    The Department for Education has announced tougher legal measures in order to, as it claims, to strengthen free speech and academic freedom at universities in England. Under the plans, the Education Secretary would appoint a new Free Speech and Academic Freedom Champion to investigate potential infringements, such as no-platforming speakers or dismissal of academics, and higher education providers would be legally required to actively promote free speech. The new Champion would be appointed to the board of the Office for Students and would be able to investigate potential infringements of the new registration condition on freedom of speech and academic freedom in higher education. The registration condition would work alongside strengthened legal duties on free speech and academic freedom and the Champion would also be able to recommend that the Office for Students imposes fines. But, will this work? Is it desirable or even necessary? What is the nature and scope to the threats to free speech and academic freedom today? Instead of enforcing free speech via legislature, should the government encourage people to engage with the subject of free speech? Or, are these new proposals, themselves, impositions on freedom of speech? Can you really legislate your way to free speech? Or perhaps, will it be beneficial to have a neutral arbitrator to settle free speech disputes on campus?     The government has announced a series of proposals to “strengthen free speech and academic freedom at universities in England”, with a “free speech champion” investigating potential infringements on campuses. The Education Secretary Gavin Williamson warned of a “chilling effect” where students and staff feel they cannot express themselves freely. Many believe these measures are a welcome legal intervention following claims of increasing numbers of individuals being silenced, no-platformed or sacked. Critics, however, say the threat to free speech on campuses is grossly exaggerated and the government is cynically stirring up a culture war to distract from its own failings in tackling Covid. Moreover, they claim these proposals actively undermine free speech because they are just another way of controlling what is 'acceptable' speech, the impact of which is to discipline those who are defending others from racism, sexism, homophobia and transphobia. Students have a right to physical safety and to expect not to be subjected to hatred, but some worry about a ‘concept creep’ in which the definition of hate speech has widened to include any opinions that go against the prevailing orthodoxy. Academics’ own experiences are mixed: some say they feel no pressure of censorship, others believe their colleagues are in denial about the regression of academic freedom. Universities have long been seen as places of intellectual danger, where people go to be shocked and changed. Is this idea in retreat?     On this episode of the Argument Ninja podcast I talk about the difficulty of judging how much we really understand about the causes of complex social phenomena—even if we do lots of research and self-study. To help make the case I’m continuing my survey of different theories of the causes of the increase in social polarization that we’re currently experiencing. On this episode I look specifically at the work of two social scientists who have written extensively on this topic: Karen Stenner on the “authoritarian” personality type. Her 2005 book The Authoritarian Dynamic can be read as predicting the expansion of right-wing populism that contributed to the rise of Trump and Brexit. Stenner’s work has been influential on Jonathan Haidt’s analysis of polarization. Eric Kauffman on the effects of immigration on polarization in white majority countries. His latest book Whiteshift explores how demographic shifts are driving cultural conflict, and how this will likely play out in the longer run. But before I get to these topics, I give some Argument Ninja Dojo updates, do a recap of episode 034, and present a conceptual model for how we should think about the epistemological challenge of understanding complex social phenomena like polarization.
