This Day in Legal History:  Wong Kim Ark becomes Wong Kim ArkOn March 28, 1898, the U.S. Supreme Court issued a landmark decision in United States v. Wong Kim Ark, affirming that a child born in the United States to Chinese immigrant parents was a U.S. citizen by virtue of the Fourteenth Amendment. Wong Kim Ark was born in San Francisco in 1873 to Chinese nationals who were legally residing in the U.S. but ineligible for naturalization due to prevailing immigration laws. After a visit to China in 1895, he was denied re-entry on the grounds of the Chinese Exclusion Act, which severely restricted immigration from China and barred Chinese nationals from becoming citizens.The Court rejected the government's argument that children of Chinese immigrants were not subject to U.S. jurisdiction and thus not entitled to birthright citizenship. In a 6–2 decision, the Court held that the Fourteenth Amendment guaranteed citizenship to nearly all individuals born on U.S. soil, regardless of the nationality or immigration status of their parents. This decision established a major precedent for interpreting the Citizenship Clause of the Fourteenth Amendment and reinforced the principle of jus soli, or right of the soil.The ruling came during a period of intense anti-Chinese sentiment, when the Chinese Exclusion Act of 1882 and its extensions aimed to restrict Chinese immigration and civil rights. Wong Kim Ark was a significant rebuke to efforts that sought to limit the constitutional rights of U.S.-born children of immigrants, and it laid the foundation for future interpretations of birthright citizenship.The Senate's vote to repeal the Consumer Financial Protection Bureau's $5 cap on overdraft fees is a clear signal: protecting bank profits matters more to Senate Republicans than shielding consumers from predatory financial practices. With a 52-48 vote, Republicans—joined by only one Democrat—moved to dismantle a regulation designed to curb exploitative overdraft charges that routinely hit working-class Americans the hardest.This isn't a technical policy disagreement—it's a choice to side with an industry that routinely charges Americans up to $35 for covering small shortfalls, even when the overdrafted amount is often less than the fee itself. The CFPB's rule was narrow, targeting only large banks and credit unions with more than $10 billion in assets, and still allowed higher fees if justified by actual costs. It was a modest, evidence-based consumer protection measure.The financial industry's immediate lawsuit and the GOP's use of the Congressional Review Act to kill the rule reveal the coordinated effort to preserve a lucrative revenue stream. The overdraft fee fight is just one piece of a broader Republican strategy to roll back protections the CFPB has implemented—protections meant to hold powerful financial institutions accountable.No one should mistake this vote as anything other than what it is: an effort by Senate Republicans to keep consumers on the hook, ensuring that banks and credit unions can continue bleeding them dry in the name of "choice" and "flexibility"—buzzwords that conveniently mask an enduring deference to corporate power. They'll couch these kinds of moves in language of fairness–pretending they ensure lower-income consumers are given access to these financial instruments. A moment's reflection, however, makes it clear that even under their best dressed reasoning they're looking to enable banks to charge exorbitant fees to account holders in precarity. Senate Votes to Repeal CFPB's $5 Cap on Bank Overdraft Fees (1)Yesterday, President Donald Trump issued an executive order against the prominent law firm WilmerHale, following its connections to Robert Mueller, the former special counsel who led the investigation into Russian interference in the 2016 election. The order directs federal agencies to cancel contracts with WilmerHale's clients, revoke lawyers' security clearances, and restrict access to U.S. government buildings. This is part of a broader strategy targeting law firms with ties to Mueller's investigation, including Perkins Coie, Paul Weiss, and Jenner & Block.Trump criticized Mueller's investigation as an example of government overreach, labeling it as politically motivated. In addition to its ties to Mueller, Trump also accused WilmerHale of discriminatory practices in its diversity programs, echoing similar claims against other law firms earlier this month. She talks about how she was inspired by a metal artist she met during a trip to Puerto Rico to start her own jewelry-making business. She also explains how that piqued her interest in learning how to weld. Desirée discusses how after enrolling in CWIT's welding program, it led to her working at number of Chicago-area fab shops. The after a few years of working in industry, her career came full circle when she accepted an open welding instructor position at CWIT. She also talks about the mission behind CWIT and its work to not only get more women to work in the trades, but empowering them with confidence and a community. At the top, we call back to a conversation in an episode with Michael Bennett about a toy plastic welder. We compare and contrast Mattel's Spin Welder and Mindware's Spin-Gineer. Senior leaders representing 23 of the country’s largest technology companies located in Ireland met for the annual Connecting Women in Technology (CWiT) CEO Forum recently. Top of the agenda at the virtual gathering was the continued efforts and commitment of CWiT in attracting, retaining and promoting women in the technology sector and to address the gender gap that exists within this community. This year’s meeting was hosted by Microsoft, one of the founding members of the network. Addressing the audience, Cathriona Hallahan, Managing Director of Microsoft Ireland said: “Almost all workplaces have changed this year with the majority of people required to work remotely. This means that an even greater effort and focus is required to ensure that the gains made in the area of D&I are not lost. Mentoring, support and training must remain a priority regardless of whether people are physically in their office or not. We all need to work together to keep this issue high on the agenda of business leaders so that organisations can continue to benefit from the positive impact that greater diversity delivers.” 