In this episode of the Legal Marketing 2.0 Podcast, Guy is joined by Christopher Melcher. Business owners, celebrities, and trust beneficiaries across California turn to Christopher Melcher for assistance protecting their most valuable assets in high stakes divorces. With deep experience in complex family law litigation and premarital agreements, he provides tactical representation in the most challenging family law disputes. He understands the need to keep sensitive family matters private, having represented noteworthy clients in the largest divorce cases in California. Clients include A-list celebrities, executives, and tech company founders. He is frequently hired by other family lawyers as a consultant, expert, or co-counsel on significant divorce cases in California. His passion is helping others and he loves the law. His father was a trial lawyer and he's learned not only how to be a lawyer from him, but what it means to be a lawyer. He has presented about 200 continuing legal education programs to other attorneys on complex family law issues and is a published author. He also wrote the only treatise on California premarital agreement law, published by LexisNexis. He is an adjunct professor of family law at Pepperdine University School of Law in Malibu. Before entering family law exclusively, he practiced criminal defense and civil personal injury litigation. Christopher joins us today to discuss how he was able to find success through social media as a lawyer.
Christopher Melcher is Partner at Walzer Melcher LLP, where he specializes in Family Law and represents clients in complex, high-stakes family law disputes. He is also Adjunct Professor at Pepperdine Law. Christopher is frequently hired by other family lawyers as a consultant, expert, or co-counsel on significant divorce cases in California. He joins Stacy Francis to talk about the breadwinning woman, and the financial considerations she needs to think about if she's considering divorce. In recent times, the number of women who are considered breadwinners has been the highest recorded number in history. More women than men are graduating college and, due to societal issues, are taking the lead in their families to earn more. The implications for how this affects marriage are such that marriages with female breadwinners are 50% more likely to end up in divorce. When it comes to alimony agreements, it's better to accept them and move on than to try contesting them in court. What that does is increase the amount of money you spend on legal fees and decrease the amount of money you have readily available, ultimately leaving the attorneys as the real winners. Before pulling the plug on marriage, it's important to seek advice from a good divorce lawyer and financial planner to prepare yourself for the economic changes that being single again will bring. Chris recommends having a friend help you put together a team of a divorce lawyer, financial planner, and counselor while you go through the divorce process. Christopher Melcher is a leading name in the field of family law and a Partner of Walzer Melcher LLP. He primarily works with celebrities, business owners and trust beneficiaries in divorce cases. His specialization lies in discretional practice and navigating the financial aspects. Christopher brings over 27 years of total experience to the table for his clients, with almost 20 of those at his current firm. His first experience as a lawyer came from his father's law firm where he handled criminal defense and personal injury cases. Aside from his practice, he also teaches as an Adjunct Professor at Pepperdine Law. In this episode: There are few better ways to get your name out there like appearing on TV. Even on smaller networks, there is a tangible sense of importance and credibility that TV gives to people. Most law firms or lawyers only appear in advertising. However, some have found the secret to being featured as a source by media outlets. This not only gives exposure to the lawyer but also reinforces their expertise for all to see. It's an effective strategy, but one that few people enjoy. Christopher Melcher has made a name for himself by appearing on multiple channels as a reliable source. Most recently, he has been giving his insight on the Britney Spears conservatorship case. His law firm has built its reputation on privacy and outstanding service, working for some of the most well-known families in California. He was able to find his niche as a media source, and now, so can you. On this episode of the Spill the Ink! podcast, Michelle Calcote King sits down with Christopher Melcher, a Partner of Walzer Melcher LLP, to learn the secret behind becoming a legal source for media outlets. Christopher talks about finding his start as a source and how he leveraged it into the career he has today. They go over the pitch process, preparing to speak on television and the importance of relationships. Stay tuned for more!

