In our season finale for 2024, we have the immense honour of speaking with the Honourable Justice Michael Kirby AC CGM. Michael Kirby is a man who needs no introduction. He was called to the Bar in 1967, and in 1975, became the youngest man to hold a federal judicial office when he was appointed as the Deputy President of the Australian Conciliation and Arbitration Commission. Later that year he was also appointed as the inaugural Chair of the Australian Law Reform Commission. In 1983, he was appointed as a judge of the Federal Court of Australia and in 1984, became the President of the New South Wales Court of Appeal. There he served until 1996, when he was appointed as a Justice of the High Court of Australia, a position he held until his retirement from the bench in 2009. In addition to his immense impact on Australia's jurisprudence, Michael Kirby's career has been marked by a commitment to human rights law reform and social justice. Regardless of where people are born or the communities they belong to, equal access to healthcare should be a fundamental human right. In our age of pandemics, and with healthcare inequality widening, how can we make healthcare access equitable? Esteemed jurist and legal scholar Michael Kirby has tirelessly advocated for equal access to healthcare over his lengthy career. As a pioneering AIDS activist, member of the WHO's Global Commission on AIDS from 1988 – 1992, and respected legal mind, Kirby's focus in recent years has also included decriminalising homosexuality and sex work, and reducing the cost of life-saving medications. Hear Michael Kirby in conversation with journalist Geraldine Doogue as they discussed his life and career, focusing on what we have learnt from the HIV/AIDS epidemic, how we have applied those lessons during recent pandemics, and how we can build support for egalitarian global healthcare. We also talk about her personal experiences of loss; how the death of her brother as young adults reshaped her life, and how the death of her mother at age 93, brought with it a profound grief. Poems for When You Can't Find the Words is a comforting collection of poetry from the Irish Hospice Foundation surrounding loss and end of life. Created in partnership with Poetry Ireland, Poems for When You Can't Find the Words offers intimate verse of honesty, candour and solidarity to patients, carers and the bereaved alike. Readers will find comfort in the penned reflections of death, grief, loss and love that span the barriers of time, geography and language. ‘Sometimes, the right words in the right order remain tantalisingly beyond our reach: when, for example, emotions are raw, or formless, or just overwhelming,' said Mary Shine Thompson, who edited and introduced the collection. ‘[Poetry] speaks to the fears and concerns that illness and approaching death awaken. Poetry can keep us going.' An essential collection for those leaving or left, Poems for When You Can't Find the Words includes comforting works by Patrick Kavanagh, Louise Glück, Seamus Heaney, Emily Dickinson, Michael D. Higgins, Paula Meehan and more. Irish Hospice Foundation is a national charity that addresses dying, death and bereavement in Ireland. Their vision is an Ireland where people facing end of life or bereavement, and those who care for them, are provided with the care and support that they need. Mary Shine Thompson lectured in English at St Patrick's College Drumcondra, now Dublin City University, until her retirement. Her edition of Skelligs Haul, by Michael Kirby, was published in 2019, and her exploration of the literary heritage of Westmeath features in Westmeath: Literature and Society (edited by S. O'Brien and W. Nolan, 2022). She is a former chair of Poetry Ireland, the national organisation for poetry, and also of Imram, Féile Litríochta Gaeilge. Professor Wayne Hudson knows a lot - a whole lot - about religion and society. In Australian Jurists and Christianity (The Federation Press, 2021) Wayne, as co-editor, assembles a collection of biographical essays providing new perspectives on the relationship between law and religion in Australia. It claims that the relationship between law and religion was more significant in Australia than has been suggested. Specifically, it suggests that Christianity was a significant influence on Australian jurists, both as public figures and as makers of Australian law. The work includes case studies of 24 leading Australian jurists: Lachlan Macquarie, James Stephen, Richard Bourke, John Hubert Plunkett, George Higinbotham, Samuel Griffith, Inglis Clark, Henry Bournes Higgins, Alfred Deakin, Edith Cowan, Lord Atkin, Robert Menzies, WJV Windeyer, Roma Mitchell, Gough Whitlam, Ron Wilson, Christopher Weeramantry, Gerard Brennan, William Deane, Robin Sharwood, Eddie Mabo, Murray Gleeson, Michael Kirby and John Hatzistergos. This volume forms part of the international series Great Christian Jurists produced under the auspices of the Center for the Study of Law and Religion at Emory University and includes a foreword by Australia's renowned legal historian, Bruce Kercher. Professor Wayne Hudson - Research Professor at Charles Sturt University, Canberra and Adjunct Professor at the University of Tasmania, and a visiting fellow at the Australian National University.  Working across the fields of philosophy, history, politics and religion, he has published twenty-four books and eighty-four refereed articles and book chapters, and has won twenty-five research grants. The United Nation's Report of the Commission of Inquiry (COI) on Human Rights in North Korea was a landmark document that detailed and codified the horrors the Kim Jong Un regime and its forebears inflict upon its people. Crimes against humanity, torture, rape, religious and racial persecution - these are but some of the gross human rights abuses that the North Korean people must endure on an everyday basis. Michael Kirby led the commission and report, and he joins the NK News podcast to discuss his findings five years later, how things have changed (and haven't), and what mechanisms exist to place human rights at the center of engagement with North Korea. The Honourable Michael Kirby is a retired judge, formerly a Justice of the High Court of Australia serving from 1996 to 2009. Michael Kirby, "North Korea and our Dilemma: How to Secure Accountability for Crimes Against Humanity by a Recalcitrant Nuclear State?" Michael Kirby was a Justice of the High Court of Australia (1996-2009), the nation's highest appellate and constitutional Court. In 2013-14 he served as chair of the Commission of Inquiry of the UN Human Rights Council investigating crimes against humanity in the Democratic People's Republic of Korea (North Korea). The commission found grave and long-standing crimes against humanity and called for referral of its report to the Security Council of the United Nations. That body has the power to refer matters to the jurisdiction of the International Criminal Court (ICC) in the Hague. He warned the Supreme Leader of North Korea that, under international law, he was potentially personally accountable for failing to use his power to prevent and redress such crimes. Although the commission's report was duly sent to the Security Council by the UN Human Rights Council and the General Assembly, so far the Security Council as failed to enliven the jurisdiction of the ICC. In recent weeks, the Council has imposed new and stronger sanctions against North Korea following the conduct of a fourth nuclear weapons test and missile tests. The report of the commission has been widely praised for its powerful description of great wrongs. But how do we move beyond another UN report into effective subjection of this dangerous state and its leadership to compulsory accountability before an international tribunal responding to the deep concerns of humanity? The speaker will outline our dilemma. He will also answer questions and suggest possible future developments. The Ulysses and Marguerite Schwartz Memorial Lectureship at the University of Chicago Law School is held by a distinguished lawyer or teacher whose experience is in the academic field or practice of public service.
