Thompson, 2025 ONCA 500 where a man was arrested in relation to a serious drug investigation and later strip searched after being booked into cells. Police delayed advising the man of his s. 10(b) Charter right to counsel for 20 minutes following his arrest, and did not re-advise him of his right to a lawyer before conducting the strip search many hours later and after he had already spoken to duty counsel. Was the 20 minute delay justified and were the police required to provide a second s. 10(b) advisement before conducting the strip search incident to arrest? Miller, 2025 MBCA 48 where police — acting on an informer's tip — arrested a man after stopping a taxi he was riding in. When the man was searched, police found cash, meth and two cellphones. Did the police sufficiently CORROBORATE the information? Was it enough for the what, when and where of the tip to be confirmed but not the criminal aspect related to it? Or should the police have done more investigation before making the arrest? Thanks for listening! Feedback welcome at legalissuesinpolicing@gmail.com

Dodd, 2025 BCSC 591 where police executed a search warrant at an apartment located in a 50 unit building. The warrant did not expressly authorize the police to move through the common areas inside the building to get to the door of the apartment, nor was permission sought from building management or another resident to enter. Did the police conduct amount to an unlawful search — thereby breaching the accused's s. 8 Charter right — when they walked through the lobby, stairwell and hallway to arrive at the target suite's door to execute the warrant? Allowing an accuser to proceed anonymously in civil lawsuits or criminal proceedings offers several advantages. It protects the individual's privacy, especially in cases involving sensitive matters like sexual assault, thereby reducing potential public scrutiny and emotional distress. Anonymity can also shield the accuser from possible retaliation or harassment, encouraging victims to come forward without fear of personal repercussions. This protection is particularly vital when the accused holds significant power or influence, as it helps balance the scales of justice. However, anonymity in legal proceedings presents notable challenges. It may hinder the defendant's ability to fully investigate the accuser's background and credibility, potentially impacting the fairness of the trial. The public's right to open judicial proceedings is also compromised, as transparency is a cornerstone of the legal system. Moreover, anonymity could inadvertently suggest that the allegations are more severe, potentially biasing jurors or the public against the defendant. Courts must carefully weigh these factors, often requiring compelling reasons to grant anonymity to ensure that justice is served equitably for all parties involved. The debate over anonymity for Sean "Diddy" Combs' accusers centers on balancing the accusers' privacy and safety with the defendant's right to a fair trial and the public's interest in transparent legal proceedings. Some accusers have sought to proceed under pseudonyms to protect themselves from potential harassment and public scrutiny. However, courts have ruled that allegations alone do not justify anonymity, emphasizing the importance of openness in judicial processes and the defendant's ability to investigate the accusers' credibility. This tension highlights the complexities of handling sensitive allegations against high-profile individuals.Let's dive in!(commercial at 9:13)to contact me:bobbycapucci@protonmail.comsource:Most of Sean ‘Diddy' Combs's Accusers Are Unnamed. Provide your feedback here. Anonymously send me a text message. In this episode, Mike discusses the Ontario Court of Appeal decision Shanthakumar Estate v. Canada Border Services Agency, 2025 ONCA 422 where a police officer continued an arrest made by CBSA of two seniors for breaching an undertaking condition based on a CPIC entry. Unfortunately, the charge related to the undertaking had been stayed but the CPIC entry had not been updated. It was only later learned, after the seniors had been transported to jail, that the undertaking had been vacated and the conditions were no longer in effect. The seniors — now plaintiffs in a civil action — sued the RCMP, CBSA & the police for negligence and arbitrary detention (under s. 9 of the Charter). Did the seniors have a case? Were their arrests unlawful? Did the police breach the standard of care expected of a reasonable officer in similar circumstances? Learning answers to these questions may help you with your decision making in like situations. Lower court ruling (2023 ONSC 3180).Thanks for listening! In Case No. 24-CV-07778-JLR, presided over by Hon. Jennifer L. Rochon, the defendant has filed a memorandum opposing the plaintiff's motion to proceed anonymously. The defendant argues that the plaintiff has not demonstrated sufficient justification to override the presumption of open judicial proceedings, emphasizing the importance of transparency and the public's right to access court records. The memorandum contends that allowing the plaintiff to remain anonymous could prejudice the defendant's ability to mount an effective defense and may set a concerning precedent for future cases. The defendant further asserts that the plaintiff's concerns about potential harm or harassment are speculative and do not meet the legal standards required to proceed under a pseudonym. They argue that the court should require the plaintiff to disclose their identity to uphold the principles of fairness and openness in the judicial process. The memorandum requests that the court deny the plaintiff's motion and mandate that all parties be identified by their real names in the proceedings.to contact me:bobbycapucci@protonmail.comsource:gov.uscourts.nysd.629911.50.0.pdf
