Recently, I caught up with Temujin Kensu, a man who has been incarcerated since 1986 for a crime he couldn't possibly have committed. Temujin has endured a great deal over his nearly 40 years behind bars, and as he gets older, his health issues have become a daily struggle. But first, award-winning reporter William N. (Bill) Proctor, and activist and streamer discuss the case of Temujin Kensu, who has been wrongfully imprisoned for 37 years for a murder that was committed more than 400 miles away from where Kensu was. Miko Peled is an author, writer, speaker, and human rights activist living in the United States. He is the author of "The General's Son: Journey of an Israeli in Palestine" and "Injustice: The Story of the Holy Land Foundation Five." His father was a high ranking Israeli general, his maternal grandfather was a signatory to Israeli independence, his niece was tragically killed in a suicide bombing and he's a staunch advocate for a one state solution. He is considered by many to be one of the clearest voices calling for justice in Palestine, support of the Palestinian call for Boycott, Divestment and Sanctions (BDS) and the creation of a single democracy with equal rights in all of historic Palestine. Educated in Jerusalem, Japan and the United States, Peled is also an accomplished professional martial artist. For 23 years, Peled ran a martial arts school that was dedicated to teaching leadership skills and non-violent conflict resolution through martial arts. Miko is also a contributor to several online publications (Mint Press, The Electronic Intifada, Democracy Now, Mondoweiss), Mikopeled.com, and produces The Miko Peled Podcast, all of which he dedicated to advocating for the creation of one democratic state with equal rights for Israelis and Palestinians. He travels regularly to Palestine where he speaks and works with the popular resistance, the BDS movement, and other justice groups. As a result, he has been arrested several times by the Israeli authorities for his activism. William N. (Bill) Proctor, founder of Proving Innocence, is an award-winning journalist, reporter, producer, and anchorperson whose career of nearly forty years spanned electronic media, radio, television, and documentaries. A graduate of the University of Maryland, Bill received his degree in Sociology and Corrections with a minor in Journalism. He concluded his career as senior staff reporter for WXYZ-TV in Southfield, MI. In the mid-1990s, he produced a series of specials on the slaying of community-college student, Scott Macklem. Through his investigations, Bill became convinced that Frederick Freeman (Temujin Kensu), the man convicted of killing Macklem, was not guilty. His passion for redressing this injustice led Bill to found Proving Innocence in 2007. In May 2013, Bill "retired" and started Bill Proctor and Associates, a communications consulting firm. In 2017 Bill formed a new organization, which looks at a multitude of issues surrounding wrongful convictions, which go beyond the scope of Proving Innocence. Joy Marie Mann is an organizer, activist, writer, journalist and long-time streamer. She resides in Harrisburg, Pennsylvania. In November of 1986 a man named Scott Macklam was fatally shot in the car park of a community college in Port Huron Michigan.Fred Freeman who now goes by Temujin Kensu who was over 400 miles away in Escanaba was subsequently arrested, tried and found guilty of the crime and remains in prison almost 37 years later.No one saw the shooting that Temujin is convicted of committing. Instead, two men testified to seeing a stranger who possibly resembled Temujin at some point before or after the shooting. One of the witnesses was hypnotized before he testified.No less than nine unimpeached neutral alibi witnesses testified to at trial, that Temujin was over 400 miles away at the time of this crime. The prosecution countered by suggesting that Temujin theoretically could have chartered a plane to go commit the murder and return in time to be seen by his alibi witnesses.The biggest issue with that is the prosecution never offered any actual evidence to support this theory.This is the insane story of Fred Freeman as told by him. Since 1989 more than 3,400 people have been exonerated in the United States, with more than 30,000 years lost between them. Relationships are hard, they take work, communication, mutual respect and love. Now just imagine you were trying to do all of that while your other half was serving a life sentence behind bars. Paula Kensu is the wife of Temujin Kensu, the man from Michigan serving a life sentence for a murder he says he didn't commit.Paula and Temujin did not meet at a bar, on tinder or through friends, Paula and Temujin met while Temujin was incarcerated. Temujin has spent more than half his life robbed of his freedom, his health is not good and he is not receiving the medical care he needs. On November 5, 1986, Scott Macklem was shot and killed in a parking lot at St. Clair County Community College in Port Huron, Michigan. No one saw the shooter, but one witness caught a fleeting glimpse into a car leaving the lot. The victim's alleged fiance, Crystal Merrill, identified Temujin Kensu as a suspect due to their previous relationship. However, Kensu was over 400 miles away at the time of the murder and had multiple independent alibi witnesses to confirm his location. Additionally, no physical evidence tied him to the crime, not even the fingerprints that were taken from the scene. The police staged a very suggestive photo lineup for the witness who chose Temujin. The prosecution crafted a narrative surrounding the fact that Kensu was an avid practitioner of martial arts and must have chartered a private plane to and from Port Huron to commit the crime. For nearly the next 3 years Temujin, his family, his supporters and his attorneys were under the understanding and impression that everyone realized this man's innocence and was working to get him out. A clemency application with Governor Gretchen Whitmer was pending and denied by the Governor in December 2020 for the reason that the parole board didn't support the clemency. The parole board admittedly does not consider innocence in its review, so if remorse for the crime is not demonstrated, they will never support clemency. By this time, the State CIU team led by Michigan's AG Dana Nessel was assigning different people to investigate this case. While a case is with the CIU, the inmate is prevented from seeking any other type of relief (no appeals can be filed). The supposed "investigation" was initially stalled due to a "conflict" in the AG's office, and later Val Newman was assigned as Special Assistant AG to spearhead an investigation. Ultimately on May 17th, 2022, Temujin's family woke up to find out that Temujin's case had been closed without rhyme or reason. Temujin's family then went to Michigan's website for the CIU and found that its criteria had been changed back in April of 2020 to a very narrow standard (very similar to the appellate court standard) which severely limits what can be considered for review. AG Dana Nessel created the unit with the promise of reviewing cases to determine if the convictions had integrity. Temujin Kensu was 23 years old, when he was sentenced to life in prison for a crime he could not have committed. The shooting and murder of Scott Macklem occurred on November 5th, 1986 on the campus of St. Clair Community College in Port Huron Michigan. No DNA, hair fibers, murder weapon, or footprints were found on the scene, there was an ammunition box with latent fingerprints on it that didn't belong to Temujin. Because things can turn around for worse, any second, and all that you are taking for granted everyday, could be gone in the blink of an eye. I thank God for all that and more - Half of Americans have family members who are incarcerated. And that is from the data in 2018. Probably half of the incarcerated are innocent. And there is no real clear data on this. No one has it. What about those who are married and would do anything to be together but just cannot. Like the women who visit their innocent husbands incarcerated in prisons across America. They go through a lot of trouble, and embarrassing searches just to be able to meet and hug and see each other and spend some time together, until it's time to go. And then you turn around to have that one last look, holding on to that last hug and the beautiful smell that it left in your mind and your memories. Irreplaceable!. What kind of a toll does it take on a spouse when she knows her husband is innocent but in prison for something he did not do, and has been there for over three decades and she really doesn't know when he's coming back? What kind of an emotional and psychological impact does it leave on spouses who have innocent loved ones incarcerated? For many it's heart breaking.
