In his keynote address at the recently concluded 2023 Clio Cloud Conference, Jack Newton, the founder and CEO of Clio, said that we are at a time in the legal industry when leveraging technology is more important for lawyers than ever before. Technology, he said, enables lawyers to amplify their impact, and when they do that, they can achieve exponential outcomes.  This was the 11th year of the Clio Cloud Conference, and the 15th year in business for the company that produces it. Ep 213: DoNotPay, Legal Regulatory Reform, and the Op-Ed the ABA Wouldn't Publish, with Maya Markovich and Tom Gordon

Today's episode offers a different perspective on the DoNotPay controversy – and ended up having an unexpected twist.   Earlier this year, DoNotPay, which described itself as the world's first robot lawyer, and its founder Joshua Browder became the subject of harsh criticism after paralegal Kathryn Tewson tested several of DoNotPay's self-help legal apps and concluded they were little more than smoke and mirrors – in some cases getting the law wrong, in others failing even to deliver the promised output.  In the wake of Tewson's allegations, this podcast recorded an exclusive interview with Browder, in which he called the criticism “a bit of a nothingburger.” I followed that Interview with one with Tewson, in which she described in detail how she tested the DoNotPay products and responded to Browder's dismissal of her critique.  Following those events, our guests today, Maya Markovich, executive director and cofounder of the Justice Technology Association and executive in residence for Justice Tech at Village Capital, and Tom Gordon, executive director of Responsive Law, an organization that represents the consumers' voice in the legal system, co-authored an op-ed in which they argued that reforms in the regulation of the practice of law, such as those implemented in Utah, could have prevented the DoNotPay debacle, since DoNotPay would have had to have been licensed and regulated. They submitted their op-ed to the American Bar Association's Center for Innovation, which agreed to publish it in the Center's biannual innovation trends report, slated to be released Aug. 1. In anticipation of that publication, LawNext host Bob Ambrogi recorded the interview you're about to hear with Markovich and Gordon, in which they discussed their op-ed and their views more broadly on regulatory reform. The interview was scheduled to post Aug. 1, in conjunction with the op-ed's publication that day.  But then the plan hit an unexpected twist. Instead of publishing the op-ed that day, the Center notified the authors that it had canceled the publication because of what it described as “political challenges” within the ABA, but that it had neglected to inform them of that.  Because this interview was recorded before the ABA canceled the op-ed, you will hear references to the ABA's publication of the op-ed. But since that never happened, Markovich and Gordon allowed us to publish the op-ed on LawNext. Ep 204: Logikcull Cofounder Andy Wilson on 10 Years of Disrupting and Democratizing E-Discovery

This year marks the 10th anniversary of Logikcull, the company that CEO Andy Wilson and CTO Sheng Yang founded with the goal of automating and democratizing e-discovery. But the company actually evolved out of an earlier company the pair founded in 2004, Logik Systems, to digitize archaic paper-based discovery workflows where lawyers would print emails to paper to review them. While that first company saw rapid growth and even made the Inc 500 in 2009 at number 181, the Great Recession took the wind out of its sails and caused the two founders to reassess their business model.  Aiming to automate what they had previously done manually, they eventually launched Logikcull as one of the earliest cloud-based e-discovery platforms. Not only did they aim to automate the process, but also to democratize it by making that automation affordable and accessible for anyone. Ten years after launching Logikcull, Wilson joins host Bob Ambrogi to discuss the growth of the company and the evolution of its platform, which Wilson says is seeing record usage. Among other things, Wilson discusses the challenges the company faced in getting lawyers to trust their documents to a cloud-based platform, how lawyers' perspective on the cloud has changed in recent years, and how a new generation of AI could impact e-discovery in the future.  This is Wilson's second time on LawNext. Ep 153: From Radical to Trailblazer: How Innovative GC Jeffrey Carr Disrupted the Legal Department, Part 2

In this second of a two-part interview, we continue our conversation with Jeffrey Carr, a trailblazing general counsel who describes his career as decades spent on the radical fringe of reforming legal services delivery. Many of his ideas for revamping legal departments, once viewed as radical, have now become mainstream.  As general counsel at FMC Technologies in the early 2000s, Carr disrupted how legal departments hire and compensate outside counsel, creating models that today are considered standard operating procedure at many companies.  After retiring from FMC in 2014, he went on to work with Valorem Law, one of the earliest law firms to focus on making alternative fee arrangements the norm. Valorem became the progenitor of ElevateNext, the law firm affiliate of the global law company Elevate. Carr returned to a GC role in 2019 at Univar Solutions, where he sought to build the law department of the future. Now retired, he teaches, writes, and pursues his hobby of driving race cars.  Last week, in part one of the interview, Carr spoke with host Bob Ambrogi about how he landed on the “radical fringe” of reforming legal services, and he discussed some of the trailblazing initiatives he created at FMC, including the Alliance Counsel Engagement System, or ACES, a method of hiring outside counsel so unique that he was encouraged to patent it. In this second installment of the interview, Carr discusses another of the initiatives for which he is known, the Litigation Value Challenge, which came to be emulated by the Association of Corporate Counsel and many of its members. How One Law School Teaches Legal Tech, Pre- and Post-Pandemic