Today we're talking about the #FreeBritney movement. It's a lot more than just a hashtag. Popstar Britney Spears has been wrapped up in a legal battle over her conservatorship for a while now and new developments have been coming out every week. The conservatorship is an arrangement that's given Britney's father, Jamie, along with a licensed “conservator” control over her finances and other parts of her life since 2008. That arrangement was originally put in place because of concerns over Britney's mental health and alleged drug use. But in the last few weeks, Britney has spoken in court. She says she's been exploited and bullied by the conservatorship for years. She says she's been overworked without any breaks, forcibly medicated with lithium and kept from having more children. And she wants control over her life back. This whole saga has opened many people's eyes to conservatorships for the first time and sparked a lot of conversations about personal freedoms. Today we're talking to family law attorney Christopher Melcher, who has been following Britney's case closely. He explains why conservatorships exist, how they work and his takeaways from the Britney Spears case. A sobbing Britney Spears lashed out at her father Wednesday for the second time in less than a month, saying in a court hearing that she wants him out as the co-conservator of her estate and charged with abuse."I want to press charges against my father today," Spears told the court by phone, breaking down in tears at times. "I want an investigation into my dad."Her comments Wednesday follow a hearing last month in which she told Los Angeles County Superior Court Judge Brenda Penny that her conservatorship is "abusive" and she wanted to choose her own attorney to help her bring the nearly 13-year arrangement to an end.Samuel D. Ingham had been Spears' court-appointed attorney since the beginning of her conservatorship in 2008.He submitted his petition to resign last week after the singer criticized his representation. The judge accepted Ingham's resignation Wednesday, along with the resignation of Bessemer Trust, a wealth management firm that had been appointed co-conservator of the singer's estate.Spears has retained former federal prosecutor Mathew Rosengart, a veteran entertainment litigator who was in attendance at Wednesday's hearing, to be her new counsel.Attorney for her father says he's not stepping downSpears initially asked for the courtroom to be cleared before she changed her mind and spoke for about 20 minutes. In the series of new bombshell allegations, Spears called the conservatorship "f-----g cruelty," describing severe limitations she is living under, like not being able to have a cup of coffee."If this isn't abuse, I don't know what is," the singer said. "I thought they were trying to kill me."Spears told the court she was not willing to be evaluated to remove her father from the conservatorship, saying she has "serious abandonment issues." Her father, Jamie Spears, remains co-conservator of her estate, while Jodi Montgomery is conservator of Spears' person.Speaking publicly on the singer's behalf for the first time, Rosengart urged Jamie Spears to voluntarily step down conservator."It is in best interest of the conservatee," Rosengart, a former federal prosecutor and veteran entertainment litigator, said outside court. "We will be moving promptly and aggressively for his removal. The question remains, why is he involved? He should step down voluntarily because that's what's in the best interest of the conservatee."Vivian Thoreen, an attorney for Jamie Spears, said in court he would not resign.Rosengart praised the pop star's "courage, passion, and humanity" in speaking out, calling her testimony "clear, lucid, powerful and compelling."He said he plans to take a deeper look into what has transpired under the conservatorship."My firm and I will be taking a top to bottom look at what's happened over the past decade," Rosengart said.Other key figures have distanced themselvesSince her testimony last month where Spears said she has felt forced to perform, take medication and use birth control against her will, many of the key figures who managed her affairs under the complex conservatorship setup have distanced themselves. In addition to Ingham and Bessemer Trust, her longtime manager, Larry Rudolph, also resigned, citing Spears' desire to retire.Spears' mother, Lynne Spears, and the American Civil Liberties Union filed court briefs in support of her desire to select her own lawyer.Other petitions in the case, including a request by Montgomery for additional security support, were continued.Interest in Spears' legal battle has grown since the February release of the documentary "Framing Britney Spears," which explores the singer's career and conservatorship.Spears' fight has drawn widespread support from other artists, including Madonna, Mariah Carey and Christina Aguilera.Fans have launched the free Britney movement, which has included a bipartisan effort from lawmakers. Sen. Elizabeth Warren, a Democrat from Massachusetts, and Sen. Ted Cruz, a Republican from Texas, have expressed...