2020 has posed significant challenges for all of society and organisations operating across all industries. CWiT member companies were no different, and have in recent months focused on adapting to the ‘new normal’, ensuring the safety of employees and the continued support for customers across the world. At the same time, they have remained focused on delivering internal and external programmes aimed at increasing diversity and inclusion in the technology industry. One such programme that aims to close the gap between STEM education is Dublin City University’s STEM Teacher Internship (STInt) supported by CWiT, Castel, 30% Club, and SFI. To date, the programme has provided 70 DCU STEM teachers with a 12-week experience across 24 of Ireland’s leading companies, including 11 CWiT member companies. Despite being affected by COVID-19 restrictions, 16 internships went ahead allowing students to get first-hand experience of working in the technology and pharma sectors. One of this year’s interns was Seán Smyth who completed his internship at Xilinx. Speaking about the programme, he said “The programme aims to highlight the careers available in STEM to pre-service teachers, like myself, while also giving student teachers’ hands-on experience of working in the corporate STEM environment. This empowers future teachers and their students to take part in STEM activities, to study STEM subjects, and to get involved in the STEM industry. The future of the tech industry is certainly looking bright (and increasingly diverse!).” The COVID-19 pandemic seems to have worked in favour of technology innovations at work, at home and in personal life, but according to TrustRadius women are disproportionately impacted by the pandemic in the professional setting, which may lead to negative impact on female representation, career progression and gender pay. CWiT has partnered with TalentHub, a leading eCommerce and Technology recruitment partner in Ireland, to address some of the challenges through a series of masterclasses and events. CWiT spokesperson and strategy lead Ifah Sivak said: “The past 8 month have been very tough for everyone, but we have continued working together and supporting both our members and our programs in attracting and retaining women in tech. We had to adapt our approach and strategy to fit with everything moving to a virtual environment, while not deprioritising our D&I activities. CWiT has also partnered with TalentHub recruitment agency to help with bridging the female gap through masterclasses and speaking events. Intro Heat Stroke is broadly defined as a core temperature above 104 F with central nervous system abnormalities following strenuous exercise or environmental heat. - Wilderness Medical Society. Heat cramps, exhaustion, illness, stroke etc. are a spectrum of a single illness (systemic non drug related hyperthermia) rather than each being an individual entity. THE CARDINAL SIGN OF HEAT STROKE IS ALTERED MENTAL STATUS Anhydrosis is not a reliable finding, and should not be used as a clinical guidepost. Pathophysiology An increase in blood temp triggers hypothalamic thermoregulation it increase blood flow to the skin – cutaneous vasodilation – blood shunts the the periphery to facilitate heat loss through sweating. Renal and splanchnic perfusion is reduced. Heat stroke produces an inflammatory response similar to that seen in sepsis. Increased mucosal permeability from inflammatory mediators allows endotoxins from the gut to enter systemic circulation – leading to alterations in microcirculation, more endothelial and tissue injury, and impaired thermoregulation. Prevention and Acclimatization Acclimatization may be likened to receiving a "heat vaccine" with small steady doses of exertion in hot environments provoking an adaptive response within the body. 1-2 hours of progressive, controlled, heat-exposed exertion per day for 10-14 days. This adaptation may persist up to a month. One bout of a heat stroke may reset thermoregulatory adaptations and increase risk for subsequent heat injury for months. Hyperhydration has no effect on heat tolerance. Forced hydration is ineffective and dangerous (hyponatremia risk). Environmental Considerations Wet Bulb Globe Temperature "Composite" temperature factoring humidity, sun angle, apparent temperature, wind speed, and solar radiation. Generally considered more accurate than the Heat Index, which is a function of temperature and humidity in shaded areas. As the environmental temperature increases the body will incur a net heat gain through convective and radiative processes, leaving evaporative thermoregulation as the only cooling mechanism. Some activities enhance heat transfer: Cyclist, swimmers, etc. Increased metabolic demand and increased ambient conditions should lead to breaks in proportion to both.   Field Treatment Principles Rapid, often empiric, cold water immersion is the gold standard treatment. Rapid reversal of the condition is key: morbidity and mortality is directly associated with the duration of hyperthermia experienced by the patient. If a patient is hyperthermic and has AMS, empiric cooling should not be delayed to obtain a temperature – or if temperature is less than 104 F, it should not deter you from aggressive cooling measures. Naturally, manage ABCs as needed. Treatment on scene is preferred over rapid transport. Cold Water Immersion Therapy CWIT is the gold standard of treatment, and usually involves placing a patient's entire body (with airway protection measures in place) in a tub or trough of cold water. CWIT is two times more effective in heat transfer than spraying cool water over the body. Hindrance of cooling in the setting of EHS due to shivering has been physiologically refuted. Other Cooling Methods If CWIT is not available, repeated dousing of cold water over the patient is "next best". Ice Sheets placed over the patient's body and exchanged every 2-3 minutes is an approach often adapted by the military where carrying large troughs of ice water is not optimal. Axillary or inguinal placement of chemical cold packs or ice is not effective. Be creative! The goal is to get large volumes of water over the patient or place the patient in a body of water to maximize the effect of convective cooling.   Temperature Monitoring Rectal and/or esophageal temperature monitoring is the gold standard. Oral, axillary, or skin temperature readings are highly likely to be inaccurate. Temperature monitoring is not required to initiate therapy, but may be helpful to guide therapy or consider other differential diagnoses.
