Photojournalist Nick Stern still has nightmares from the night an officer fired a flashbang into his leg as he covered the LA immigration protests. He's one of dozens of journalists assaulted, arrested, or deported in Trump's second term — a year that pushed the US to 64th on the World Press Freedom Index, its lowest ranking ever.In this episode of The Battle for Free Speech, Michael Fox is joined by Real News investigative journalist and Capitol Hill correspondent Taya Graham to map the assault on the American press: the rubber bullets and broken bones, the billion-dollar lawsuits, the FBI raids on reporters' homes, the jailing of journalists like Georgia Fort and Don Lemon, and the deportation of immigrant reporters Mario Guevara and Estephanie Rodriguez. Featuring voices from the Committee to Protect Journalists and the National Press Photographers Association, they trace how violence, intimidation, media consolidation, and the gutting of access all serve a single goal: self-censorship — the silencing of the press in the name of free speech. The Battle for Free Speech is a production of The Real News Network.Hosted by Michael Fox and Marc Steiner. On the day of Donald Trump's inauguration—January 20, 2025—the heads of many of Silicon Valley's most powerful tech firms sat in the rows just behind Trump. It was a sign of Trump's deep ties to the industry and to these powerful individuals who are transforming how we communicate, and not for the better. In this episode, Michael Fox visits Silicon Valley to try to understand the stranglehold that tech has over our media and our airwaves. Hosts Michael Fox and Marc Steiner dig into the ways media consolidation, social media, and AI are strangling our free speech, even as they claim to be liberating it—and us—with incredible insight from professors Todd Wolfson, Mary Anne Franks, Fara Dabhoiwala, Ramesh Srinivasan, and Jeff Cohen, the founder of the organization Fairness and Accuracy in Reporting, FAIR.The Battle for Free Speech is a production of The Real News Network.Hosted by Michael Fox and Marc Steiner. Free speech in America was never given — it was fought for, bled for, and died for. In this episode, hosts Marc Steiner and Michael Fox dive into the history of the movements that built and defended the right to speak out: the abolitionists who continued to speak — even as mobs attacked the building where they gathered — Ida B. Wells, who exposed the truth about lynching in Jim Crow Memphis, and the students at UC Berkeley who launched the Free Speech Movement of 1964.Michael takes us to Sproul Plaza, ground zero of the Berkeley free speech movement, and Marc shares his own story of carrying that fight from the civil rights movement to campuses on the East Coast. Together they trace a brutal pattern that runs from Elijah Lovejoy — the abolitionist editor murdered by a mob in 1837 — to the burning of Pennsylvania Hall, to today's crackdowns on student protest and the firing of professors for their political views.Featuring law professor Mary Anne Franks, author of Fearless Speech, on the crucial difference between fearless speech and reckless speech — and why America has so often protected the wrong one. Plus UC Berkeley historian David Hollinger on why universities are "the hill to die on," and Princeton historian Fara Dabhoiwala on why free speech has always been a battle over power. This is the second episode of The Battle for Free Speech. In this podcast series, in the lead-up to the country's 250th anniversary, journalists Michael Fox and Marc Steiner look at the battle for our free speech rights today, and the attacks on people speaking out in the United States. The Battle for Free Speech is a production of The Real News Network.Hosted by Michael Fox and Marc Steiner. In The Last Word, Greg Belfrage gives his final thoughts on the day's news including a recent lawsuit against US Secretary of Agriculture, Brook Rawlins. The suit claims that Rawlins broke the 1st amendment by pushing and proselytizing her religion onto employees in the department. Greg points out that this overreaction is similar to the Merry Christmas vs. Happy Holidays argument. See omnystudio.com/listener for privacy information.
