BigTent hosted Michael Waldman, President of the Brennan Center for Justice and retired Judge J. Michael Luttig. They joined us to discuss the 2024 election, and whether Trump is ineligible for the presidency in accordance with Section 3 of the 14th Amendment. This section bars anyone who has violated their oath to uphold the US Constitution by “engaging in insurrection”, from holding public office. Judge Luttig has said that the Supreme Court's decision to take up the question of Trump's eligibility will be “one of the most consequential Supreme Court decisions since the founding of the nation.”Links discussed on the PodcastDonate to Brennan CenterJudge Luttig on MSNBCNY Times Article:The Trump Threat Is Growing. SEASON 2 EPISODE 98: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT: You and I have 305 days until the election and the GOOD news is: if the Supreme Court rules Trump is immune from prosecution for anything he did while president OR if the Supreme Court rules the 14th Amendment DOESN'T disqualify him from the ballot OR if the Supreme Court rules both… Joe Biden can declare himself president for life, he can arrest the Supreme Court, and he can detain Trump without charges or trial and the Supreme Court has just ruled there's not a goddamned thing anybody can do about it, including them. Well thank god THAT'S settled. Happy New Year! I am mystified by the sanctimonious criticisms of Maine striking Trump from the ballot from its Senator Angus King and "Democratic" Congressman Jared Golden. They have decided the Constitution wasn't enough and decided on their own that we needed HIGHER BARRIERS before as a nation we could defend ourselves against a psychotic dictator-in-waiting who wants to turn the government into a personal revenge factory and oh by the way the only thing he's going to remember about YOU Angus King, is that you voted to impeach him. “Under the established Constitutional process," said Senator King from atop his high horse, "absent a final judicial determination of a violation of the 14th Amendment's disqualification clause, I believe the decision as to whether or not Trump should rest with the people as expressed in free and fair elections. This is the ultimate check within our Constitutional system,” This isn't a matter of interpretation for the courts, or for you, Senator King. It's what the 14thAmendment SAYS as opposed to what a fragment of your voters want you to tell them it says. What it SAYS is, your Senate AND the House have a right to REMOVE the disqualification of Donald Trump by a two-thirds vote. It exists. It exists right now. It only STOPS existing if you OVERRIDE IT. By 75 to 25, thank you. That's what it says. THAT is the ultimate check within our Constitutional System. I hope you can hear me up there floating on that cloud above it all. Speaking of, congratulations to The New York Times, which addresses disqualification by quoting Judge Michael Luttig, and balancing him with someone who wrote commercial scripts for Dunkin' Donuts and an L.A. democrat who went on Fox to say he's mad at Joe Biden. And congratulations to The Washington Post for buying out the only one of its reporters who got it - Greg Sargent. But genuine thinks to Green Day, which did what the rest of us can almost never do - pierce the MAGA/Trump Cult/Fascist bubble and show its cultists, to their shock, that they are not a majority and not at all liked. It's shocking that such penetrations come during Dick Clark's Rockin' New Year's Eve - but it's worth singing about! B-Block (27:45) POSTSCRIPTS TO THE NEWS: She allegedly liquored up underaged teenagers at her daughter's 17th birthday party. Is she A) a drag queen B) a trans-gendered swimmer C) a librarian or D) the founder of the “Keeping Kids In School PAC” and former Republican candidate for Lieutenant Governor?; The right-wing pundit who boasts of how The Statue of Liberty is better than any European art; The passing of Tom Foty. (35:25) THE WORST PERSONS IN THE WORLD: Fox kills the wrong Frank Thomas. Aaron Rodgers has now descended into using antisemitic tropes. And Michael Flynn Jr. sticks his father with a new name: "General Flynn-Bitch." C-Block (41:55) THINGS I PROMISED NOT TO TELL: We're now in the 25th anniversary year of the night - before Game 1 of the World Series which I was covering for Fox - where an Atlanta hotel gave me a room next to a choir that spent the entire night practicing for a competition the next day. It then tried to make it up to me by offering me, instead...THE PRESIDENTIAL SUITE.See omnystudio.com/listener for privacy information.