Here’s one that gets a bit meta. Back in November 2017, LawNext host Bob Ambrogi spoke at BYU Law School about a lawyer’s ethical duty to be technologically competent. The talk prompted the school to explore ways it could help students improve their technological abilities. What resulted was the school’s Legal Technology Initiative, a multi-pronged program to provide law students with technology training and assessment.  Initially overseen by Shawn Nevers, deputy director of the law library, BYU this year brought on Tina Wilder, a former practicing lawyer, as an assistant law librarian to assist Nevers and take the lead in running tech training. On March 12, 2020, Ambrogi was at BYU and sat down with Nevers and Wilder to discuss the initiative and learn more about how the school teaches technology.  But what no one anticipated when the interview was scheduled was that March 12 would be the very day that the coronavirus crisis would force the school to shut down its physical classrooms and put its lessons online. So Ambrogi recently connected with Nevers and Wilder for a follow-up on how going virtual has impacted the initiative. This episode of LawNext begins with the original interview with Nevers and Wilder recorded March 12. Exploring the Meaning of Legal Terms through Corpus Linguistics

At BYU Law in Provo, Utah, a first-of-its-kind technology platform is enabling legal researchers to explore the meanings of legal words and phrases by examining the contexts in which they historically were used. The Law and Corpus Linguistics platform enables users to examine large collections of historical texts to help determine, for example, what early drafters meant by a phrase such as “bear arms.”  In this episode of LawNext, my guest is David Armond, head of infrastructure and technology and senior law librarian at BYU Law, who was instrumental in helping create and launch the platform. We discuss this emerging field of corpus linguistics and how it is being used by lawyers, judges and legal scholars.  The BYU Law collection is now home to seven collections of historical text, or corpora, including founding-era American English (1760-1799), early modern English (1475-1800), Supreme Court opinions, U.S. caselaw, records of the Constitutional Convention of 1787, and more.  As it happened, host Bob Ambrogi interviewed Armond live at BYU Law on the very day that the school decided to close down due to the coronavirus crisis. Before discussing their scheduled topic of corpus linguistics, Armond and Ambrogi had a conversation about how a law school prepares to shut down and go online. Não necessariamente é o triathlon ou o treinos, tampouco a Cape Epic onde nos encontramos por acaso. O que nos conecta é a bicicleta. Ele, tanto quanto eu, tem uma relação especial com as magrelas, desde muito cedo. Giba foi campeão brasileiro júnior de MTB em 1990 e no mesmo ano correu o campeonato mundial da modalidade. Experimentou as sensações de treinar e completar uma prova de Ironman e participou da Cape Epic, do Haute Route entre outras provas legais. Profissionalmente, foi pioneiro no Spinning por aqui, atuou como professor em grandes academias e mais recentemente, integrou a equipe de uma assessoria esportiva de São Paulo, concentrando-se nos treinamentos de ciclismo. Today I have Giulia Ambrogi with us on Audiogyan. She is a co-founder and curator of a non-profit organisation, St+art India Foundation which has been making waves in the Indian street art movement. It aims to make our streets more interactive through the medium of urban art festivals across India. They have been instrumental in improving the aesthetics of cities like Delhi, Hyderabad, Bangalore and Mumbai. And today we are here to discover what goes into making it happen. 1. Can you briefly tell us about St+art project? Since when is this active and what do you do exactly in this project? 2. What is the importance of murals in society? How and what changes happen once a city scape has some murals / paint over it; as per your understanding? 3. Does Art need to be site specific? Can you tell us how do you pick your canvas? 4. New Rulings for Juvenile Life Sentences by the Supreme Court

