The Hazing From Hell, LA Frat Kills Another Student By “Accident” Authorities in Baton Rouge have announced two more arrests in the death of Caleb Wilson, a 20-year-old Southern University student who died after being repeatedly punched during an alleged off-campus fraternity hazing ritual. Police said Tuesday that 25-year-old Kyle Thurman and 28-year-old Isaiah Smith have been charged with felony criminal hazing in connection with the fatal incident. Wilson, a junior studying mechanical engineering, died in late February. Last week, investigators arrested 23-year-old Caleb McCray on charges of criminal hazing and manslaughter. Police allege that McCray punched Wilson four times before the pledge collapsed, became unresponsive, and appeared to experience a seizure. Surveillance footage reviewed by law enforcement shows Smith removing Wilson from his vehicle and taking him to a hospital. According to a police arrest warrant affidavit, the group initially told medical staff that Wilson had collapsed while playing basketball at a park, then left before officers arrived. Baton Rouge Police Department Chief Thomas Morse Jr. said Wilson died as a “direct result” of the hazing. Smith, who held the title “Dean of Pledges,” was allegedly in charge of overseeing the ritual. Authorities say he turned himself in on Tuesday. Smith's attorney, Franz Borghardt, emphasized that his client is not accused of making physical contact with Wilson and that no one was aware of any underlying medical conditions the student might have had. “This was a freak accident; we're not talking about force-feeding alcohol,” Borghardt said. “To be sure, everyone in that fraternity cares about Caleb. Our hearts go out to the Wilson family.” While both Smith and Thurman allegedly participated in punching some of the nine pledges, they are not described in police affidavits as having hit Wilson. The hazing took place at a warehouse owned by Smith's father, Todd Smith, who has not responded to requests for comment. Thurman could not be reached, and no information about legal counsel for him was immediately available. Phillip Robinson, McCray's attorney, said his client is innocent and urged the public to refrain from judgment. In Louisiana, hazing can be prosecuted as a felony under the 2018 Max Gruver Act, which carries penalties of up to a $10,000 fine and five years in prison when serious injury or death results. Organizations and educational institutions may also face penalties under the act. Omega Psi Phi, the fraternity Wilson was pledging, could face civil penalties. A spokesperson said the organization is cooperating with authorities. The campus chapter of the fraternity has been suspended, and Greek life organizations at Southern University have been barred from taking on new members for the remainder of the academic year, according to President Dennis Shields. Wilson, a passionate trumpet player in Southern University's renowned band, was honored with a well-attended vigil in early March. Want to listen to ALL of our podcasts AD-FREE? The courtroom is intended to be the place where fairness is the fundamental ideology and judges are supposed to be the arbiters of justice and equity. What happens when a Judge turns out to be a blatant racist? How are we to view judicial decisions that have come down while that judge is on the bench? ...and How do you pick jurors when you are faced with a situation where you know people will have biases against certain crimes? The President recently signed a law into effect making animal cruelty a federal crime punishable by a fine and up to 7 years in prison. Do we need a federal law when there are already state laws in place to cover such acts? Should we be affording so many legal resources to protect non-humans? Does Richard's cat have a soul? These questions and more on this week's episode of Legally Unfiltered. BUT WAIT, THERE'S MORE! What would you say about and adult tricking you into changing their dirty diaper? Nope, no more description on that one... you'll just have to listen to get the rest of the details. We don't want to spoil the fun :) So kick back, relax and enjoy the sweet sounds of attorneys Franz N. Borghardt and Richard Sprinkle on this all new double-feature episode of Legally Unfiltered, brought to you by the Sprinkle Law Firm and the Borghardt Law Firm.
When people get arrested, they usually are allowed to post a bond (also known as bail) to get out of jail pending trial. The price of the bond is often linked to the crime the individual defendant is accused of. The more serious the crime, the higher the bond typically is. Recently a man was arrested on 500 counts of child pornography and his bond was set at $50 million dollars. Is this too high? On this episode Franz N. Borghardt and Richard Sprinkle sit down to discuss bonds. How much is too much? There is an 8th Amendment protection against excessive bail, but what exactly is excessive? Is it $50 million dollars? Listen to this episode to see what our attorney hosts have to say about the subject.
