History shows that our nation was to continue the "reformation" struggle in England between religious liberty and religious tolerance that had ended with restoration of the monarchy and the Church of England's primacy. But, recent First Amendment religious liberty arguments made to the U.S. Supreme Court show that we have forgotten that history and God' purpose for our nation. Today, David will demonstrate that esteemed early Justice Joseph Story wrote about it, picking up language used by John Owen and contained in the 1658 Savoy Declaration. He'll show the U.S. Supreme Court once understood it, too. This week shows that it is time for the Church to get back to the mission given it pertaining to harmonious reconciliation of religious liberty and righteous and just civil law.
Estoppel is a legal principle that prevents a party from asserting a claim or fact that contradicts a previous statement or agreement. Its primary goal is to ensure fairness and consistency in legal proceedings by preventing parties from deceiving or harming others who have relied on their earlier representations.Estoppel originated in the early equitable jurisdiction of common law courts. Judges of equity developed it as a remedy to prevent injustices that would occur if strict adherence to common law rules was enforced in certain situations.The three main forms of estoppel discussed are equitable estoppel, promissory estoppel, and judicial estoppel. Equitable estoppel arises from misleading conduct causing detrimental reliance. Promissory estoppel prevents reneging on a promise that induced detrimental reliance, even without a contract. Judicial estoppel prevents taking inconsistent positions in different legal proceedings.The essential elements commonly found in estoppel claims are a representation (or conduct), reliance by the other party, and resulting detriment to the relying party. Reliance is significant because it demonstrates that the party acted based on the representation, and the potential for injustice arises if the original party can then contradict that representation.Equitable estoppel arises when one party's misleading conduct or representations induce another party to act to their detriment. For example, if a landlord verbally assures a tenant that they can sublet their apartment, and the tenant then incurs costs finding a sublessee, the landlord might be estopped from later denying the tenant's right to sublet.Promissory estoppel prevents a party from breaking a promise, even if there's no formal contract, if the promisee reasonably relied on that promise and suffered a loss as a result. It differs from a formal contract because it doesn't require consideration. It might be invoked when enforcing the promise is necessary to avoid injustice due to the promisee's detrimental reliance.The purpose of judicial estoppel is to protect the integrity of judicial proceedings by preventing parties from "playing fast and loose" with the courts. Key requirements include the party having taken a specific position in a prior legal proceeding, that position being accepted by the court, and the party subsequently trying to assert a contradictory position in a later proceeding.The main function of collateral estoppel, or issue preclusion, is to prevent the re-litigation of specific factual or legal issues that have already been conclusively decided in a prior legal proceeding involving the same parties.One policy consideration underlying estoppel is fairness and justice. The doctrine aims to prevent opportunistic behavior by holding parties accountable for their representations when others have reasonably relied on them, thus promoting reliability and predictability in legal interactions.One criticism of estoppel is that its rigid enforcement might sometimes lead to unjust results, particularly if the party making the initial representation did so under duress, without fully understanding the implications, or if subsequent circumstances have significantly changed.

He has been Member of Parliament (MP) for Holborn and St Pancras since 2015, and previously was Director of Public Prosecutions from 2008 to 2013.Born in London and raised in Surrey, Starmer attended the selective state Reigate Grammar School, which became a private school while he was a student. He was politically active from an early age and joined the Labour Party Young Socialists at the age of 16. He graduated with a Bachelor of Laws degree from the University of Leeds in 1985 and gained a postgraduate Bachelor of Civil Law degree at St Edmund Hall at the University of Oxford in 1986. After being called to the bar, Starmer practised predominantly in criminal defence work, specialising in human rights. He served as a human rights adviser to the Northern Ireland Policing Board and was appointed a Queen's Counsel in 2002, later citing his work on policing in Northern Ireland as being a key influence on his decision to pursue a political career. During his time as Director of Public Prosecutions, he dealt with a number of major cases including the Stephen Lawrence murder case. In July 2024, Starmer led Labour to a landslide victory at the 2024 general election, ending fourteen years of Conservative government with Labour becoming the largest party in the House of Commons. This week I'm reading from Douglas Charles Hodgson's book 'Spiritual Revelations from Beyond the Veil: What Humanity Can Learn from the Near Death Experience'.Spiritual Revelations from Beyond the Veil: What Humanity Can Learn from the Near Death Experience decouples spirituality from a religious context and perspective. It examines the intriguing accounts of people who have undergone a near-death experience (NDE) and what was revealed to them while outside their physical bodies. What those people vividly described went well beyond what can be found in religious scripture. The NDE accounts contain descriptions of Heaven and the higher spiritual realms, what interconnectedness/oneness means, the eternal nature and liberation of the soul consciousness, the gift of free will and its purpose, the nature of soul agreements, the universal laws of attraction, reincarnation, and cause and effect (karma), the nature of positive and negative energy, the significance of the death of our physical body as well as our spiritual rebirth and life review. The study and collation of more than 500 NDE accounts, and the identification of common observations and insights drawn therefrom, culminated in the writing of this book. Going beyond the current NDE literature, which mainly examines the historical, religious, philosophical, scientific and medical aspects of this phenomenon, Spiritual Revelations from Beyond the Veil concentrates on the important messages brought back from beyond the veil for humanity's knowledge and benefit. DEFINITION AND PURPOSE OF CRIMINAL LAW. Criminal Law, at its core, is the body of law that deals with offenses against society. It's designed to maintain societal order and protect the rights and safety of individuals. In essence, Criminal Law sets the rules and boundaries that individuals within a society must follow. It delineates what actions are considered criminal and the consequences for engaging in such actions. But what sets Criminal Law apart from its counterpart, Civil Law? DISTINCTION BETWEEN CRIMINAL LAW AND CIVIL LAW. In a nutshell, Criminal Law primarily focuses on punishing individuals for committing crimes that harm society as a whole. The key distinction lies in the nature of the parties involved: In Criminal Law, the government, represented by the prosecutor, brings charges against the accused, seeking to establish their guilt. In Civil Law, it's typically one individual or entity (the plaintiff) suing another individual or entity (the defendant) for damages or specific remedies. The aim here is to provide redress for private wrongs, such as breaches of contract or personal injury. BACKGROUND TRANSITION. Now that we've clarified the purpose and distinction, let's explore where Criminal Law draws its authority and guidance. SOURCES OF CRIMINAL LAW. Criminal Law finds its roots in various sources, each contributing to the rich tapestry of legal principles and rules. Let's delve into these sources: STATUTES. Statutes, also known as legislative acts, are laws passed by legislative bodies, such as Congress at the federal level and state legislatures. These statutes define specific crimes, their elements, and the penalties for violations. They form the backbone of Criminal Law and provide a clear and written foundation for legal actions. COMMON LAW. Common Law, on the other hand, is developed through judicial decisions over time. It's the accumulation of legal precedents set by courts in previous cases. Judges interpret and apply the law to specific situations, and these decisions become binding on future cases. Common Law is especially important in areas where statutes are not comprehensive or do not exist. CONSTITUTIONAL IMPLICATIONS. Lastly, we must consider Constitutional Law. The United States Constitution, at both the federal and state levels, plays a significant role in shaping Criminal Law. It establishes the framework for government authority and the rights of individuals. Some Constitutional provisions directly impact Criminal Law, such as the Fourth Amendment, which protects against unreasonable searches and seizures. BACKGROUND TRANSITION. So, how do these sources come together to form the legal landscape? HOW THESE SOURCES SHAPE THE LEGAL LANDSCAPE. Criminal Law operates within a complex web of statutes, common law, and constitutional principles. These sources interact to create a legal framework that guides law enforcement, prosecutors, defense attorneys, judges, and, of course, you as a future attorney. EXAMPLES. For example, let's consider a case of theft: Statutes will define what constitutes theft, specifying the elements required for a conviction, such as taking someone else's property with the intent to permanently deprive them of it. Common law decisions in previous theft cases will provide additional guidance on how courts have interpreted theft laws. Constitutional principles, like the right to due process, will ensure that the accused receives a fair trial and that their rights are protected throughout the process. To summarize, Criminal Law's primary purpose is to maintain societal order and protect individuals' rights by defining and punishing offenses against society. It's the first year of restored voting rights for many formerly incarcerated people and people with felony records in Minnesota.It's a change that was approved during the 2023 legislative session, which followed a move by several other states to restore voting eligibility.The new law is estimated to restore the voting rights of 55,000 Minnesotans who are not currently incarcerated but are serving out the final days of their sentence via probation or supervised release.But it's also facing challenges.
