Welcome back to Through the inquisitor's lens, the podcast that explores the complex world of public inquiries and inquests, one question at a time.  In this episode, we explore whether Coroners' Prevention of Future Death (PFD) Reports are truly fit for purpose. Catherine Henney, Legal Director at Eversheds Sutherland, and David Pojur, Barrister at Lincoln House Chambers and Assistant Coroner for North Wales, discuss the statutory role of PFD reports, the training and guidance provided to coroners on when to issue them, and the frequently raised concern that PFDs lack real enforcement power, with no sanctions for those who fail to respond.  They also consider whether the approach of the new Chief Coroner signals a shift in emphasis, and whether we are likely to see greater scrutiny of PFD reports and of those who fail to engage with them.

A coroner's report says a man who drowned on Wellington's waterfront may not have, if the council's safety procedures had been better. Open Justice reports 30-year-old Sandy Calkin drowned in Wellington Harbour in 2021 after accidentally falling in after drinking on Courtney Place. Coroner Katherine Greig's report says Wellington City Council knew about identified safety risks at the waterfront but failed to act on them. The report says the risks were identified in 2013 and since then, seven people have drowned in the harbour. It also found there was no council record or investigation into any of those deaths. The victim's father, Roger Calkin, told Nick Mills the fact that his son's death could've been prevented is absolutely gutting, but it justifies everything they've been pushing for for over three years. Lola Young, Baroness Young of Hornsey, is the latest guest on Lord Speaker's Corner.In this episode, Baroness Young speaks to Lord McFall of Alcluith about her work tackling modern slavery, race and inequality in the creative sector, and why consumers should challenge companies to do better when they source materials.Baroness Young has extensive experience telling truth to power. From challenging the workplace dress code of her employer in 1971, to pushing for representation as an actor, to calling on major fashion brands to improve their practices, Baroness Young has regularly campaigned for change.‘It was to criminalise forced labour and domestic servitude and like virtually everybody else, including people in this House. I said, "Well, isn't that already a crime?" And no, it wasn't. Forced labour on these shores… in essence, that was the start of this country's towards the Modern Slavery Act, which was six years later.' In 2009, Baroness Young worked with Anti-Slavery International to put forward amendments to the Coroners and Justice Bill. She talks about the importance of that work and how it has led her to go further, working with the fashion industry to tackle issues in their supply chains and improve transparency.Discussing why consumers should hold companies to account for the products they buy, Baroness Young explains ‘some industries will have a supply chain that's metaphorically miles long… [companies] have to take responsibility for it because otherwise what happens when the people who live by a particular river in China find that they can no longer use the water from that river because it's dyed red… We again, are implicated in that practise. So we have to hold businesses to account.'‘If you think about any one of the scandals that have happened recently, you can talk about Post Office, you can talk about Windrush, you can talk about Grenfell, all of those different things. We always say, "We are never going to let this happen again." And then the next time we say, "We've learned our lesson, it's not going to happen again." And then the next time we say, "We've learned our lesson."' A coroner's inquest has heard that double murderer Paul Tainui is now used as a case study for certain types of psychopathy for Corrections staff training. Tainui raped and murdered Nicole Tuxford in Christchurch, after breaking into her home and lying in wait for her in 2018. He murdered his ex-partner Kimberley Schroder on the West Coast in 1994 in similar circumstances. A joint inquest has been held into the murder of Nicole Tuxford and the suspected suicide of Kimberley Schroder's father Gary, who died after hearing Tainui had killed again. Two young female tourists are staying in the same quiet spot in Tasmania…one disappears, never to be seen again and two years later, the other woman is brutally murdered.The women are 26-year-old German Nancy Grunwaldt, reported missing on April 15th 1993. Getting around on a bike, she was spending some time at Beaumaris Beach, reading a book. What happened after that is a mystery…so far. Nancy's never been found but she was declared deceased by the coroner in 2003. This is a "Just The Facts" episode. It's a shortened version of this week's more detailed full episode, which is also available on our feed. Two young female tourists are staying in the same quiet spot in Tasmania…one disappears, never to be seen again and two years later, the other woman is brutally murdered.The women are 26-year-old German Nancy Grunwaldt, reported missing on April 15th 1993. Getting around on a bike, she was spending some time at Beaumaris Beach, reading a book. What happened after that is a mystery…so far. Nancy's never been found but she was declared deceased by the coroner in 2003. She'd been stabbed numerous times and had been beaten. Victoria was staying in the tiny hamlet of Beaumaris with her cousin