On January 25, 2016, in a 6-3 opinion written by Justice Kennedy, the Supreme Court ruled that those sentenced as juveniles to mandatory life imprisonment for murder, “should have a chance to be resentenced or argue for parole.” This ruling plays off of the 2012 decision in Miller v. Alabama, which struck down mandatory life terms without parole for juveniles. This now must be applied retroactively and could affect at least 1,000 inmates in similar situations across the country. In this episode of Lawyer 2 Lawyer, host Bob Ambrogi joins Emily C. Keller, a supervising attorney at Juvenile Law Center, and professor Christopher Slobogin from Vanderbilt Law School as they look at the recent Supreme Court decision, inside Montgomery v. Louisiana and Miller v. Alabama, the impact on past and future cases involving juveniles, the decision’s impact on the families of victims and juvenile justice reform. Emily C. Keller engages in litigation and policy efforts to improve the child welfare and justice systems, including efforts to eliminate juvenile life without parole. Emily served as co-counsel for Henry Montgomery in Montgomery v. Louisiana before the U.S. Supreme Court and co-authored an amicus brief in Miller v. Alabama, the U.S. Supreme Court’s 2012 case banning mandatory life without parole sentences for juveniles. Emily has also submitted amicus briefs in cases around the country challenging the imposition of life without parole and other extreme sentences on juvenile offenders. Professor Christopher Slobogin occupies the Milton Underwood Chair at Vanderbilt Law School, where he directs the criminal justice program.  He has authored several books, including Juveniles at Risk: A Plea for Preventive Justice, published by Oxford University Press. All lawyers have an ethical obligation to employ security measures when sharing information and data with their clients. Whether that means encrypting all important emails or properly researching cloud based file-sharing services like Dropbox, it is incumbent on lawyers to understand the levels of security available. LexisNexis recently did a survey on what tools lawyers and legal professionals are using to protect their clients' privileged information. 77% of the lawyers surveyed did not have adequate security for their confidential client data. How important is encryption and what can lawyers do to change the way they share data? On this episode of Digital Detectives, Sharon Nelson and John Simek interview Bob Ambrogi, a lawyer and journalist who recently wrote about the LexisNexis survey. They ask him about the implications of the survey, what security measures lawyers should be taking, how frequently clients are hurt by lack of security, and why lawyers are generally resistant to learning about data encryption. Ambrogi explains that an overall lack of information, ignored ethics rulings, lack of time, and assumed difficulty are the reasons lawyers often refuse to learn how to safely share data. He encourages lawyers, especially the ones in small or solo firms, to seek out a consultant to learn about the relatively easy encryption tools and techniques. After all, no lawyer wants to be a part of the 77%. Bob Ambrogi is a Massachusetts lawyer and journalist and has covered legal technology and the Internet for two decades. If it’s not legally a human, it’s a thing. But animal rights advocates argue these alternatives fail to recognize that there are many cognitively complex species who deserve to be treated as people. The Nonhuman Rights Project is planning to file a writ of habeas corpus on behalf of a chimp to grant her the right to bodily liberty. This will release her from the cage she is currently living in, and the project will have her admitted into a cageless sanctuary. Steven M. Wise, president of The Nonhuman Rights Project, has been researching and planning this case for 20 years. Steven M. Wise has been practicing animal protection law nationwide for for the past 30 years. He was the first professor to teach animal law at Harvard University and is still teaching animal law courses all over the world. Personal Audio’s founder Jim Logan created and patented an idea which, in his eyes, covers the concept of podcasting. “This is the story of the American inventor,” Richard Baker, Personal Audio’s vice president of licensing, says. Personal Audio has filed lawsuits against several podcasters and media companies, claiming patent infringement by popular programs such as NBC’s The Adam Carolla Show and by CBS for its podcast distribution of multiple shows including The Voice and Meet the Press. On the other side, The Electronic Frontier Foundation (EFF) has spearheaded a campaign dubbed “Save Podcasting!” to rescind Personal Audio’s patent. EFF’s goal is to revoke Personal Audio’s right to compensation from any podcast program. Daniel Nazer, a staff attorney working on the campaign, represents EFF on the program. On this episode of Lawyer2Lawyer, Bob Ambrogi and Craig Williams invite California Judge James Mize to discuss his first-of-its-kind idea to address the heavy congestion of divorce cases in Sacramento’s family court: The One-Day Divorce Program. This allows couples, who meet the specified requirements, to participate in an expedited divorce process that finalizes the separation in just one day. This program aims to serve couples who can’t afford a divorce lawyer. According to Judge Mize, 72% of family law litigants in California don’t have representation. Judge Mize began his career with an undergraduate degree in psychology, followed by graduate work at the School of Social Welfare where he earned his Master of Social Work. He found his work in social issues to be a defining part of his 26 years working as an attorney, and his current work on the bench. He has served as the presiding judge of the Sacramento Superior Court and is currently the supervising judge of Sacramento’s Family Court. Judge Mize is best known for his civil reform efforts which have garnered him several honors including the California Judge Association’s Alba Witkin Humanitarian Award and Sacramento County Bar Association’s Judge of the Year Award.
