The Vancouver Police Department (VPD) formalized a new policy around “street checks,” better known as “carding.” Street checks refer to voluntary interactions with police that go beyond a casual conversation, and may include a request for identifying information. The new policy overtly bans stopping someone based on identity factors such as race, sex, age or homelessness, and requires police to tell people being checked that their interaction is voluntary and that the subject can leave at any time. Apparently that's a no no given what has been happening with folks being ticketed for having their phones within reach. Quebec's impaired driving laws are about to adapt stricter consequences. The Société de l'assurance automobile du Québec (SAAQ) announced that starting TODAY, motorists in QUEBEC convicted of drunk driving twice within 10 YEARS will have to blow into a breathalyzer every time they attempt to start a car — for the rest of their lives. Quebec's Ministry of Transport says from 2013 to 2017, alcohol-related crashes killed an average of 100 people annually. That's on top of the approximately 220 serious injuries and 1,800 minor injuries. According to ICBC, BC had the toughest impaired driving laws… but obviously that just changed. I spoke with Paul Doroshenko of Acumen Law about our current impaired driving laws are here in our province… According to ICBC, on average, 68 people die every year in crashes involving impaired driving. You know those waivers they make you sign before you do an extreme sport, or an extreme activity, like ziplining or mountain biking? They're pretty long, right? But if you look closely, in a lot of cases it absolves the company of any liability - regardless of whether or not the company was negligent. These kinds of waivers are back in the news, after a ruling this past week in favour of Grouse Mountain. A snowboarder who was paralyzed in a crash had taken an injury suit against the company, and the case partly-hinged on whether the resort took enough steps to make the claimant aware of the waiver he had agreed to. The claimant actually had worked at the resort and part of his job involved helping customers to sign similar waivers. In her ruling, Justice Catherine Murray wrote that the claimant “should have known of the waiver of liability for the mountain's own negligence,” and “that he chose not to read the waivers does not render them invalid or inapplicable to him”. This is not the first time a claimant has lost their case in the courts because of waivers. But is it right that a company can get its customers to waive all rights to sue? Another surprising decision from the B.C. Courts on distracted driving. The driver's cell phone battery dead. The cell phone was in a cubby hole in the dashboard away from the driver. BUT: the earbuds connected to the phone were in his ears. And so, the driver was guilty of distracted driving, according to Judge Brent Adair. And by the way, the BC RCMP say driving with ONE earbud in is fine -- but if you have two earbuds, you get a $368 ticket and four points. Guest: Kyla Lee Lawyer with Acumen Law

Many women are now going sleeveless in their more respectful workplaces in solidarity with the women at the BC Legislature. One of those women is Kyla Lee who feels very strongly about this. It may sound unbelievable, but Canada's revised laws on impaired driving could see police demand breath samples from people in bars, restaurants, or even at home. And if you say no, you could be arrested, face a criminal record, ordered to pay a fine, and subjected to a driving suspension. You could be in violation of the impaired driving laws even two hours after you've been driving. Now, the onus is on drivers to prove they weren't impaired when they were on the road. The new drunk driving laws went into effect on Monday. While appearing on the CKNW Simi Sara Show earlier this month, ister of Border Security and Organized Crime Reduction Bill Blair explained what the new changes consisted of… Paul Doroshenko is with Acumen Law, and he and his colleagues have been very vocal on how they believe the new rules to be unconstitutional. ICBC is recruiting seven-thousand new drivers to let technology track driving behaviour next year. Mark Milner, with the company, says an app will gather info from an in-car device. It'll collect data over the course of a year. He says there will be some kind of perk for participants but not a rate-cut. The end goal, Milner says reducing crashes and with that costs - of driver's rates and ICBC payouts. The price tag of the pilot project is three-point-four million dollars - a fraction, he says, of the 13-million now being paid DAILY in claims.
