Well, to a specific movie, anyway – a documentary being made to raise public awareness and understanding of the access to justice crisis in this country.  Today's guests are the film's director, documentary filmmaker Laura Hand, who previously directed The Tent Mender, about homelessness on Skid Row in Los Angeles, and Maya Markovich, a legal innovation leader – and two-time previous guest on this show (here and here) – who is serving as a producer and advisor to the documentary. You may know Markovich as executive director of the Justice Technology Association and for her recent appointment as vice president of the American Arbitration Association's thought leadership and research arm.  The documentary, called Justice: Just A Promise?, has been given unprecedented access to film inside the courthouses of the Los Angeles County court system – the largest court system in the world and one where litigants unable to get a lawyer present enormous challenges to the civil justice system.  As this episode airs, the filmmakers have just launched an Indiegogo crowdfunding campaign to raise the money they need to complete and distribute the film. Maya started her career journey in change management consulting for tech, then became a practicing lawyer. Having a deep interest in the possibilities of technology in the legal profession, she went on to work in legal tech product management and product marketing. She later joined Nextlaw Labs and Nextlaw Ventures, founded by Dentons, as Chief Growth Officer. As justice tech executive in residence at Village Capital, Maya works with a broad investor coalition and startup founders to define, support, grow, and fund the justice tech sector. As executive director of the Justice Technology Association, she supports the change-makers who are developing meaningful tech solutions to the A2J crisis. Ep 213: DoNotPay, Legal Regulatory Reform, and the Op-Ed the ABA Wouldn't Publish, with Maya Markovich and Tom Gordon

Today's episode offers a different perspective on the DoNotPay controversy – and ended up having an unexpected twist.   Earlier this year, DoNotPay, which described itself as the world's first robot lawyer, and its founder Joshua Browder became the subject of harsh criticism after paralegal Kathryn Tewson tested several of DoNotPay's self-help legal apps and concluded they were little more than smoke and mirrors – in some cases getting the law wrong, in others failing even to deliver the promised output.  In the wake of Tewson's allegations, this podcast recorded an exclusive interview with Browder, in which he called the criticism “a bit of a nothingburger.” I followed that Interview with one with Tewson, in which she described in detail how she tested the DoNotPay products and responded to Browder's dismissal of her critique.  Following those events, our guests today, Maya Markovich, executive director and cofounder of the Justice Technology Association and executive in residence for Justice Tech at Village Capital, and Tom Gordon, executive director of Responsive Law, an organization that represents the consumers' voice in the legal system, co-authored an op-ed in which they argued that reforms in the regulation of the practice of law, such as those implemented in Utah, could have prevented the DoNotPay debacle, since DoNotPay would have had to have been licensed and regulated. They submitted their op-ed to the American Bar Association's Center for Innovation, which agreed to publish it in the Center's biannual innovation trends report, slated to be released Aug. 1. In anticipation of that publication, LawNext host Bob Ambrogi recorded the interview you're about to hear with Markovich and Gordon, in which they discussed their op-ed and their views more broadly on regulatory reform. The interview was scheduled to post Aug. 1, in conjunction with the op-ed's publication that day.  But then the plan hit an unexpected twist. Instead of publishing the op-ed that day, the Center notified the authors that it had canceled the publication because of what it described as “political challenges” within the ABA, but that it had neglected to inform them of that.  Because this interview was recorded before the ABA canceled the op-ed, you will hear references to the ABA's publication of the op-ed. But since that never happened, Markovich and Gordon allowed us to publish the op-ed on LawNext. We talk about justice tech having an impact on access to justice but since access to justice is not a technology, but a systemic problem, we also concentrate on what else could we do as a society. Just recently Henna met with some law students and learned that the generation we believed was born to use technology is really questioning whether or not there will be entry level legal jobs in the future (Yes, there will!). We asked Maya's opinion about this and discussed the future of legal. An increasing number of startups are defining themselves not as legal tech, but as justice tech. So what, exactly, is justice tech, who are some of the companies that represent it, and what is the business opportunity they present for potential investors? Our guest this week is Maya Markovich, executive director of the Justice Technology Association, an organization formed earlier this year to support companies in the justice tech sector.  