When it comes to Russia, Trump's America appears on the verge of a major foreign policy U-turn. A couple of weeks ago, Trump called Zelenskyy a dictator and lyingly claimed that Ukraine had started the war. Then there was the February 28 ‘Oval Office Ambush' heard round the world. Don't forget that after years of isolating and sanctioning Russia over its invasion of Ukraine, Team Trump met face to face with the Russian Foreign Minister in Saudi and now appears ready to do direct business with Russia and to be actively seeking to humiliate the Ukrainians. Despite these worrying moves, at the moment, the U-turn remains hypothetical… all words, not yet binding actions. So… how seriously should we take this perspective shift? Does the ‘Vance/Trump Oval Office Ambush' change everything? And what are the implications for Europe and its allies if America actually switches sides to support Russia long term? To discuss this perilous moment, we're joined again by Sir Bill Browder, a successful investor, a globally acclaimed author, and a famous philanthropist/humanitarian advocate. Browder's tireless advocacy for holding dictators and their henchman to account is widely known. This action upheld a ruling from the U.S. District Court for the Middle District of Alabama, which had declared state and local bus segregation laws unconstitutional. Trump's team, led by conservative lawyer Mark Paoletta, is signaling that department employees must either support Trump's agenda or risk losing their positions, signaling a deep commitment to loyalty over impartiality.Trump has promised to prioritize mass deportations, pardon January 6 rioters, and aggressively pursue individuals and officials he believes have wronged him, including political figures like Joe Biden, prosecutors like Alvin Bragg, and past critics like Liz Cheney. The case, led by Swedish investment firm E. Ohman J:or Fonder AB, claims Nvidia and CEO Jensen Huang made false statements in 2017-2018 that downplayed how much of the company's revenue growth stemmed from volatile crypto markets. When cryptocurrency profitability declined in 2018, Nvidia's revenue fell short of projections, leading to a stock price drop that hurt investors.The lawsuit initially dismissed by a federal judge was later revived by the 9th Circuit Court, which found the plaintiffs had sufficiently alleged that Nvidia's leadership knowingly or recklessly made misleading statements. Delligatti's case challenges a firearms statute that imposes a minimum five-year sentence for crimes involving “the use, attempted use, or threatened use of physical force.”The justices grappled with “absurd” hypotheticals to explore if a crime can be violent in nature without actual force, as the statute requires. Justice Ketanji Brown Jackson highlighted a hypothetical involving a lifeguard refusing to save someone, pointing out that under the court's “categorical approach,” even passive omissions could be considered violent. Justice Neil Gorsuch suggested the court could separate violent acts from omissions to avoid “absurdity.” Yet, the debate underscores the challenge: whether the law's strict categorization aligns with common-sense definitions of violent crimes, especially in cases involving complex, indirect criminal conduct like murder-for-hire.Mafia Case Tests Supreme Court on Crime of Violence Limits (1)Wealth managers are increasingly turning to strategies like the “tax-aware long-short” to help high-net-worth clients avoid taxes. This tax-loss harvesting approach involves holding one stock expected to appreciate long-term and another stock likely to decline in value short-term. When the anticipated loss occurs, the losing asset is sold to offset gains from the appreciating one, reducing taxable income and the overall tax bill. At the macro level, this strategy effectively shifts the tax burden from wealthy investors to average taxpayers and ultimately reduces public funds for essential services.The preferential treatment of long-term capital gains—taxed at up to 20%, compared to a 37% maximum for ordinary income—already favors investment income over wages. While this policy was intended to promote investment, its default high cost to public funds and the extensive tax planning that can be used to exploit it reveal systemic failures in the tax code. When tax professionals and investors go to such lengths to sidestep taxes, this reflects inefficiencies and inequities in tax policy.Addressing this issue requires substantial policy reforms. One solution would be to tax capital gains at the same rate as wages, removing the impetus to shift income into capital gains and thus increasing tax equity between ordinary income and investment income. While this might simplify the tax code and raise substantial revenue, it could discourage investment and lead to market volatility as investors bear more risk without tax-offset options.Another option is to tax unrealized gains, similar to property taxes which tax value without the need for realization, where gains are taxed at regular intervals even if the asset isn't sold. Under this approach, unrealized capital losses could offset unrealized gains during these set intervals, reducing opportunities for manipulative tax timing. This method would diminish the appeal of strategies like the long-short by minimizing the benefits of timing short-term losses against long-term gains. In sum, the effect of timing-based tax loss planning strategies would largely be blunted. On the polar opposite policy spectrum, lowering capital gains rates would reduce the financial incentive to hire advisors for complex tax avoidance strategies. Lowering rates might make it more cost effective for investors to pay taxes directly rather than invest in costly avoidance techniques.Ultimately, tax reform should prioritize policies that effectively