and had been there less than a week. It's hard enough for me to imagine having a missing loved one. Can you? Then picture finding out that a serial killer has been operating where and when your loved one went missing. That's the scenario we have for this week's case. Authorities may never know exactly how many victims this killer had, but a new coroner investigating the case is determined to identify as many of the known remains as he can. Our book this week is “The Double Life of a Serial Murderer” and our guest is Hamilton County, Indiana Coroner Jeff Jellison. He is a former law enforcement officer and is a certified Medical-Legal Death Investigator. Jeff has a very big job trying to determine who the bones found on Herb Baumeister's Indiana estate belong to. And as you'll hear, there were thousands of bones and bone fragments discovered on Fox Hollow Farm. Let's investigate what in the world happened in central Indiana. Then we'll dive into Matthew 7:1-5: “Do not judge and criticize and condemn others, so that you may not be judged and criticized and condemned yourselves. For just as you judge and criticize and condemn others, you will be judged and criticized and condemned, and in accordance with the measure you [use to] deal out to others, it will be dealt out again to you. Why do you stare from without at the very small particle that is in your brother's eye but do not become aware of and consider the beam of timber that is in your own eye? Or how can you say to your brother, ‘Let me get the tiny particle out of your eye', when there is the beam of timber in your own eye? You hypocrite, first get the beam of timber out of your own eye, and then you will see clearly to take the tiny particle out of your brother's eye.” This isn't a long passage, but there is so much practical wisdom here so be sure you catch this episode, then check out some earlier ones. Trevor Tascas was 27 years old when he suspiciously disappeared in October 2005 from an address in Whittington, a suburb of the regional Victorian city Geelong. His mum Pamela and sister Kirsty join us for this episode. Trevor's life was up and down and at the time of his disappearance - he was using and dealing drugs but still in sporadic contact with his family.  Investigators believe Trevor had been involved in a dispute with Lawrence Butler, the man he was sharing a house with prior to his disappearance.  In 2009 Lawrence Butler was sentenced to 23 years in jail for Trevor's murder before his conviction was quashed on appeal.  It's not the end though for Trevor's heartbroken family.  Missing Persons Squad detectives are continuing to investigate Trevor Tascas's disappearance and there's a $1M reward for information in relation to the person or people responsible for Trevor's death. Anyone with any information to contact Crime Stoppers on 1800 333 000, or file a report online at crimestoppersvic.com.auMore info:Victoria Police appeal for info on Trevor's murder Cold case: Trevor Tascas | Victoria PoliceCoroners' findings into the death of Trevor John TascasMore on Lawyer Anthony Strik can be found here: https://strik.com.au/CREDITS:Host: Meshel Laurie. This week we are running an entire series dedicated to the #DOWNBALLOT. Coroners are elected in counties in 20 states in the country. To learn more about about what a coroner does, and what is important to consider when voting for a coroner, we speak with Darnell Hartwell. He is currently chief deputy coroner of Berkeley County, South Carolina, which encompasses parts of North Charleston and its outskirts. He is also a Republican candidate for coroner of Berkeley County running unopposed in the November midterm election Interview Highlights Melissa Harris-Perry: What kind of skill set does it take to do that kind of work? Darnell Hartwell: The job of the coroner involves several different professions, we have to know some things about medical, law enforcement, legal. Again, we have extensive amount of hours and trainings that we have to have and maintain to be able to keep up with the qualifications and to be able to keep up with the changing times of things that we're seeing. Currently, right now we're seeing in Berkeley County, South Carolina, and other parts of the country as well, is the opioid pandemic. Again, we have to maintain knowledge on these changing things as well. Melissa Harris-Perry: You did have a primary campaign. What does it mean? What does it look like to campaign for coroner? Darnell Hartwell: Yes. Well, it was a busy campaign season for me. My candidate actually was in law enforcement for a number of years as well. He definitely had some of the requirements. Listening to the constituents here in Berkeley County, it was hard to beat the experience that I have. Again, working for the coroner's office for nearly 20 years, I've had the opportunity to work for three coroners and my career here with the Berkeley County Coroner's Office and my whole career was here working throughout this office. I have investigated well over 5,000 deaths. I have several thousand hours of death investigating training, law enforcement training, medical investigating training. One of my campaign stumps was experience matters. You will want your coroner to be experienced, you want to be experienced in the investigation, you want to be able to have community connections, great relationships with law enforcement agencies, doctors' offices, hospitals. Throughout my career, I was able to build great relationships with all those entities here in Berkeley County.