When you gotta have it, you gotta have it. Imagine being struck by cupid's arrow as you are being arrested. What do you do? Do you scratch that itch even though you are about to be taken to jail? Spoiler alert: A couple in Florida recently did just that. Also in this episode... can an employer be held liable for a worker who dies while having sex? A French court recently said yes! You read that right... Find out all about these bizarre stories in this all new episode of Legally Unfiltered as your hosts Franz N. Borghardt and Richard Sprinkle tackle the toughest issues of the day. Strike that; we can't even type it with a straight face. Just listen in to some of the strangest sex stories ever to have a legal twist to them, right here on Legally Unfiltered!

Can the media actually affect legal decisions? What happens when the media acts in a way to affect court decisions? Legally Unfiltered hosts Franz N. Borghardt and Richard Sprinkle were recently interviewed by Bill Profita and Kevin G. Gallagher of The Morning Exiles about media in the law, and the discussion was quite eye-opening. Can your boss fire you over a Facebook post? Can your boss fire you for "Liking" a Facebook post? Two former Gretna, Louisiana police officers would tell you it happened to them. Borghardt and Richard Sprinkle take on an interesting question this time around... Is freedom of speech dead? Check it out and let us know what you think.
A RevFisk Raw Interview. Pastor George Borghardt is pastor of Immanuel Lutheran Church in Bossier City, LA, but you probably know him from his work with Higher Things, an organization dedicated to daring youth to believe in grace alone through faith alone for the sake of Christ alone. At a recent conference, I had a chance to sit down with him for what was supposed to be a one hour set. Instead, we talked for two hours, covering a gambit of topics from the most controversial hotbeds of distraction to the way the near loss of his daughter seventeen years ago changed his life and set him free. I hope you enjoy it as much as I did! When the public needs defending, who pays for it? The public? The answer might just surprise you... If you think being a public defender is tough, try managing the budget for a public defender's office. Shrinking funding combined with increasing workloads demands that new solutions be found. Borghardt and Richard Sprinkle about the challenges of ensuring that everyone gets access to justice. Check it out, and let us know your thoughts. We want to hear from you.
LET'S GET READY TO RUMBLE! The rules have changed! Now, the first rule of fight club is... go find a cop. That's right, kids! When words just won't do and you want to settle things the old fashioned way by stepping outside and "handling it," one state will let you duke it out in the street as long as you get a police officer to referee the fight! Check out what our hosts have to say about "mutual combat laws." BUT WAIT, THERE'S MORE! Because we know you can't get enough of the wacky side of the law, Franz and Richard also bring you the story of the parents who tragically lost their son in a skiing accident, and want to carry on his legacy by using his sperm for insemination. That's right... the dead Cadet's sperm... Yeah, you heard that right. Lots of questions to answer on this one, so check out this week's episode of Legally Unfiltered and see what your hosts Franz N. The courtroom is intended to be a fair battlefield. Both sides are supposed to have an equal chance at proving their claims. Both sides get to present their case, call and question witnesses, and make their arguments. But what if one side is cheating? What if one side is spying on the other? We don't have to ask what if, all we have to do is look at what happened in one courtroom where the Sheriff was caught red-handed using security cameras as intelligence gathering devices during trials. We can't make these stories up, guys. Want to know more? Just listen to this week's episode of Legally Unfiltered and check out what Franz N. Borghardt and Richard Sprinkle have to say about this new breakdown of the justice system.
Lawsuits; can't live with 'em, can't live without 'em. Tort Reform is back on the table in many areas around the country, as the insurance and business lobbyists try to curb large judgments in tort suits. Many claim that most lawsuits are just frivolous and waste the court's time. But what really is a "frivolous" law suit? How can we tell if a claimant is going too far? Do we as a country need tort reform? Attorneys Franz N. Borghardt and Richard Sprinkle take this hot-button issue head on in this week's episode of Legally Unfiltered.

Defendants often face the possibility of stiffer penalties at trial than they would if they were to plead guilty. The Sixth Amendment grants everyone the right to a trial but if exercising that right becomes so risky that defendants don't want to try their cases, are they being denied this right all together? Or are they just being coerced into an agreement with "good" plea offers? In this episode of Legally Unfiltered, Attorneys Franz N. Borghardt and Richard Sprinkle explore the reality of criminal prosecutions and discuss the fact that defendants take plea agreements for numerous reasons, even when they are truly not guilty. But are they taking those plea deals for the right reasons? Or are they just being led to plead based on the possibility that they could face a much worse sentence if they exercised their right to trial and lost? What makes someone take a guilty plea when they know they are innocent? Find out in this episode of Legally Unfiltered.
