In this episode of the NASP Podcast, Sheila Arquette, President & CEO of NASP, speaks with Jeffrey S. Baird, Esq., Chairman of the Health Care Group at Brown & Fortunato, P.C. and Bradley W. Howard, shareholder and director at Brown & Fortunato, P.C. In today's environment, it is challenging enough to profitably run a specialty pharmacy. The pharmacy needs to avoid the additional challenge of inquiries, audits and investigations by governmental agencies and PBMs. This podcast will discuss the proactive steps the specialty pharmacy can take to lower the risk of inquiries, audits and investigations. This podcast will also set out steps the pharmacy can take to resolve inquiries, audits and investigations before they spin out of control. The podcast will focus on the following: • Corporate Compliance Program – The specialty pharmacy needs to implement a robust compliance program that is specific to the pharmacy's business model. Such a program will head off many problems before they arise…and a compliance program will resolve problems, once arisen, before they spin out of control. • PBMs – A PBM is in a stronger negotiating position than that of the specialty pharmacy. At the end of the day, the PBM “possesses the pharmacy's money.” This podcast will discuss the steps the pharmacy should take to establish a “win-win” relationship with a PBM. Doing so will eliminate uncertainty and prevent many problems from arising. However, if the PBM ends up bringing an inquiry, audit or investigation against the pharmacy, the podcast will set out the steps the pharmacy should take to resolve the inquiry, audit or investigation without it devolving into an adversarial action. • Governmental Agencies – There are a number of federal and state governmental agencies that a specialty pharmacy may have to deal with. These include (i) the Department of Justice, (ii) the Office of Inspector General, (iii) the DEA, (iv) the FDA, (v) state Attorneys General, and (vi) State Boards of Pharmacy. This podcast will discuss the steps the pharmacy should take when it is investigated by a governmental agency. As with working with PBMs, the pharmacy should strive to resolve a government investigation before it spins out of control.

During this episode of the NASP Podcast, Sheila Arquette, President & CEO of NASP, speaks with Jeffrey S. Baird, JD, Chairman of the Health Care Group at Brown & Fortunato. Health care providers, including pharmacies, must play by a set of rules that non-health  care providers do not have to follow. A principal reason for this is that a large portion of payments to providers comes from government programs (Medicare, Medicaid, TRICARE, etc.). Because tax dollars are involved, pharmacies must comply with an array of  federal and state fraud laws. These laws come into play when pharmacies work with referral sources such as physicians, hospitals, home health agencies and labs. Sheila and Jeffery discuss important federal laws such as the anti-kickback statute, physician  self-referral statute (“Stark”), beneficiary inducement statute, and False Claims Act. They also discuss examples of similar state laws, types of arrangements pharmacies can legally enter into with referral sources…and the types of arrangements that should  be avoided.

