A manual is a booklet that's written to help us understand how something works. In the coaching world, however, "the manual" refers to an unspoken set of beliefs and expectations that we set for the people in our lives. Because it's unspoken, the other person doesn't even know it exists... and, to be honest, you may not even realize it exists until you shed some light on it. Once we see it, it's easier to understand how this set of expectations and beliefs can negatively affect us. It can also give us some helpful insight into what we need to do to improve the quality of our relationships. Regardless of political leanings, there's a renewed and essential focus on local governing by school boards, commissioners courts and city councils. To understand the responsibilities, and the urgent need for the preparation of locally elected representatives, as well as the professional administrators and lawyers who work for them, and the public, it is important to know the duties and requirements of their positions. At the state level, there has been a lack of understanding of what the Texas Education Agency is supposed to do, and be prepared to do, under law in serving, not dictating to school districts. At the local level, there's a lack of understanding of what elected school boards are responsible to do under their district's own policies for planning and action to serve the needs of all schoolchildren, for the children's sake.Steve Swanson is a retired business executive and education researcher. He has volunteered in education for thirty years, including Austin, at the state, and in school districts throughout Texas. Steve's experience with, and research on, Johnston/Eastside Memorial HS revealed that students, teachers, and schools are not THE problem. This experience and research revealed the critical and urgent opportunity for improvement exists above the schools, at the district and state levels. Opportunities in the promises made in ISD policies and Texas laws for local governing of community planning and action serving the needs of all students, for the students' sake. Steve and Lynn Davenport met at a hearing in Austin at the Texas Education Agency in 2016. We don't need to reinvent or recreate new policies when we already have the tools we need to serve the needs of kids, we don't read the instructions! The important “instructional manuals” that exist in Texas with the Texas Education Code, the Texas Lawyer's Creed, and the Educator's Code of Ethics are in place for just these reasons.For example, Richardson ISD created a redundant Equity Policy which was already in existence under BQ Local to be applied to all students. That policy has been ignored for decades. Much like the TEA and the legislators, our school boards are not prepared in, and don't follow, existing policies, yet they continue to create new ones. Swanson would like to inform and help empower parents, students, teachers, business leaders, voters, as well as boards and superintendents through a learning process to read and understand Texas' governance responsibilities for serving the needs of ALL students, for the students' sake, including special needs and suicide prevention. Taking the first steps in a Construction Injury CastUnderstanding all of the parties involved is the best way to begin approaching a construction injury case. Establish the relationship that the worker has with the job site. Who is the general contractor? Is there a worker's comp or insurance agreement?Example Quote: “It's so important to get started on these cases right away,” says Christina.Common Types of Cases/Injuries in construction.Both construction workers and bystanders are often injured. Accidents involving falls are very common, but also falling debris, forklifts, and other heavy vehicles are often involved in injuries on construction sites.Example Quote: “Construction Sites are—by their nature—dangerous places,” says Burgess, “Things can go wrong, and they can go wrong quickly.”Helpful Regulations and Guides to Reference“The first place you want to go to are the OSHA regulations,” says Burgess. Looking at OSHA regulations and ANSI Standards is the first place to start. Keeping in mind that when an accident is reported to OSHA, they will send a representative to investigate at the site of the incident.“Instruction Manuals & Trade Journals are also great resources,” adds Jack. “You want it to be very simple—who was in the best position to prevent the harm and who had the power to do so.”Frequency of Construction InjuriesConstruction Injuries are very common, and whether or not you have a viable case will depend state to state.“Typically if your client is working and has worker's compensation then they have no recourse against the company” says Burgess. “Find our if there were any third parties onsite.”There is always the possibility of a product malfunction being the cause of the injury.“Unfortunately, a lot of our clients are undocumented workers,” says Jack “and they're really taken advantage of. A lot of them are terrified to even contact an attorney initially.”Most common types of construction site injuries“They're almost always going to be catastrophic,” says Christine. “You're almost always going to have a severe brain injury or some type of spinal injury.” “Helmets are meant to protect against small debris, not catastrophic impact,” adds Jack.Injuries are typically very severe in nature, most often causing permanent harm to the victim.Outlining a discovery plan“If you are not the type of law firm that likes to litigate then I would stay far away from construction cases,” says Jack. Make a list of all the parties involved in the construction site. Then get contractual information to establish the relationships of each party. Then comes the deposition phase, be prepared to take a lot of depositions in these types of cases.“Get as much information as possible at the initial client meeting,” says Christine. “Checking 911 calls can be helpful” says Jack.Key takeaways: Approach the case by creating a “snapshot” of the construction site Create detailed documentation showing all of the parties involved OSHA & ANSI Regulations are key resources when understanding fault Many victims are undocumented workers Workers comp typically bars you from being able to proceed with the case These are tough, expensive cases.
