New confusion over what the CDC is recommending in its effort to slow the surge in COVID cases. The agency is sticking with guidance on how long people should isolate -- but tried to clarify its advice on testing. An average of more than 550,000 americans have tested positive every day over the past week. About 10% of them are in Florida, where the average number of new cases is higher than it's ever been. Chicago public school officials have canceled today's classes after teachers voted to switch to remote learning, due to the surge of COVID cases. Interstate 95 in Virginia is finally clear, after Monday's powerful snowstorm trapped hundreds of people in their cars. Tom's guest today is Congressman Jamie Raskin, who represents Maryland's 8th District, which includes parts of Montgomery, Carroll, and Frederick Counties. Raskin came to national prominence early last year when he was tapped by Speaker Nancy Pelosi to be the lead manager in Donald Trump's second impeachment trial. Trump was charged with “incitement of insurrection” for the purpose of overturning the results of the 2020 election. As Rep. Raskin writes in his new book, although the Senate demonstrated the most bipartisan support ever for conviction in a presidential impeachment trial, Mr. Trump “beat the constitutional spread,” in Raskin's words, and avoided conviction. The final vote was 57-43, 10 votes short of the number needed to convict. Rep. Raskin is a member of the House Select Committee to Investigate the January 6th Attack on the Capitol. The committee has interviewed more than 300 witnesses in private sessions. It plans to hold public hearings in the coming weeks. This Thursday marks the one-year anniversary of the insurrection at the Capitol. But for the Raskin family and legions of their friends, last Thursday marked the one-year anniversary of a terrible tragedy. The Congressman's son, Tommy, a 25-year-old student at the Harvard Law School, succumbed to depression and died by suicide. The riot at the Capitol occurred just a week after Tommy Raskin's death. Jamie Raskin has written a book that weaves the story of Tommy's life into the Congressman's work as the lead impeachment manager, reflecting on his personal anguish, and the national anguish that the country experienced as the very foundations of democratic rule were threatened. The book is called Unthinkable:  Trauma, Truth, and the Trials of American Democracy.  Congressman Raskin joins us on Zoom from his home in Takoma Park. After losing in both the trial and appellate courts, Trump is now seeking to enlist the Supreme Court in his attempt to hide from the House select committee information in the possession of the National Archives regarding his conduct in connection with the January 6 attack on the US Capitol. Given that Supreme Court Justice Sonia Sotomayor recently used the work "stench" to describe the politicization of the Supreme Court, we now await word on whether the Supreme Court will accept review of Trump's latest appeal, thereby giving Trump the delay he seeks and adding to the court's political "stench," or reject Trump's appeal and allow Congress to fully investigate the attack on American democracy so it can put legislative fixes in place to prevent the next attack from succeeding. Eric Kohn, Sam Gregg, and Dan Hugger discuss the progress of the House Select Committee on the events of January 6. Has everyone already formed their conclusions about what happened? Is there anything that could be revealed that would change anyone's mind? Is there any civic good that could come from this? The Omicron variant appears to be more transmissible but less deadly. That's a good development. So why is it prompting renewed talk of school shutdowns, greater lockdowns, and mask mandates that extend forever? Are we perpetually searching for a technocratic solution to a problem that has no actual solution? And finally, Florida Gov. Ron DeSantis has proposed the Stop the Wrongs to Our Kids and Employees (W.O.K.E.) Act to extricate wokeness from schools and businesses. Is this a problem that we can legislate away? The tornadoes that hit the mid-west have left a swath of devastation. Carla complements California's Governor Gavin Newsom for leading the way for the rest of the nation. Liz Cheney outed Mark Meadows who continues to take his cues from the former President, hindering the work of the House Select Committee on the January 6 Attack. Fox News personalities (Sean Hannity, Brian Kilmeade) offered their advice to Mark Meadows as the insurrection exploded on national television, blurring the boundaries between governing and journalism. Laura Ingraham cried out via text that January 6 would "destroy the President's [Trump] legacy!" Carla underscores the imminent threat to democracy and the need to call out the forces currently in play. Senator (Rev.) Raphael Warnock delivers a powerful speech on voting rights. A call for "bi-partisanship" can be a smoke-screen obscuring the issues that lead to legislative progress. The delivery of the new baby, making Carla a grandmother, could happen any day now.
