Congratulations graduates! The Farm & Industry Short Course at UW-River Falls concluded this week, and the grads are ready to take what they’ve learned back into the agriculture industry. Today we’re catching up with two FISC students. Kevin Biese from Wrightstown comes from a family-owned dairy milking about 1,000 cows. He said the Farm and Industry Short Course just made sense for someone in production agriculture. FISC has a notable reputation even out-of-state. On April 19, 2022, representatives of Volta Charging, LLC, came before the Newtown Township Planning Commission (NTPC) to discuss a plan to install two Electrical Vehicle (EV) Charging Stations in landscape islands located in the parking lot of ACME in the Newtown Shopping Center. Testifying for Volta were Michael J. Megnniss of Begley, Carlin & Mandio, LLP, and John Stuckey, VP East Charging Solutions and Site Development. In this composite of audio snippets from the meeting, Volta describes its unique business model that includes a 4-foot high visual electronic signage/advertising charging station panel. The charging service is FREE to anyone. There is no fee to charging partners (e.g., ACME) who, according to Volta, benefit by attracting “more customers who stay longer.” “Volta's business model creates a bit of unique situation for each municipality,” admits Volta's legal representative, Michael J. Megnniss of Begley, Carlin & Mandio, LLP. Indeed, as noted by Peggy Driscoll, chair of the NTPC, electronic “message centers” are not permitted anywhere in the Jointure (Newtown, Wrightstown, and Upper Makefield). Other than that, variances regarding freestanding sign size and height requirements would be required. Because the Jointure is currently working on an ordinance permitting the use of EV charging stations, Volta and the NTPC decided that this matter would not be brought up at the My 5, 2022, Zoning Hearing Board meeting as planned for a variance hearing. It was also agreed that Volta representatives would be invited to the next Jointure meeting to discuss its plan. This would help the Jointure develop an ordinance that properly addresses the location, use of existing parking spaces, signage, public vs private locations, etc., of EV charging stations.

Ted Dorand, PECO External Affairs Manager for Bucks County, was a Special Guest speaker at the April 19, 2022, meeting of the Newtown Economic Development Committee. In this audio clip, Mr. Dorland speaks about Electric Vehicle (EV) Charging Stations. He describes the three main types of EV charging – rapid, fast, and slow - and provided information on financial aid that PECO and the Department of Environmental Protection offer to municipalities wishing to install charging stations. Mr. Dorland mentions, for example, that Middletown Township recently received a $215,000 grant to install three EV fast chargers for public use. Meanwhile, the Joint Zoning Council (JZC) is working on an ordinance permitting the use of EV charging stations in Newtown, Upper Makefield, and Wrightstown. There have been notable shifts in the land use characteristics of the individual municipalities of the Newtown Area Jointure (Newtown, Wrightstown, Upper Makefiled) as well as in the characteristics of the Jointure, as measured against comparable statistics from 2005. At the June 15, 2020, Newtown Township Board of Supervisors (BOS) meeting, the Board reviewed the details of latest draft of the E30 "Curative Amendment" to the Newtown Area Zoning ordinance. This amendment creates a new use for a combination gas station/convenience store (i.e., Wawa) in each township of the "Jointure" of Newtown, Wrightstown and Upper Makefield. Supervisor Mack asked how this amendment differed from the original "sketch plan" submitted to the BOS by Provco Pineville Acquisitions LLC, which is the Wawa developer. Provco - representing Wawa - has sued Newtown because it does not have a zone that allows a combination gas station and convenience store. In a separate but somewhat related action, a curative amendment was proposed that seeks to find a zoning area for the use within the jointure area of Newtown Township, Wrightstown and Upper Makefield (view the video here: https://johnmacknewtown.info/municure.html). Although Supervisor Calabro suggested that this is "protecting" Newtown, Township Solicitor Dave Sander said it does not apply to Wawa's substantive legal challenge to the joint municipal zoning ordinance previously filed by Wawa. Only if that challenge does not succeed will Wawa be subject to the Municipal Cure. At the June 6, 2020, Newtown Planning Commission Zoom meeting, the members tried to understand the process and were frustrated that the township virtually has no choice but to give Wawa want it wants - i.e, modification of the OR (Office/Research) zone, which is along the Newtown Bypass, to allow a Super Wawa to be built there pretty much the way Wawa wants to build it - primarily due to the fact that Newtown does not have the funds to fight Wawa in court, a situation exacerbated by the COVID-19 pandemic. In other words, Wawa has the township over a barrel! In addition, this will be by "exceptional use," not "conditional use," which means the Zoning Hearing Board - NOT the Supervisors - will have the authority to approve this use. The ZHB is not elected by the public, just sayin'