generate revenue while minimizing the need for complex, resource-intensive planning.We Need a Better Way to Reduce Tax Avoidance and Enhance Equity This is a public episode. Artist and health care activist Michelle Browder has forced a reckoning with this legacy with one clear goal — we need to talk about the mothers. In the days following Navalny's murder, Western leaders have made all too predictable speeches and issued all too predictable condemnations. But as of yet, very little concrete action has been taken to respond to the murder of Russia's most prominent opposition politician. The West talks the talk, but has yet to walk the walk. How should Biden, Sunak and Ursula Van Der Leyen hit Putin where it actually hurts and genuinely punish him for his actions? In this episode of Disorder, Jason Pack sits down with successful investor, globally acclaimed author, and famous philanthropist/humanitarian advocate, Bill Browder. A close friend of Navalny, Browder talks of his emotions at hearing of his ally's death, how ‘demoralizing' the news is for ordinary people opposing Putin's regime, and what the West can now do to turn their words of condemnation and outrage into concrete actions. On this episode of the EBB podcast, we talk with Michelle Browder, artist, activist, and the creator of the Anarcha, Lucy, and Betsy Monument in Montgomery, Alabama, established to honor the three Mothers of Gynecology. Michelle Browder is a nationally recognized artist, activist, and amplifier, bridging the racial divide through art, history, and conversation. Michelle's artwork has been exhibited in art galleries around the world, most notably, the Rosa Parks Museum located in Montgomery, Alabama. In September 2021, she created a monument to honor three enslaved women, Anarcha, Lucy, and Betsey, in Montgomery, Alabama. This monument is a reminder of the inhumane treatment and experimentation on enslaved Black bodies. The medical procedures that we have access to today in gynecology have been perfected because of them. The monument honors these Black women and all those that came after to correct the historical narrative around the beginnings of gynecology. Michelle shares with us how she originally learned about the dark history of Anarcha, Lucy and Betsy and the inspiration to create a monument about the true founders of the field of gynecology. Not only is Michelle working to correct the history of gynecology, she discusses her progress and future plans to bring access, care, and healing to families and practitioners in the 21st Century, at the same site of the torture of Anarcha, Lucy, and Betsy, the Mothers of Gynecology. Bill is the CEO Hermitage Capital Management, Head of the Global Magnitsky Justice Campaign and author of Red Notice William Browder was the largest foreign investor in Russia until 2005, when he was denied entry to the country and declared “a threat to national security” for exposing corruption in Russian state-owned companies. In 2008, Mr. Browder's lawyer, Sergei Magnitsky, uncovered a massive fraud committed by Russian government officials that involved the theft of US $230 million of state taxes. Sergei testified against state officials involved in this fraud and was subsequently arrested, imprisoned without trial and systematically tortured. He spent a year in prison under horrific detention conditions, was repeatedly denied medical treatment, and died in prison on November 16, 2009, leaving behind a wife and two children. Since then, Mr. Browder has sought justice outside of Russia and started a global campaign for governments around the world to impose targeted visa bans and asset freezes on human rights abusers and highly corrupt officials. The United States was the first to impose these targeted sanctions with the passage of the Sergei Magnitsky Accountability Act in 2012, followed by the Global Magnitsky Human Rights Accountability Act in 2016. Since then, Canada, the United Kingdom, the Baltic states, the European Union and most recently Australia have passed their own versions of the Magnitsky Act. Mr. Browder is currently working to have similar legislation passed in other countries worldwide including New Zealand and Japan, to name a few. Few people know more about Vladimir Putin than Bill Browder. Browder, an investor and political activist, is the architect of the Magnitsky Act, which allows the US government to sanction foreign nationals who have perpetrated human rights abuses. One of Browder's key allies in the passage of the Magnitsky Act was a fellow activist named Vladimir Kara-Murza. Kara-Murza is now imprisoned in a Russian jail. Browder joins Preet to discuss Kara-Murza's case and Putin's war on his political opponents. Following his expulsion, the Russian authorities raided his offices, seized Hermitage Fund's investment companies and used them to steal $230 million of taxes that the companies had previously paid. When Browder's lawyer, Sergei Magnitsky, investigated the crime, he was arrested by the same officers he implicated, tortured for 358 days, and killed in custody at the age of 37 in November 2009. Since then, Browder has spent the last 5 years fighting for justice for Mr. Magnitsky. The Russian government exonerated and even promoted some of the officials involved so Browder took the case to America, where his campaigning led to the US Congress adopting the ‘Sergei Magnitsky Rule of Law Accountability Act' in 2012, which imposed visa sanctions and asset freezes on those involved in the detention, ill-treatment and death of Sergei Magnitsky (as well as in other human rights abuses). This law was the first time the US sanctioned Russia in 35 years and became the model for all subsequent US sanctions against Russia. Browder is currently working to have similar legislation passed in Magnitsky's name across the European Union.