Britney Spears' father has asked the court overseeing his daughter's conservatorship to investigate her statements to a judge last week on the court's control of her medical treatment and personal life, which she called overly restrictive and abusive.James Spears emphasized in a pair of documents filed that he has had no power over his daughter's personal affairs for nearly two years. His filing says the court must investigate "serious allegations regarding forced labor, forced medical treatment and therapy, improper medical care, and limitations on personal rights.""Given the nature of the allegations and claims, it is critical that that the court confirm whether or not Ms. Spears' testimony was accurate in order to determine what corrective actions, if any, need to be taken," the documents said. The filings come a week after Britney Spears spoke for the first time in open court in the conservatorship that has controlled her life and money for 13 years. She condemned those with power over her, saying she has been forced to perform live shows, compelled to use an intrauterine device for birth control, made to take lithium and other medications against her will, and prevented from getting married or having another child."I truly believe this conservatorship is abusive," Spears said.James Spears controlled his daughter's personal life for most of the existence of the conservatorship, but he now oversees only her money and business dealings along with an estate-management firm. A court-appointed professional, Jodi Montgomery, has had power over Britney Spears' personal decisions since her father relinquished that role, known as conservator of the person, in 2019."Mr. Spears is not the conservator of the person. He has not been the conservator of the person since September 2019," one of the court filings says. "Ms. Montgomery has been fully in charge of Ms. Spears day-to-day personal care and medical treatment."Montgomery, whose appointment Britney Spears supported, is serving temporarily. The court was expected to make her role permanent, but one of James Spears' filings says his daughter's criticism of Montgomery last week suggests that she doesn't want her in the role.James Spears says that when he was conservator over his daughter's personal decisions, he did everything in his power to support her well-being, including consenting to her getting married in 2012 and sharing conservatorship duties with her fiance. Spears was engaged to former manager Jason Trawick in 2012, but the couple broke it off in 2013.Montgomery's attorney Lauriann Wright said in a statement in response that "conservatorships in California are subject to the strictest laws in the nation to protect against any potential abuses," and that Montgomery is "a licensed private professional fiduciary who, unlike family members who serve as conservators, is required to follow a Code of Ethics."Wright said Britney Spears' right to marry or have more children are not affected by the conservatorship, and that Montgomery has had no say in those matters since she took on the job."I can state unequivocally that Jodi Montgomery has been a tireless advocate for Britney and for her well-being," Wright said, adding that "it is her sincere personal wish that Britney continues to make meaningful progress in her well-being so that her conservatorship of the person can be terminated."Montgomery is creating a care plan with that end in mind, the statement said.James Spears' filing is also critical of Britney Spears' personal attorney Samuel L. Ingham III, saying that he wrongly asserted in a recent filing that the court had found Spears did not have capacity to consent to medical treatment and is using that as a pretext for a court order taking away her right to give informed consent. An email sent to Ingham seeking comment was not immediately returned. While Britney Spears was critical of both Montgomery and Ingham in her impassioned speech of more than 20 mi...
What a celebrity case can teach us about conservatorships! This week Bob interviews celebrity lawyer Christopher Melcher about the controversial conservatorship of Britney Spears. Millions of fans worldwide have called for the end of the control of the megastar's life. Many say she is perfectly able to manage her own life. What does this case teach us? What does it mean for you?Key Points:What is a conservatorship?A conservatorship is granted by a court for individuals who are unable to make their own decisions.Usually, they are granted in the case of those suffering with dementia or other mental illnesses. "High functioning," folks usually do NOT have conservatorships.Britney’s conservatorship is split into two parts – one is for her estate and financial affairs, the other is for her as a person.Under this legal agreement, the singer has not controlled her finances since 2008.Her finances must be documented with the court. In short, the arrangement means that Britney is not in control of large parts of her life, particularly her financial affairs - but also in many of her personal choices. Can Someone Else Control YOUR Life? Is That Even Legal?
Isn't it funny how we see certain professions as more empathetic than others?
