E69 The Fifth Court with Mark Tottenham BL and Peter Leonard BLLiam Herrick, Executive Director of the Irish Council of Civil Liberties talks about the so-called 'Hate Speech' legislation and how difficult it can be to prosecute and enforce such laws. It's a very timely interview about some of the many complexities that could arise from such legislation, but also about the reasons that the legislation may be needed in the first place.Liam also discusses his three years working as general adviser to Uachtarán na hÉireann, Michael D Higgins. Fascinatingly he asserts that the media and others are incorrect when they query whether the President's 'words' have been cleared by the Government. He says that such permission is simply not necessary and may be 'imagined by the commentariat'. He calls it an 'incredible misconception'. He also talks about when the President visited the UK.And, as usual, our interlocutors discuss three recent cases drawn from the Decisis casebook including;+ A challenge to a planning permission given to a windfarm. Judge Egan decided that the windfarm was too noisy.+ A 'delay' case where little or nothing had proceeded in this case since 2009 but was in front of the courts again in 2023.+ A case where a family in a 'Witness Protection Programme' were seeking new marriage certificates and birth certificates to confirm the family's new identity. However, it seems it's not that straightforward to get a new identity, and legislation may be needed. As always, essential listening for practitioners, students and the curious public. With thanks to Clio Legal Software Hosted on Acast. Today's episode features Executive Director of the Irish Council for Civil Liberties, Liam Herrick. Liam and Sarah discuss the history of the ICCL and its place in the development of human rights and social justice, not only in Ireland, but globally. They look at the ‘Enforce' unit within the ICCL which aims to challenge the ‘tech threat' posed to democracy and human rights. Liam Herrick is the Executive Director of the Irish Council for Civil Liberties. Liam was appointed in November 2016. Prior to his appointment, he was the Advisor to President Michael D. Higgins. Liam was Executive Director of the Irish Penal Reform Trust (IPRT) between 2007 and 2014. He has also worked as the first Head of Legislation and Policy at the former Irish Human Rights Commission, with the Law Reform Commission and at the Department of Foreign Affairs. Liam is a sought-after commentator and appears regularly before parliamentary committees and in the media. Liam says “I have worked in human rights for most of the last 20 years. There has been a lot of progress in relation to equal rights and protections for members of the LGBTQ+ in Ireland. However, despite decriminalisation in 1993, and the passage of Marriage Equality in 2015, there is still much to do. In addition to requiring effective hate speech legislation, the defence of provocation does allow a person accused of murder to claim that a romantic or sexual advance by an LGBTQ+ person resulted in a loss of control leading to the killing of that person. In this episode, we explore cases where this partial defence was employed at trial and appeal: the killing of John Roche in 1982, the murder of Gerard Hackett in 2002, and the kidnap and murder of Matthew Shepard in Wyoming in 1998. The ICCL has found another horrible, civil liberty limiting bill to fully support; the government brings in antigen testing, in the most cack-handed fashion imaginable; and maybe the real solution to online misinformation is simply acting in a trustworthy fashion. https://www.thelancet.com/journals/lanonc/article/PIIS1470-2045(20)30388-0/fulltext
As Ireland continues to be home for many Big Tech HQ's, the responsibility for enforcing privacy laws lies with us too. This week, the Irish Council for Civil Liberties released a report that suggests Ireland is failing to enforce these laws on these companies. The report comes on the back of a recent case with WhatsApp where the Irish Data Protection Commissioner's suggested fine of 30-50 million was pushed back on by our EU counterparts in the European Data Protection Board (EDPB), which oversees the GDPR and ended up coming in at 225m. Obviously financial penalties are but a thorn in the side of big tech, and enforcement of the privacy laws with order's to bring data systems into compliance is much more pertinent. To discuss this report and to offer suggestions on what needs to happen to bring Big Tech under control is Dr Jonny Ryan, Senior Fellow at ICCL and the Open Markets Institute and co-author of the report.