Save Sharon Hospital was originally formed during the summer of 2018 when we found out that Sharon Hospital planned to close Maternity services in less than a month. We were outraged by the decision to remove this vital service from our community and upset by the lack of communication from Sharon Hospital. We hosted a rally to Save Sharon Hospital on the Sharon Town Green, with several speakers including local CT and NY selectmen, the CT State Representative, and concerned members of the community (including two women whose lives were saved because they had access to emergent obstetric surgery within a few minutes of their homes in Millerton, NY and Kent, CT). We also sent hundreds of signed letters from our community to state officials, asking them to ensure Labor and Delivery stayed open. Our hard work paid off, and Sharon Hospital announced that it would keep Labor and Delivery open indefinitely!  Later that year, HealthQuest (the NY-based company that previously owned Sharon Hospital) and Western Connecticut Health Network (WCHN), applied to the Connecticut Office of Health Strategy (OHS) to merge their two organizations. At the public hearing for this merger, several members of our community shared testimony about the importance of maintaining Sharon Hospital as a full-service hospital. We also discussed our disappointment in the lack of communication from HealthQuest to the community and our hopes that after the merger the new ownership could do better. OHS made the decision that HealthQuest and WCHN could merge (eventually becoming Nuvance Health), and took our public testimony to heart – OHS required that Sharon Hospital maintain all services including Maternity for the next five years (see Certificate of Need 18-32238-CON), and that the new managers of Sharon Hospital be more open with its communication. Then in 2020, in the face of the global pandemic, Save Sharon Hospital organized the community to support Sharon Hospital. When masks were scarce but necessary for all (especially our healthcare workers!), we started a large community mask-making operation and donated hundreds of homemade facemasks to Sharon Hospital. We organized a meal train to support staff with delicious food from local restaurants, and we organized the delivery of artwork from local grade schools, in an effort to thank all hospital staff for their hard work and dedication. Fast forward to September 2021, and once again Nuvance announced plans to close Maternity, this time in 8-12 months. However, they have yet to obtain approval from OHS, and its five-year commitment is not up until April 1, 2024. Rather than closing down our vital services, Nuvance should be using the remaining time in its five-year commitment to find sustainable solutions to maintain our hospital as a full-service operation. Since Nuvance's September 2021 announcement, we have formed a non-profit 501(c)(3) organization, Save Sharon Hospital, Inc, and hired an experienced healthcare attorney, Paul Knag from Murtha Cullina LLP - one of Connecticut's major law firms. Mr. Knag is co-chair of Murtha Cullina's Health Care Group and the past president of the Connecticut Health Lawyers Association. He is already helping us plan our legal strategy and communications with OHS, and is responding to the legal filings in connection with the ongoing CON process. In response to the letters from Save Sharon Hospital and the medical community, on February 3, 2022, OHS opened an official investigation into Nuvance's compliance at Sharon Hospital with the initial agreement made in April 2019, citing: “Information received from the community and Hospital suggests that key discrepancies persist concerning the Hospital's compliance…” and that OHS “shall have the power to administer oaths and take testimony related to the matter of the investigation.” Once again, Sharon Hospital administration is breaking its promises to our community, and we cannot let them make their proposed changes to our hospital. What’s it like working for President Trump after working for President Obama? Former White House policy advisor Maya Uppaluru speaks to the energy of both white houses, the initiatives that persist despite the new President, and what it’s like to be a working mom in these roles… Maya Uppaluru was a policy advisor in both the President Obama White House and President Trump White House.  Maya joined the White House in 2015, in the Office of Science and Technology Policy, launching the Precision Medicine Initiative and serving as a policy advisor to the U.S. Chief Technology Officer, where she helped to shape national policies around health data interoperability and led public-private collaborations to facilitate better access to health data for medical research. She is now an associate in Crowell & Moring’s Washington, D.C. office with the Digital Health Practice and Health Care Group and provides strategic, legal, and regulatory advice to a range of organizations at the forefront of health innovation, including providers, plans, large tech companies, startups, and venture capital. Maya has a track record of helping technologists successfully navigate complex regulations to achieve their design and product goals. Most recently, she was on the healthcare team at the United States Digital Service, which aims to improve the way government delivers services to the American people through better technology and user-centered design. Mayaworked directly with engineers, data scientists, designers, and product managers on the launch of the All of Us Research Program at the National Institutes of Health. She also worked with the Centers for Medicare and Medicaid Services to improve data sharing with physicians participating in the Quality Payment Program, and transition Medicare from fee for service to value-based care under the Medicare Access and CHIP Reauthorization Act. Previously, Maya served as a policy advisor at the Office of the National Coordinator for Health IT, where she drafted regulations pertaining to patient access to health data and application programming interfaces and created the first program to link health IT policymakers directly with digital health startups and the venture capital community. Maya also served as an attorney advisor for the Healthcare Connect Fund at the Federal Communications Commission, working to expand access to broadband for rural health care providers to gain access to technology, including telemedicine and electronic health records.