A guy with a sign on a street corner shouldn't be able to expose a training crisis, but that's exactly what happens when police misunderstand the First Amendment in public. We bring on Otto The Watchdog, a longtime First Amendment auditor and activist, to talk through the real rules behind profanity, filming, and protected speech and why “I don't like it” is not the same thing as “it's illegal.” Along the way, we break down the case law that keeps showing up in viral videos and why basic constitutional rights training still gets treated like an afterthought. From there, the conversation gets personal and messy in the best way. Otto shares how pretextual traffic stops over minor equipment violations pushed him into activism, and how a dispute over “needing a permit” to give away food spiraled into national attention and local backlash. We dig into police discretion, ego, and the reality that bad outcomes often come from small decisions made under stress, especially on domestics and low-level stops where officers feel pressure to “do something.” We also tackle bigger systems: hiring red flags in small agencies, accountability gaps when officers move department to department, and why body cameras only work when someone actually reviews them. Then we step into the future with license plate readers, weighing stolen-car recoveries and missing-person wins against the risk of mass surveillance and innocent people getting swept up. Finally, we kill a popular myth: auditors aren't getting rich off lawsuits, and real change usually comes from documentation, persistence, and public scrutiny. Truth Social (3/14/26) This week on CounterSpin: Those not in vigorous denial understand that we in the US are in the midst of not just “foreign” wars—today on, most prominently, Iran—but also a war against our ability to talk about it all, to dissent from it, to hear from people who have different ideas about ways forward. It doesn't seem too much to say: If we cut off our ability to have a widespread public debate, whatever “solutions” we're told “we” came up with have nothing to do with democracy. We'll hear from FAIR editor Jim Naureckas about what news media could call, if only they would, “the Trump administration vs. the First Amendment.” https://media.blubrry.com/counterspin/content.blubrry.com/counterspin/CounterSpin260320Naureckas.mp3 Just Security (3/17/26) Also on the show: US news media told us that the images of Iraqis tortured at the infamous “hard site” in Abu Ghraib have been “seared into the American consciousness.” That would imply that those US news media were genuinely interested in the horrors meted out at the Iraqi prison where the CIA and the Army committed what Wikipedia comfortably calls a “a series of human rights violations and war crimes against detainees.” Those media would surely want all of us “consciousness-seared” people to know what was being done to answer for it all, to bring people to account, to make sure it never, ever happened again. (That shouldn't sound like a joke.) The Center for Constitutional Rights has been in back of the last remaining lawsuit on behalf of victims of Abu Ghraib; and, though you might not have heard about it, they won. EPISODE 127 - “HOLLYWOOD FIGHTS BACK: THE COMMITTEE FOR THE FIRST AMENDMENT” - 2/16/2026 On October 1st, a group of entertainment professionals—led by iconic actress and activist JANE FONDA—relaunched the Committee for the First Amendment. They did so in response to what they see as troubling actions by the current government, including renewed efforts to silence critics across government, media, the courts, universities, and the entertainment industry. The group is standing up for free speech and creative expression, believing that the right to criticize, question, protest—and even poke fun at those in power—is central to what America has always aimed to be.This isn't the first time Hollywood has come together to push back against the federal government for violating the Constitution. Back in 1947, the fear of communism sent the government into a frenzy. In an effort to root out so-called “commies,” officials went after elected leaders, government workers, professors, and artists. Many were blacklisted, harassed, silenced, and even jailed because of their political beliefs. To counter this, a group of actors, writers, producers, and directors formed the Committee for the First Amendment, an advocacy group to fight these Hollywood blacklisting, during what would turn out to be a very dark and shameful chapter in American history. This week, we dive into the Committee for the First Amendment, how it started, what it stood for, and why it's still relevant today. In this episode, we start by looking at the political landscape in Ohio as we approach the 2026 gubernatorial election. With Mike DeWine term-limited, the race is heating up between Democrat Amy Acton and the wealthy tech entrepreneur, Vivek Ramaswamy. Ramaswamy, who boasts credentials as a Yale graduate and a venture capitalist in the biotech sector, finds himself showing his lack of understanding of pressing local issues, particularly the closure of coal plants in Ohio which has greatly impacted the energy landscape. His assertions that he would simply ramp up coal production without acknowledging the broader regulatory and economic context reveal a fundamental misunderstanding of energy economics. Ramaswamy's campaign