On February 19 of this year, President Donald Trump issued one of his first executive orders, Commencing the Reduction of the Federal Bureaucracy, leaving no doubt his aim to reduce its size and scope. As DOGE got to work firing federal workers—and cutting entire agencies, the president also fired heads of agencies—Democratic and Republican—cleaning house of leadership not deemed on side. As EO whiplash continues, so does pushback, with many in the public learning about the people behind the cost-cutting and loyalty tests—the federal workers and government agencies helping to make American life run smoothly and safely. What are the legal questions?Joining this episode is Anne Joseph O'Connell, a leading scholar of U.S. administrative law and the federal bureaucracy. She was a presidentially appointed member of the Council of the Administrative Conference of the United States, an independent federal agency dedicated to improving regulatory procedures, from October 2022 to January 2025. She combines a lawyer's doctrinal acumen and institutional sensibilities with a political scientist's deep understanding of American politics and political theory and an empiricist's rigor about facts in the world. Her scholarship explains how government really works. Simplified is not confident customers are willing to pay much more for its products, so when President Donald Trump put tariffs on China, it went to court to object. Emily Ley Paper, Inc., argues that the IEEPA does not authorize the president to impose tariffs. Now a Florida judge who understands the limitations of jurisdiction, T. Kent Wetherell II, has agreed to move the case to the CIT. In the process of doing so, he also answered a key question that has national implications. Does the IEEPA allow the president to impose tariffs? Wetherell says yes. “IEEPA grants the President broad economic powers to deal with ‘any unusual and extraordinary [foreign] threat … to the national security, foreign policy, or economy of the United States' on which a national emergency has been declared.” Wetherell spells out the historical legal cases in his order, which lead him to say, “IEEPA is a ‘law … providing for … tariffs.'” Source: thefederalist.com nowhere! This podcast will also set out steps the pharmacy can take to resolve inquiries, audits and investigations before they spin out of control. The podcast will focus on the following: • Corporate Compliance Program – The specialty pharmacy needs to implement a robust compliance program that is specific to the pharmacy's business model. Such a program will head off many problems before they arise…and a compliance program will resolve problems, once arisen, before they spin out of control. • PBMs – A PBM is in a stronger negotiating position than that of the specialty pharmacy. At the end of the day, the PBM “possesses the pharmacy's money.” This podcast will discuss the steps the pharmacy should take to establish a “win-win” relationship with a PBM. Doing so will eliminate uncertainty and prevent many problems from arising. However, if the PBM ends up bringing an inquiry, audit or investigation against the pharmacy, the podcast will set out the steps the pharmacy should take to resolve the inquiry, audit or investigation without it devolving into an adversarial action. • Governmental Agencies – There are a number of federal and state governmental agencies that a specialty pharmacy may have to deal with. These include (i) the Department of Justice, (ii) the Office of Inspector General, (iii) the DEA, (iv) the FDA, (v) state Attorneys General, and (vi) State Boards of Pharmacy. This podcast will discuss the steps the pharmacy should take when it is investigated by a governmental agency. As with working with PBMs, the pharmacy should strive to resolve a government investigation before it spins out of control.

A new standard for Government agencies handling data will be set after today's bombshell report. The Public Service Commission has released a report detailing failures by Stats NZ, Health NZ and the Ministry of Health. It's after allegations surfaced in June that Census and Covid vaccination data was inappropriately used at Manurewa Marae. It's highlighted a lack of safeguards - even when concerns were raised within Stats NZ, whose acting head is now stepping down. It found agencies also failed to address conflicts-of-interest by providers working with Covid data. Commissioner Sir Brian Roche says contracting requirements for third-parties will change. The Prime Minister's open to axing entire Government agencies, saying there's probably too many. Public Service Commissioner Sir Brian Roche says he's considering the idea of cutting whole departments and bringing others together. Christopher Luxon told Mike Hosking he wants more efficiency in the public sector and is open to departments being scrapped. He says there are many small agencies that lack scale, and they need to be better focused on core business. Luxon also says New Zealand needs to do more to keep on top of illegal immigration. Associate Immigration Minister Chris Penk is considering the case of Kiwi born 18-year-old Damen Kumar. Kumar's parents have been living as overstayers for 24 years. Luxon says he can't comment on the individual case, but he told Hosking people need to follow the immigration process. He says illegal immigration is unfair for people who have followed the rules.