Jess chats with Barbara Delaney, ComReg Retail and Consumer Services Director about scam calls and service issues. Dr Johnny Ryan of the ICCL explains 'consent spam'. Founders of Run Angel explain what their device does and where the idea came from. The price of an assault; the ICCL stands up civil liberties before quickly sitting down; and the Zappone situation has progressed from scandal, to farce, before ending up as a series of incredibly stupid events. https://www.independent.ie/irish-news/green-councillor-deletes-milkshake-these-racist-vermin-tweet-40810277.html
A shortage of truck drivers in the UK demonstrates that supply and demand is real, and perhaps could even influence the price of houses; the biggest story you're not hearing about is the issues the electrical grid is going to face this winter; and the ICCL's interesting views on protests are calling out in the Sunday Times. https://www.thetimes.co.uk/article/soaring-pay-puts-waitrose-lorry-drivers-on-a-par-with-lawyers-r5673lbls https://www.businesspost.ie/energy/balance-of-power-why-irelands-electricity-supply-is-threatened-and-what-can-be-done-to-bolster-it-d8fbf07a https://www.idaireland.com/newsroom/publications/ida-ireland-economic-benefits-of-data-centre-inves
The ICCL now thinks political databases are bad; the Journal fact-checks a claim from Aontu and you'll be shocked to learn how that worked out; the alcohol prohibitionists are at it again; and the perfect is the enemy of the good when building houses. https://www.thejournal.ie/abortion-factcheck-5521191-Aug2021/
Outbreaks north of the country, vaccinating the young, re-opening indoor hospitality and certification. With Dr Denis McCauley of IMO and Liam Herrick of the ICCL
Panel: Fine Gael Minister of State Colm Brophy, Sinn Féin TD Louise O'Reilly and Aontú leader Peadar Tóibín. With columnist Alison O'Connor, Dr Denis McCauley of IMO, Liam Herrick of the ICCL and Fianna Fáil TD Cathal Crowe
This week we speak to Neil, whose sister Donna was killed while she was cycling in 2016. Neil talks to us about his interactions with the Gardaí after her death, how supportive the liaison officer could be, but how difficult it was to find out key information. We also consider the inquest process and the Garda role in that. Liam Herrick of the ICCL joins us to share findings from their recent report on the coroner system. (This episode builds on our last episode with Conn, and we recommend listening to that first.) Support us at patreon.com/tortoiseshack
Simon Coveney made some interesting comments when he recently went to meet the Foreign Minister of China; the ICCL has an interesting understanding of the phrase "100% independent"; and the state is now just giving 6 figure sums of money to anyone who asks. https://web.archive.org/web/20210531133639/https://www.fmprc.gov.cn/mfa_eng/zxxx_662805/t1880004.shtml https://gript.ie/gravy-train-how-public-money-keeps-the-iccl-in-business/ https://gript.ie/over-100000-in-public-money-to-be-given-to-anonymous-far-left-group/ https://www.youtube.com/watch?v=3f20L0msLsM&list=PLD5OhzwvKKtOPs27ZJUjJ4Euw793mHgub https://www.youtube.com/watch?v=WwyuM0PODuY&list=PLD5OhzwvKKtOPs27ZJUjJ4Euw793mHgub
We were joined in this Policed - Echo Chamber crossover podcast by Liam Herrick, Executive Director of the Irish Council for Civil Liberties. We talk about the report on the Coroners' System, authored by Prof Phil Scraton and Dr Gillian McNaul, which ICCL launched last week. Vicky and Liam talk about why the coroners system matters, what families are saying about how it's failing them, and some of the key considerations within the report for reform. Then Liam looks back over the past 14 months and the extraordinary restrictions on our civil liberties due to the pandemic. In particular we look at mandatory hotel quarantine, Covid passports and the role of An Garda Siochana. Restrictions are up for review in June and it's important that any future restrictions are balanced with our constitutional rights. In this programme, looking at Ireland's Coroner's Court. The Irish Council for Civil Liberties commissioned a report 'Left Out in the Cold' looking into Ireland's system of investigating deaths. It found serious failings that compound the suffering of bereaved families I'm joined on the line by Liam Herrick, executive director of the Irish council for civil liberties to share what it found and what can be done to fix it. Today we are joined by Peace Commissioner and Experience Legal Executive, Roman Shortall, who spoke to #Liveline earlier in the week highlighting how he and his family were targeted at Dublin airport by SIU officers from An Garda Siochana and the Department of Social Protection. Roman's account has unearthed a scandal that is forcing the new government in to all sorts of twists and turns and which now encompasses ICCL, the DPC, FLAC and the opposition. The Oireachtas is the only body with the power to create legislation and yet it appears that the Department has taken it upon itself to firstly, overrule existing legislation, and secondly, create its own legislation. This looks set to end up in a High Noon showdown. Music written by Alan Maguire, performed by David O'Doherty, no really. Emergency legislation tends to become permanent, nowhere is this more evident than with the Special Criminal Court. Despite national and international human rights criticism, emergency legislation has been approved again for the 48th year in a row to keep the SCC. We are joined in the #tortoiseshack by Doireann Ansbro, Senior Research and Policy Officer with the Irish Council for Civil Liberties (ICCL) to discuss the origins, workings and deficits of the SCC. We ask why it is still in operation and has it become a political football. See iccl.ie for more Join us: patreon.com/tortoiseshack
Martin and Caroline were joined in the #TortoiseShack by Liam Herrick, Executive Director of the Irish Council for Civil Liberties. The ICCL has issued a report containing 9 Principles vital to creating a fair and transparent Contact Tracing App. We discuss the app as it is currently proposed, whether it is fit for purpose and the dangers of mission creep. We also discuss the Garda emergency powers and protesting in a time of #Covid19. See iccl.ie for more Join us: patreon.com/tortoiseshack
Our political system is busy passing the Health Preservation & Protection and other Emergency Measures in the Public Interest Bill, as we record, but what does this mean for us all? Senior Researcher and Policy Officer at the Irish Council for Civil Liberites, Doireann Ansbro, joins us to discuss what these new powers are, whether they are appropriate, time-limited and proportionate in the face of the Covid-19 pandemic. While ICCL fully accept the need for this legislation, Doireann outlines the concerns, shared by many Human Rights organisations, that such Bills can be (and are) used to limit freedoms way beyond the lifespan of the crisis that necessitated them in the first place.
