NORML (National Organization for the Reform of Marijuana Laws) deputy director Paul Armentano joins PanAm Post English editor David Unsworth for a discussion of Jeff Sessions recent repeal of the Cole Memo, which prohibited the Justice Department from using federal resources to prosecute the production or consumption of marijuana in states that have legalized marijuana. Armentano sees an immediate backlash for the Trump administration, and suggests that Republicans will target state marijuana laws at their own peril. Ultimately, he holds out hope for a bipartisan approach to ending federal marijuana prohibition, noting that polls consistently reveal that voters in both parties are no longer enthusiastic about treating marijuana as a criminal justice matter. Several bills are currently working their way through Congress that seek to end classification of marijuana as a Schedule I drug, and treat marijuana as a public health, not a criminal justice matter. Ultimately, the principles of self-ownership and non-aggression are key to changing the philosophical mentality of politicians on both the left and the right that seek to regulate the behavior of adults in the privacy of their own homes. Americans should be free to make their own decisions for their own lives as long as they do not violate the Constitutional or human rights of others.

Former Deputy Attorney General of the United States and author of the Cole Memo’s James M. Cole returns to discuss the rescission of the Cole Memos and the Ogden Memo before it. We discuss the thought process behind creating each of the three memos, his first in 2011, the second in 2013 and the final memo released in concert with FinCen guidance on Valentine’s Day 2014. Now that the memos have been rescinded the state of legal cannabis is dictated by the Rohrabacher Blumenaur Amendment for medical cannabis. For adult-use cannabis, it’s now up to US attorneys stationed where adult-use cannabis has been passed. Central California which includes Los Angeles and San Diego and Northern California which includes the Bay Area both have new Attorney’s which have been appointed by AG Sessions.

This week, Attorney General Jeff Sessions repealed the Cole Memo, which had previously directed the Justice Department not to use federal resources to target states that had passed recreational or medicinal marijuana legislation. On the campaign trail, Trump pledged to continue the policy of the Obama administration on the issue, and expressed hesitance to interfere with the states that have passed individual legislation that contradicts federal marijuana prohibition. Now, a bipartisan backlash has some commentators suggesting that a federal law legalizing marijuana may be at hand. And there is hope: House Resolution 1227, the Ending Federal Marijuana Prohibition Act, would remove marijuana as a Schedule I drug, and end federal prosecution in states that have legalized marijuana. It appears that a new libertarian sentiment, in both parties, is going to provide plenty of pushback for Attorney General Sessions.

A lifelong regional banker, Mac Jones joins us and notes that the banking industry is a completely different animal than it was just a short time ago. He shares that two things have happened in tandem- there has been an increase in regulations on banks while bankers have come to have less of a relationship with depositors and merchants. All the while, there’s no longer true accountability in the industry. That said, Mac’s always kept that relationship with the merchant and so when legal cannabis arrived in Colorado, with an understanding of the Cole Memo’s, Mac saw no difference in cannabis merchants and provided traditional banking relationships in the industry- providing structural support for the industry. The congressman joins us and shares Colorado’s cannabis legalization results- crime is down, businesses have grown, there’s a better banking landscape and revenue to the state has been strong. The congressman has introduced The Marijuana Business Access To Banking Act which says that if a State has a regulatory structure in place, the businesses within that State would be exempt from the very restrictive federal banking laws. This of course would put into law the FinCen guidance released in tandem with the third Cole Memo. Remember- it was the Ogden memo in 2009, the first cole memo in 2011, the second cole memo in 2013 and that third cole memo in 2014. The congressman says that momentum is building for true federal legislation.

The party was hosted at the Mad Art Gallery (http://www.madart.com/), an old police station turned into a picturesque joint with plenty of photo opportunities. More than 100 people attended the event  including 420 POW (https://www.facebook.com/POW420) creator Adela Falk, who has created and maintains a state-by-state list of all inmates currently locked up for cannabis (https://docs.google.com/spreadsheet/pub?key=0Aow-cJlOJUTNdFpDYWpYeS1nSXZZeEFjZ3Rtc2ZqU3c&gid=1). Falk encourages everyone to write to these inmates and brought greeting cards for the Repeal Day party attendees to sign. She believes no one deserves jail time over a plant. Native Americans can now grow and sell cannabis The Department of Justice is now allowing Native American tribes to grow and sell cannabis on their sovereign land, as long as they abide the federal guidelines laid out in the "Cole Memo."  (http://www.justice.gov/iso/opa/resources/3052013829132756857467.pdf) This information was released in a memo published yesterday (http://www.justice.gov/sites/default/files/tribal/pages/attachments/2014/12/11/policystatementregardingmarijuanaissuesinindiancountry2.pdf), although the memo was dated "Oct. 28, 2014." In short, there are eight triggers for federal law enforcement involvement: I. Distribution to minors II. Revenue for criminal enterprise III. Transferring cannabis from legal to illegal states IV. Selling substances other than cannabis V. Violent crime related to cultivation or distribution VI. Drugged driving VII. Growing cannabis on public lands VIII. Possession or use of cannabis on federal property Of course, these aren't the only reasons for cannabis-related investigations conducted by federal law enforcement. How does the Omnibus Spending Bill affect cannabis? Laurien and Spencer also discuss what the Omnibus Spending Bill means for cannabis. This fiscal year, the bill plans for $1.1 trillion dollars in spending. Let's refresh ourselves on some American government terminology, shall we? Omnibus spending bill — a type of bill in the United States that encompasses many smaller appropriations bills into on single, large bill that can be passed with only one vote in each house. Appropriations bill — a legislative motion authorizing the government to spend money. This bill sets aside money for specific spending during the federal fiscal year, which runs from Oct. 1 to Sept. 30 of the following year.