is characterized by flashy rallies where he promotes himself as an anti-woke candidate, yet his connections to conservative elites like J.D. Vance and Elon Musk raise questions about his grassroots appeal.Next we look at the recent government intimidation of journalists trying to cover the growing fascist regimes' illegitimate actions in Minnesota and elsewhere. We point out that journalists were arrested for covering a protest at a church while just two months prior a Republican religious extremist interrupted a church service in Texas and was never arrested or charged. We also talk about the FACE Act, that is used to protect access to abortion clinics and how churches were added to the law to appease Christian Nationalists in Congress. Finally we discuss the troubling trend of ICE-related violence. The recent murder of Alex Pretti while he tried to intervene during a confrontation with ICE agents adds a chilling layer to the narrative. We need to consider the wider implications of policing practices and to critically engage with the language and narratives used by advocates of increased law enforcement. The escalating violence tied to ICE's actions raises a critical question: how much violence must occur before we start questioning the legitimacy of these federal agents' operations?Full show notes & links usedSend us a textSupport the showSubscribe to our free newsletterCheck out our MerchFollow us on BlueskyFind us on Twitter(for now) Find us on InstagramFind us on Counter SocialFind us on Mastadon

We examine how this campaign represents a coordinated attack on foundational Western values — and what that means for the future of open societies. A school police officer told an auditor that filming an officer is illegal. It wasn't—and what followed became a masterclass in rights, ego, and how quickly a routine moment can unravel when the law takes a back seat. We invited David from San Joaquin Valley Transparency to walk us through the viral arrest and the lessons he's learned after years of auditing—then put those claims under the microscope with three cops who train recruits and call out bad policing.Together we map the real line between lawful public recording and unlawful interference and explain why prior restraint and, in California, the Bain Act matter on the street—not just in court. We talk through field-tested approaches any patrol officer can use today: speak to the caller first, observe before you engage, and treat auditors as a chance to educate the public. We also get into the cultural stuff you won't see in a policy binder: how ego fills the gap when an officer isn't sure, why a simple “let me verify” can defuse a confrontation, and how confidence from jiu‑jitsu or boxing training lowers hesitation and reduces force.David shares concrete wins achieved through public records, complaint routing, and sustained local pressure, including leadership changes that followed documented misconduct. We push for more transparency, including body‑worn cameras that stay on with no muting during calls, and accountability that extends past police to prosecutors, judges, and corrections. The conversation lands on a nuanced truth: yes, we need professionals to handle real violence, and yes, citizens must know their rights. When both are true in practice, cameras become bridges, not battlegrounds. If you care about First Amendment audits, police reform that actually works, and the kind of training that protects everyone, this one's worth your time. Listen, share with a friend, and tell us where you think accountability should start. Dan walks through the framework around free speech in media, while Bryce draws parallels to landmark constitutional cases, emphasizing how these precedents protect expression even when controversial.Next, Mike breaks down the Sauce Gardner defamation case, where the Jets cornerback was sued by a New Jersey woman over a Twitter exchange involving OnlyFans allegations. The court ultimately dismissed the case under New Jersey's new anti-SLAP protections, awarding Gardner over $50,000 in attorney's fees. The trio debates whether the case was truly frivolous and discusses the broader implications for athlete-fan interactions on social media. Finally, Bryce provides an update on Diego Pavia's ongoing eligibility battle with the NCAA. The Vanderbilt quarterback's antitrust challenge to the five-year eligibility rule recently reached the Sixth Circuit, with arguments focusing on whether junior college years should count toward eligibility limits. Dan and Bryce express concerns about the blurring lines between college and professional sports, questioning where reasonable limits should be drawn. The episode wraps with "What to Watch For" covering professional players entering college athletics and international student-athletes' NIL rights. On this episode of Conduct Detrimental: THE Sports Law Podcast, Dan Lust (@SportsLawLust) , Mike Kravchenko (Watch on YouTube) and Bryce Goodwyn (@BryceGoodwyn) return after a brief hiatus to tackle three major legal stories that unfolded while they were away. The trio kicks off with an analysis of the Jimmy Kimmel temporary suspension from ABC, the First Amendment implications, and his eventual return to the air. The FCC had taken no action and ABC is a private company. These things combine to give a good idea of what market forces were at play in ABC's decision to remove Kimmel.
