a seizure. Cynthia has well over $100,000 in legal fees. Randy Hayes, 34, pleaded guilty in 2019 to a felony count of deprivation of civil rights under the color of law. He has remained free on bond as he has awaited his sentencing. A judge sentenced Hays Tuesday afternoon to 52 months in prison and two years of probation. Prosecutors wanted 70 months, while the defense was asking for 36 months. The 1980s saw a new consciousness of environmental awareness, particularly around the Earth's rainforests. Scientists had discovered that, aside from their enormous biodiversity, rainforests also helped to keep carbon from being released into the atmosphere. Corporations in the U.S. and Europe saw tropical rainforests as a means for profit. For a long time, Indigenous communities had stood against industrial development and deforestation. And by the 1980s, environmental groups in Europe and Australia had been actively fighting deforestation on a grassroots level. But in the U.S. environmental movements had failed to evoke widespread activism on the subject. This episode is about the emergence of rainforest movements in the U.S. during the 1980s with one of the founders of Rainforest Action Network (RAN)-- Randy Hayes. We interview Randy about the history of the movement to save tropical rainforests, the founding of RAN, corporate campaigning in the early days of RAN and being in solidarity with Indigenous communities around the globe. Randy also talks about biodiversity loss and the ever smaller window of opportunity we have to halt and reverse the very worst of the damage. This past summer there was a brief flaring of concern about rainforest destruction in the Brazilian Amazon. Panicked headlines portrayed the whole region as on fire, the President of France took the President of Brazil to task, and ‘the lungs of the planet” were said to be risk. Brazil’s Foreign Minister responded by saying that the number of fires were not above average. This was presumably meant as reassurance, as well as defiance, It was, in fact, a tricky claim - there had been past years when there were even more fires, though the number in 2019 was double the number of the year before - but, even if it had been true, it would not have been that reassuring. The Brazilian rainforest has been on fire for a long time, as I think the following series will make clear.For two years in the mid-1960’s I lived near the little town of Sibu in the Malaysian state of Sarawak on the island of Borneo, a vast region of tropical rainforest. By the later 1980’s I was hearing, again and again, of a logging boom there. Not only were valuable tropical hardwoods being sold so cheap that they ended up in shipping pallets and other similarly wasteful uses, but forest peoples were losing their homes and livelihoods. Similar stories were coming from Brazil and elsewhere. I began to investigate, and the result was this five-hour effort, broadcast in 1989. It gathered stories from Sarawak and Brazil - but also from Canada where acid rain was believed responsible for the declining health of maple forests. - and it reflected on forest ecology and forest conservation through the world.Thirty years later, it remains germane, although many details may be out-of-date. It also contains a number of inspiring accounts of resistance from around the world. One caution concerns the conclusion of the fifth and final program in the series that maple decline in Canada was a direct result of acid rain. New scientific evidence, presented in the year after these broadcast, suggested that damage to roots sustained during an unusually harsh winter in the later 1970’s was also playing a key role in maple decline. This theory received some confirmation, when the maple bush began to recover out of proportion with any declines in acid rain. This demonstration that scientific theories are always, more or less, provisional became a lasting lesson to me and seems relevant at a time when the expression “settled science” has become something of an ideological cudgel.A transcript of the series is available on the transcripts page of this site. As Democratic leaders offer their “Green New Deal” modeled on FDR’s “New Deal,” veteran environmental leader Randy Hayes has drafted the “New Green Deal,” a seven-point plan to address what he calls “a deep planetary emergency.” While Hayes supports all the goals of the Democrats’ proposal, he focuses more intently on the essential requirements to sustain human life on the planet. Hayes wants to shift to 100 percent renewable energy and ecological farming with a plant-food focus. He wants to end subsidies for carbon-based energy to reach a “true cost economy.”  And he calls for a plan to restore healthy ecosystems to half the earth, to offset the impact of humans on the other half. We discuss the recent “eco-spasms” that have flooded large parts of the Midwest and produced more than 500 tornadoes over a 13-day period in May. We talk about the recent launch of a misleading “astroturf” campaign funded by Big Oil. Its front organization, Americans for Carbon Dividends, dangles a carbon tax and dividend scheme as bait for an indemnification of the very industries that have profited from environmentally disastrous resource extraction. When asked about the practicality of his plan, Hayes says that, given the grave threat facing the planet, he intends to at least “go down swinging.” Randy Hayes, the founder of Rainforest Action Network, is an author, filmmaker and environmentalist. Aired 11/18/12 I'll be talking with RANDY HAYES, former head of Rainforest Action Network, currently ED of Foundation Earth, whose primary work these days is rethinking and "ecologizing" the economy. While Balog offers evidence of some symptoms of our way of life, the consequences of our actions, Hayes is attempting to develop radical approaches to economics that will enable us to deal with the underlying causes. RANDY HAYES is a Climate Policy Officer at the World Future Council, a global forum composed of 50 individuals from around the world championing the rights of future generations and working to ensure that humanity acts now for a sustainable future. Hayes is also the founder of Rainforest Action Network, a veteran of many high-visibility corporate accountability campaigns, served as President to the City of San Francisco Commission on the Environment, and as Director of Sustainability in the office of Oakland Mayor Jerry Brown. Hayes has a Master's degree in Environmental Planning from San Francisco State University and his master's thesis, The Four Corners, won the Academy of Motion Picture Arts and Sciences award for "Best Student Documentary" in 1983. http://www.fdnearth.org
