Just a few days remain in October, so this is our Halloween episode and the end of monster month for another year! We had so many great suggestions for Halloween episodes that I couldn't get to them all, but I might just sprinkle some in throughout the other months too. We have two great monsters to talk about this week, suggested by Ezra and Leo, the kraken and Chessie the sea serpent. First, as always on our Halloween episode, we have a few housekeeping details. I also don't have any new books out this year, but you can still buy the Beyond Bigfoot & Nessie book if you like. I am actually working on another book about mystery animals, tentatively titled Small Mysteries since it's going to be all about mysteries surrounding small animals like frogs and invertebrates that often get overlooked. I'm hoping to have it ready to publish in early 2026 or so. I don't know that I'll do another Kickstarter for it since that was a lot of work, and I just finished a Kickstarter for more enamel pins and just can't even think about the stress of doing another crowdfunding campaign anytime soon. Also, I hate to keep asking listeners for money. Anyway, one of the things I don't like about Beyond Bigfoot & Nessie is that I didn't cite my sources properly, so for the Small Mysteries book I'm being very careful to have footnotes on pretty much every page so that anyone who wants to double-check my information can do so easily. But all that is in the future. Let's celebrate Halloween now with a couple of sea monsters! We'll start with Ezra's suggestion, the kraken. It's a creature of folklore that has gotten confused with lots of other folklore monsters. We don't know how old the original legend is, but the first mention of it in writing dates to 1700, when an Italian writer published a book about his travels to Scandinavia. One of the things he mentions is a giant fish with lots of horns and arms, which he called the “sciu-crak.” This seems to come from the Norwegian word meaning sea krake. “Krake” is related to the English word crooked, and it can refer to an old dead tree with crooked branches, or tree roots, or something with a hook on the end like a boat hook, or an anchor or drag, or various similar things related to hooks or multiple prongs. That has led to people naturally assuming that the kraken had many arms and was probably a giant squid, and that may be the case. But there's another possibility, because in many old uses of the word krake, it means something weak or misshapen, like a rotten old dead tree. In the olden days in Norway, people thought that if you spoke about an animal by name, the spirit that protected that animal would hear you. Some historians think that whale-hunters referred to whales as krake so the whale's protective spirit wouldn't guess that they were planning a whale-hunt. Who would refer to a huge, strong animal like a whale as weak and crooked, after all? Whatever its origins, the kraken's modern form is mainly due to a Danish bishop called Erik Pontoppidan. He wrote about the kraken in 1753, and embellished the story by saying the kraken could reach out of the ocean with its long arms to grab sailors or just pull an entire ship down into the water and sink it.

Historically Thinking: Conversations about historical knowledge and how we achieve it

In 1978, along the shoreline of the Potomac River in Westmoreland County, Virginia, people began to see…something…out in the water. Whatever it was, it seemed snakelike. But then all such sightings ended–until, over a period of years in the early 1980s, sightings proliferated around Kent Island, situated in the very middle of the Chesapeake, the eastern end of the Chesapeake Bay Bridge. The “monster” was soon named “Chessie”, and perhaps because of the cute name was characterized as being a friendly monster; and while no biological traces of it were ever discovered, “Chessie” became an icon of the environmental movement to save the bay.  But what was the context for Chessie's sightings?  What might suburbanization and taking recreation as seriously as labor have to do with seeing monsters in the water? And why did so many (including, as best as I can remember, myself) need to believe that Chessie was real?  With me to discuss Chessie, and her life and times is Eric Cheezum, an independent historian, a resident of Maryland's eastern shore, and the author of Chessie: A Cultural History of the Chesapeake Bay Sea Monster, which is–not surprisingly–the subject of our conversation today. Administration Fails Forward on China Chip Exports

This episode of the Cyberlaw Podcast begins with the administration's aggressive new rules on chip exports to China. Practically every aspect of the rules announced just eight months ago was sharply tightened, Nate Jones reports. The changes are so severe, I suggest, that they make the original rules look like a failure that had to be overhauled to work. Much the same could be said about the Biden administration's plan for an executive order on AI regulation that Chessie Lockhart thinks will  focus on government purchases. As a symbolic expression of best AI practice, procurement focused rules make symbolic sense. But given the current government market for AI, it's hard to see them having much bite. If it's bite you want, Nate says, the EU has sketched out what appears to be version 3.0 of its AI Act. It doesn't look all that much like Versions 1.0 or 2.0, but it's sure to take the world by storm, fans of the Brussels Effect tell us. I note that the new version includes plans for fee-driven enforcement and suggest that the scope of the rules is already being tailored to ensure fee revenue from popular but not especially risky AI models. Jane Bambauer offers a kind review of  Marc Andreessen's “‘Techno-Optimist Manifesto”.  We end up agreeing more than we disagree with Marc's arguments, if not his bombast. I attribute his style to a lesson I once learned from mountaineering. Chessie discusses the Achilles heel of the growing state movement to require that registered data brokers delete personal data on request. It turns out that a lot of the data brokers, just aren't registering. The Supreme Court, moving with surprising speed at the Solicitor General's behest, has granted cert and a stay  in the jawboning case, brought by Missouri among other states to stop federal agencies from leaning on social media to suppress speech the federal government disagrees with. I note that the SG's desperation to win this case has led it to make surprisingly creative arguments, leading to yet another Cybertoonz explainer. Social media's loss of public esteem may be showing up in judicial decisions. Jane reports on a California decision allowing a lawsuit that seeks to sue kids' social media on a negligence theory for marketing an addictive product. I'm happier than Jane to see that the bloom is off the section 230 rose, but we agree that suing companies for making their product's too attractive may run into a few pitfalls on the way to judgment. I offer listeners who don't remember the Reagan administration a short history of the California judge who wrote the opinion. And speaking of tort liability for tech products, Chessie tells us that Chinny Sharma, another Cyberlaw podcast stalwart, has an article in Lawfare confessing some fondness for products liability (as opposed to negligence) lawsuits over cybersecurity failures.  Chessie also breaks down a Colorado Supreme Court decision approving a keyword search for an arson-murder suspect. Although played as a win for keyword searches in the press, it's actually a loss. The search results were deemed admissible only because the good faith exception excused what the court considered a lack of probable cause. I award EFF the “sore winner” award for its whiny screed complaining that, while it agree with EFF on the principle, the court didn't also free the scumbags who burned five people to death. Finally,  Nate and I explain why the Cybersecurity and Infrastructure Security Agency won't be getting the small-ball cyber bills through Congress that used to be routine. CISA overplayed its hand in the misinformation wars over the  2020 election, going so far as to consider curbs on “malinformation” – information that is true but inconvenient for the government. This has led a lot of conservatives to look for reasons to cut CISA's budget.