Michael digs into today's Smerconish.com poll question, sparked by a fiery legal debate after comments made by Attorney General Pam Pondi on going after people who were spreading 'hate speech'' in the wake of the death of Charlie Kirk: “Agree or Disagree: ‘Hate speech does not exist legally in America. There's ugly speech… gross speech… evil speech. And ALL of it is protected by the 1st Amendment.'” Putting this current controversy in context with landmark Supreme Court rulings and his own legal knowledge, Michael unpacks where the law really stands—and why it matters now more than ever. Hello to you listening around the world!Coming to you from Whidbey Island, Washington this is 60 Seconds for Wednesdays on Whidbey with your host Diane Wyzga.About a block from my library or a block from the post office sits a house on a corner. Propped against this house I saw a very large sheet of plywood. Spray-painted in large black letters were these words: Kill Lawyers - Not Cops. Putting aside any 1st Amendment right of free speech arguments or the notion that many folks don't like lawyers until they need one, I have a question: When and how did we arrive at this place? When and how did we depart from human kindness, civility, and manners? I've often spoken to the man who lives in this house as I passed by on my walk, admired his sunflowers, commented on the weather. I plan to walk up to his door and say, “I am a lawyer. Are you going to kill me? Or do you wish someone would?” I want to hear how he arrived at his position. And then perhaps get him to put away his larger-than-life sign before some yahoo takes him up on the dare.Practical Tip: Be of speech a little more careful than anything else today, tomorrow, and forever. Vance urges supporters on The Charlie Kirk Show to report and call the employers of people who "celebrate" Charlie Kirk's killing, effectively endorsing mass doxxing -- Trump tells supporters to "do whatever the hell you want" toward people they dislike, which encourages mob violence and lawlessness -- Gavin Newsom warns that Trump and Stephen Miller plan to rebrand Democrats as terrorists to justify dismantling democratic institutions -- Kash Patel and others claim a missing manifesto proves motive in the Charlie Kirk killing despite no presented chain-of-custody or verifiable evidence -- Rachel Campos-Duffy and Kevin Corke on Fox & Friends push an unfounded narrative that Tyler Robinson's gender identity or hormones caused Charlie Kirk's shooting -- On the Bonus Show: Trump sues the New York Times for $15 billion alleging defamation, Kash Patel gets questioned on Capitol Hill, Kathy Hochul endorses Zohran Mamdani, and much more...
Join Jim and Greg for Monday's 3 Martini Lunch as they call out Democrats and the media for lying about Charlie Kirk's assassin, criticize Attorney General Pam Bondi for forgetting the First Amendment, and laugh at Pete Buttigieg's sudden admission that Joe Biden should never have run for re-election.First, they update the latest evidence in the case against the shooter who assassinated Charlie Kirk last week in Utah and then hammer elected Democrats and leftists in the media who stressed that the parents were Republicans and tried to peddle the fiction that killer was mad that Kirk was not far right enough, even after the facts were painfully obvious.Next, Jim and Greg reprimand Attorney General Pam Bondi for threatening to prosecute people for their despicable celebrations of Charlie Kirk's murder. She also demanded employers fire any employees who did that. They remind Bondi that public pressure on employers over that kind of speech is very different than the government filing charges or trying to get people fired. Jim says that's exactly what the left has been trying to do to conservatives for years. Finally, they laugh as former Transportation Sec. Pete Buttigieg weakly follows Kamala Harris' lead and says Joe Biden definitely should not have run for re-election in 2024. But Buttigieg, who also never said a word about his alleged concerns, says it's just time to move on now. Please visit our great sponsors:If your business can't adapt in real-time, you're in a world of hurt.