Rundown - Jason Dunn in Craig's Lawyers' Lounge - 10:50 Troubadour Dave Gunders - 01:30:59 "Time To Plant Everything" by Dave Gunders - 01:42:28 Accomplished Denver attorney Jason Dunn, former US Attorney under President Donald J. Trump, makes a sensational first appearance in Craig's Lawyers' Lounge. He even promises to extend an invitation to his Brownstein law firm partner, @davidlbernhardt, recent Interior Secretary. Jason Dunn ducked no questions including why he didn't resign right after 1/6/21. Cases of USA v Trump addressed especially the DC case presided over by Judge Tanya Chutkan who put Mr. Trump on notice today. Will 45 soon be jailed? Dunn worked high up at the Colorado AG's Office under John Suthers. Numerous great Republican role models are discussed including Judge Tim Tymkovich, Judge Michael Luttig, Richard Donahue, Jeff Rosen, and others at the DOJ. Jason Dunn became US Attorney in 2018 and so did David Weiss, who was from Delaware. Learn what Dunn thinks of Weiss and other Special Counsel he knows well. Amazing back stories discussed. Is Weiss a disguised Biden guy? Host dislikes “Biden Crime Family” disparagements, especially used as propagandist deflection for Trump crime spree. Dunn responds brilliantly, pointing out legitimate reasons for suspicion including some walk backs on prior statements. But Dunn agrees there's no proof yet Joe Biden is dirty. Hear the best discussion of the federal Hunter Biden prosecution available. Do such firearms forms' crimes get prosecuted? Almost never. BTW, Dunn confesses no one who regularly consumes cannabis in America can honestly possess a firearm if they honestly fill out that federal form. Hunter Biden wrote a book about his crack cocaine usage and reckless lifestyle, including possessing firearms while wasted. As for the tax crimes, listen to Colorado's former top prosecutor. Hunter Biden matter discussed in full. As for corruption, these two lawyers stipulate, despite his public censure, former Colorado Chief Justice Nathan Ben Coats had a long distinguished history of phenomenal service to Colorado, and should be applauded. These guys know this judge. Ben Coats is not corrupt. Jason Dunn did a great job addressing crime during COVID time and kept his large important office together. Dunn demonstrated during difficult days his decades long abilities to supervise a team as a big law firm administrator. First rule. Find great help. After Biden won the election, when Trumps and allies falsely accused Denver's Dominion Voting Systems, Jason Dunn was offended, and spoke out. The election was fair. Dangerous accusations against Dominion were not. Lively discussion follows as host predicts likely jailing of Trump and soon, for violations of court's order. The proper judicial reaction is debated in this high caliber discussion. Complicity of House Republicans is also reviewed. As for the debate of whether “you are too honest” really said to VP Pence, Trump-Pence appointee Dunn believes VP and explains why. The ethical grotesqueries of Justice Clarence Thomas gets reviewed and ripped more by host than guest. Show Troubadour Dave Gunders contributes his wonderful song, Time to Plant Everything, signaling new spinoff podcast, Craig's Colorado Corner with Speaker Terrance Carroll and Colorado Sun columnist Mario Nicolais. Ep 162 coming subscribers' way at 8 a.m. Monday, Colorado time.

This week, the Supreme Court handed down a major decision relating to elections in America in the Moore v. Harper case. In a 6-3 ruling, the Court rejected the independent state legislature theory, finding that the Elections Clause does not give state legislatures exclusive power over elections, and upholding the power of judicial review in electoral cases, including redistricting decisions. In this episode of We the People, guests Judge Michael Luttig and Professor Evan Bernick join to break down the Moore decision – including why the Court decided to reject the independent state legislature theory; why conservative Justices Thomas, Alito, and Gorsuch dissented; and what this means for the future of judicial review of election laws. January 6 Committee Chair Rep. Bennie Thompson (D-MS) said “ Thanks in part to Mike Pence, our democracy withstood Donald Trump's scheme and the violence of Jan. 6.” The chair's remarks came as he delivered his opening statement during the January 6 Committee hearing on the investigation of the attack on the U.S. Capitol. This is the third in a series of hearings - after months of closed-door investigations - detailing the committee's findings on the attack. While testifying on the pressure then-Vice President Pence was subjected to by former President Trump and attorney John Eastman, former counsel to Vice President Pence, Greg Jacobs said that the vice president was urged multiple times by the president and Mr. Eastman to reject the electors prior to the joint session of Congress, even though the vice president consistently said he did not have the authority to do so. The third January 6 hearing just wrapped up – laying out the narrative of how President Trump latched onto a theory of how a vice president can usurp the will of the people, and select the President of the United States. This time – the focus was on how former President Donald Trump pressured his vice president to not accept the lawfully presented electors. On January 6, while speaking before the gathered crowds, President Trump said, in regard to the electors, all Pence had to do was “send it back to the states…”. Nonetheless, Pence continued to follow his constitutional duty. Also in today's hearing, former federal Judge Michael Luttig testified he would have laid his body across the road before he would let the vice president overturn the results of the 2020 election. What are your thoughts and feelings? We take calls, and get our guests' thoughts on current Republican lawmakers' responses to all of this after the fact now, and how they're talking about what took place on January 6.
