The importance of making room for rights-based politics In this episode, recorded during the FRA FORUM in Vienna, we focus on practicing human rights-based politics in institutional structures and spaces. Morten Kjaerum* brings in his professional and personal perspective to respond to the following questions: what space is there for human rights in politics? Are there new or regenerated ideas that can drive more rights-based politics?  *Morten Kjaerum was Director of the Raoul Wallenberg Institute of Human Rights and Humanitarian Law (RWI) in Sweden from 2015 to 2024. Before joining RWI, he was the Director of the EU Agency for Fundamental Rights in Vienna from 2008 to 2015.

The Being Black in the EU report was published earlier this week. It had been carried out by the EU Agency for Fundamental Rights. It showed that the levels of racism directed at black people in Ireland has increased over the past five years. But does racism exist in Irish business too? According to the 'Being Black in the EU' report, which was carried out by the EU Agency for Fundamental Rights examined the experiences of more than 6,700 people of African descent living in 13 different EU countries and found that people of African descent in the EU "face ever more racism and discrimination". Artificial intelligence (AI) already plays a role in deciding what unemployment benefits someone gets, where a burglary is likely to take place, whether someone is at risk of cancer, or who sees an advertisement for low mortgage rates. Its use keeps growing, presenting seemingly endless possibilities. However, AI also poses major challenges to upholding fundamental rights standards in Europe. In his address to the IIEA, Michael O'Flaherty, the Director of the EU Agency for Fundamental Rights, discusses the implications of AI for human rights, the new AI Act, as well as the wider challenges facing human rights standards in an age of rapid digitalisation. About the Speaker: Michael O'Flaherty is Director of the EU Agency for Fundamental Rights. Previously, Michael O'Flaherty was Established Professor of Human Rights Law and Director of the Irish Centre for Human Rights at the National University of Ireland, Galway. He has served as Chief Commissioner of the Northern Ireland Human Rights Commission, Member of the UN Human Rights Committee, and head of a number of UN Human Rights Field Operations.

The report also states that “AMR will be an increasing concern unless governments respond more robustly to the threat.” In 2020, more than 800,000 infections due to resistant bacteria occurred in the EU/EEA, which directly resulted in the deaths of 35,000 people. “This means that every day nearly 100 people die in the EU, Norway, and Iceland,” ECDC director Andrea Ammon said at a press briefing presenting the report. “The burden of AMR in the EU remains similar to the burden of influenza, tuberculosis and HIV/AIDS combined,” Ammon added. Antimicrobials include the subcategories antibiotics, antivirals, antifungals and antiparasitics, and are used to prevent and treat infections in humans, animals and plants. According to the World Health Organisation (WHO), AMR occurs when bacteria, viruses, fungi and parasites change over time and stop responding to medicines. This complicates the treatment of infections. AMR is driven by many factors, including widespread mis- and overuse of antibiotics in humans and animals worldwide. AMR is a slow, silent pandemic, according to Ammon, who warned that we continue to see “high levels of AMR for several very important bacterial species” and that “new ones continue to emerge”. In July, the Commission's Health Emergency Preparedness and Response Authority (HERA) identified AMR as one of the top three health threats requiring coordinated EU action. In 2019, it was estimated that AMR cost the healthcare systems of EU/EEA countries approximately €1.1 billion every year. This cost is bound to increase as AMR is on the rise and the development of new antimicrobials is slow. Antibiotics List of antimicrobials still disputed despite endorsement by member states The EU member states have now formally given their support to the list of antimicrobials reserved for human use proposed by the Commission. Despite this, the criticism has not died down. Burden in healthcare settings According to Ammon, around 70% of the AMR burden is linked “with healthcare-associated infections”. “[This] could be easily minimised through adequate infection prevention and control measures, as well as antibiotic stewardship in healthcare settings,” she said. One positive development shown by the report is that the last 10 years have shown a decrease of 23% of the total antimicrobial consumption in humans in primary care and hospital sectors. While this could show that we are moving in the right direction, Ammon advised keeping in mind that there could be missed factors lost in the disruption of the COVID-19 pandemic. The European Medicines Agency (EMA) reviewed the jab after 13 EU states suspended use of the AstraZeneca vaccine over fears of a link to blood clots. Following the announcement, Germany, France, Italy and Spain announced they would restart their roll-out of the vaccine. Also: President Biden has announced that the US will on Friday meet his target of vaccinating a-hundred million people in his first one-hundred days in office, more than a month ahead of schedule, and up to ten Russian track and field athletes will be able to compete as neutrals at the Tokyo Olympics this summer.

The EU disease agency ECDC on Thursday urged countries to prepare more stringent measures and speed up vaccine campaigns in the coming weeks because of the risks of more infectious variants of the novel coronavirus.The European Centre Disease Prevention and Control in a new report said that countries in the EU and European Economic Area should expect increased numbers of COVID-19 cases due to the gradual spread and possible dominance of the variants with increased transmissibility.

On 12 November 2020, the European Commission launched its first ever LGBTIQ Equality Strategy. While the strategy was published against the backdrop of overall increasing public support for LGBTIQ equality in the EU, it paradoxically also follows a recent increase in instances of discrimination, as well as substantial curtailments of LGBTIQ rights in some Member States. In this online discussion, Minister Byrne addresses Ireland's position on the new EU strategy and consider how Ireland's policies on LGBTIQ rights inform its global role. Director O'Flaherty offers analysis of the challenges facing LGBTIQ equality at European level and the work of the EU Agency for Fundamental Rights on this issue. Migration in rational terms is little more than a self-made political crisis. S. Mordue observes that the flows of migrants dropped from 1.2 million during the 2015 Syrian crisis to 160 000 today and regrets that, four months ahead of the European elections, Parliament and Council agreed on 5 of the 7 proposals made by the Commission in 2016 but have not yet adopted them. Solidarity and responsibility mean the frontline countries deal with asylum claims, the others being called to share the burden: this is the Dublin Regulation (in need of reform now). When this is not in place, migrants move on: instead of establishing internal border controls within the Schengen zone, the Commission proposes a mix of relocations, disincentives and the administrative and operational support provided by the reinforced European Border and Coast guards and the EU Agency for Asylum. There is also a huge need for convergence in the way asylum seekers are protected: the Commission proposes that the EU agency collects information on reception conditions in the Member states and their regions. The Agenda on migration provides for a legal pathway for asylum seekers directly from third countries, with financial compensation for resettlements paid directly to the receiving Member states. The EU also engages with third countries to ensure voluntary returns, readmission of nationals and a regional disembarkation mechanism aiming to avoid deaths at sea. Better management of migration also means organising circular migration, seasonal labour, readmission of nationals by third countries. Overall, the EU today needs a holistic approach to migration, in line with its labour needs and with European and international standards for human rights.

The Legal Affairs Committee has tabled a report with recommendations to the Commission on the civil-law and ethical aspects of robotics.
