E69 The Fifth Court with Mark Tottenham BL and Peter Leonard BLLiam Herrick, Executive Director of the Irish Council of Civil Liberties talks about the so-called 'Hate Speech' legislation and how difficult it can be to prosecute and enforce such laws. It's a very timely interview about some of the many complexities that could arise from such legislation, but also about the reasons that the legislation may be needed in the first place.Liam also discusses his three years working as general adviser to Uachtarán na hÉireann, Michael D Higgins. Fascinatingly he asserts that the media and others are incorrect when they query whether the President's 'words' have been cleared by the Government. He says that such permission is simply not necessary and may be 'imagined by the commentariat'. He calls it an 'incredible misconception'. He also talks about when the President visited the UK.And, as usual, our interlocutors discuss three recent cases drawn from the Decisis casebook including;+ A challenge to a planning permission given to a windfarm. Judge Egan decided that the windfarm was too noisy.+ A 'delay' case where little or nothing had proceeded in this case since 2009 but was in front of the courts again in 2023.+ A case where a family in a 'Witness Protection Programme' were seeking new marriage certificates and birth certificates to confirm the family's new identity. Today's episode features Executive Director of the Irish Council for Civil Liberties, Liam Herrick.  Liam and Sarah discuss the history of the ICCL and its place in the development of human rights and social justice, not only in Ireland, but globally.  They look at the ‘Enforce' unit within the ICCL which aims to challenge the ‘tech threat' posed to democracy and human rights.  Liam Herrick is the Executive Director of the Irish Council for Civil Liberties. Liam was appointed in November 2016. Prior to his appointment, he was the Advisor to President Michael D. Higgins. Liam was Executive Director of the Irish Penal Reform Trust (IPRT) between 2007 and 2014. He has also worked as the first Head of Legislation and Policy at the former Irish Human Rights Commission, with the Law Reform Commission and at the Department of Foreign Affairs. He is a former member of the Irish Human Rights and Equality Commission (IHREC) and the Minister for Justice and Equality's Strategic Review Group on Penal Policy. Liam is a sought-after commentator and appears regularly before parliamentary committees and in the media.   Liam says “I have worked in human rights for most of the last 20 years. I believe that fighting for human rights protections in law and in policy can make a real difference to peoples' lives and to the type of society we live in. “

The Department of Social Protection has withdrawn its appeal challenging a Data Protection Commission ruling that the Public Services Card is illegal. The DPC announced this morning that the matter has been resolved, and the Department has acknowledged that the card cannot be made a mandatory requirement for accessing public services “in the absence of legislation”. Liam Herrick was appointed to Executive Director of the Irish Council for Civil Liberties (ICCL) in November 2016. Prior to his appointment, he worked as Advisor to President Michael D. Higgins for almost three years. Liam was Executive Director of the Irish Penal Reform Trust (IPRT) between 2007 and 2014. He has also worked as the first head of legislation and policy at the former Irish Human Rights Commission and with the Law Reform Commission and the Department of Foreign Affairs. He is a member of the Irish Human Rights and Equality Commission (IHREC), a former Board member of the Children's Rights Alliance and the Minister for Justice and Equality's Strategic Review Group on Penal Policy (2012-2014).