She is also executive in residence for justice tech at Village Capital, the largest organization in the world supporting impact-driven, seed-stage startups, where she recently co-authored the report, Supporting Tech for Justice-Impacted Communities: Strategies to Supercharge Justice Tech Investing, a framework to help investors maximize the probably that a justice tech investment will have a positive impact on individuals involved with the justice system.  Until last year, Markovich was chief growth officer at Nextlaw Labs, the legal tech incubator created by Dentons, one of the world's largest law firms. We all know that it takes some "outside of the box thinking" to help improve the legal system in the United States, especially when it comes to Pro Se litigants. Courtroom5 CEO and co-founder Sonja Ebron does exactly that with her startup focused on guiding Pro Se litigants through complex court processes. Ed Walters, CEO and co-founder of Fastcase wants the legal industry to stop trying so hard to reinforce that "box." Together, Ebron and Walters are creating a process to help litigants access and navigate the court system through a combination of case process instructions, legal information, Artificial Intelligence, and collaboration with legal professionals. Eventually, Ebron would like to see the courts themselves leverage Courtroom5's abilities to help those seeking legal recourse. Walters stresses that the "North Star" of legal practice should be the wellbeing of clients. In a system where according to The World Justice Project, over 75% of legal needs go unmet, and some 80% of citizens seeking judicial action do so without the use of legal professionals. Part of that solution lies with the courts and the need to focus on the ability "to filter out people who need lawyers helping people who don't." Once again, this is not about replacing lawyers with robots, or encouraging Pro Se litigants to not seek legal assistance. Courtroom5 and Fastcase are seeking ways to improve the overall process of placing the right information in front of litigants, at the right time. We are all pretty familiar with the phrase "Legal Tech." Maya Markovich and Yousef Kassim would like you to also become more familiar with the phrase "Justice Tech" as well. In fact, they have a new trade association focused on this issue called the Justice Technology Association or JTA. Justice Tech is defined as those companies which build tech solutions which are designed to improve or open access to legal rights, improve outcomes, and increase equity within a system that is stacked against users who are often going it alone in the justice system. Yousef Kassim's product, EasyExpunctions.com is one example. Maya Markovich is the Executive Director of JTA, and along with founders like Yousef Kassim and a diverse board of advisors, JTA is looking to leverage technology to help those seeking access to justice. This group of founders and advisors are not limited to lawyers, as access to justice is not a problem that can be solved by lawyers alone. JTA brought in engineers, policy advisors, academics, venture capitalists, and a wide range of other professionals to help guide the mission of the trade association. When Sang Lee set out to begin her own talent management and recruitment company, her two-decades of experience taught her that much of the industry felt like a charade. To change that, she thought of the phrase, "To Thine Own Self Be True" as a guiding principle and from that came the company she co-founded called Thine. The youngest of three daughters from an immigrant family, she had many expectations placed upon her, but while she and her sisters all graduated from Georgetown Law School, her father's dream of a Lee, Lee, & Lee law firm never came into fruition. Instead, Sang found herself in the legal recruiting profession after working as an associate in a large law firm. In 2019, she launched Thine with Jon Strom where they focus on custom assessments and benchmarking for recruiting, leadership skills, and competency assessments to find and build great fits for both the law firms and the attorneys. Thine's use of algorithmic data, Organizational Psychology, and interview insights creates assessments which reflect what it really takes to be a successful attorney within the firm. Sonja Ebron found herself in a couple legal tangles over the years. From disputes with landlords to dust-ups with shady creditors, she represented herself in court a couple times and quickly figured out litigation without a lawyer can be very difficult. So, what did she do about it? She founded Courtroom5, an app that helps civil pro se litigants with legal research, provides education about court procedures and also helps them draft and file pleadings. A “do-it-yourself” litigation support tool. In 2019 when Courtroom5 participated in the Duke Law Tech Lab incubator program, Sonja met Maya Markovich who joined the Courtroom5 advisory board. Together with the Courtroom5 team, they are trying to bridge the access to justice gap and make it a little easier on litigants who head to court without a lawyer.

Most people view legal profession as traditional and slow to adapt to ever present forces of technology and innovation. In some aspects they are right and there are good reasons for moving slowly. In its core, legal profession is intrinsically based on trust and human to human interaction.
