DOCKET ALERTS:   The House Judiciary Committee wants to change the US Attorney statute to say what Attorney General Bondi claimed it did in court. This would involve the Senate voluntarily surrendering their power to vote on nominees, so … lotsa luck. Back in New Jersey, prosecutors say they'll seek superseding indictments in cases with Alina Habba's name on them, to remove the stink of illegitimacy.   The DOJ has quietly settled a trollsuit filed by red states and rightwing trolls, including Robert Kennedy, alleging social media censorship by the Biden administration. The Supreme Court already dropkicked this case once, so the parties agreed to simply declare victory and go home.   And Sam Bankman-Fried finds new ways to piss off judges and be sooooo weird, this time with help from his mom.   MAIN SHOW:   The DOJ settled a bogus lawsuit filed by former national security advisor Mike Flynn. His malicious prosecution claims had already been tossed by a federal judge, but she let him amend his complaint again, and by then Trump was back in the White House. Is this a new template for MAGA criminals to back the truck up to the Treasury and start filling it with taxpayer cash? The January 6 defendants sure seem to think so! We'll compare a newly filed case by rioters with a suit filed by pardoned Proud Boys.   And we've got a deep dive into the birthright citizenship case Trump v. It is Pride Month, it is primary season, and the Democratic Party is having a moment. Brian and Glennis are back with our third-time guest, political strategist and one of the fastest growing podcasters in the game right now, Keith Edwards, for a wide-ranging conversation about Trump's health, the gerrymandering debate splitting the left, and the Patagonia versus Pattie Gonia trademark war that took over every progressive's Threads feed this week. But first, we have to talk about Maine. Graham Platner, the oyster farmer and Marine veteran running to unseat Susan Collins, is now facing reports that he sexted multiple women early in his marriage, the latest in a string of controversies that includes a covered Nazi tattoo and a pattern of bad online judgment. Brian and Glennis land in very different places on whether any of it matters, and the conversation ends up being less about Platner specifically and more about what Democrats are actually looking for in a candidate right now, and what they are willing to overlook to get there. Then Brian lifts the mood with the Oath candidate of the week: Bobby Pulido, a Latin Grammy winning musician running to flip a gerrymandered seat in Texas by performing at quinceañeras and meeting voters where they actually are. Glennis, reporting from Washington DC, takes us to the White House lawn, where a UFC cage is going up for Trump's 80th birthday. After that, Jared Polis, the Democratic governor of Colorado - who under pressure from Trump - commuted the sentence of Tina Peters. Miss Peters, if you're nasty, was the election denier convicted of tampering with voting equipment. She walked out of prison and went straight to Steve Bannon's podcast to call herself a political prisoner and accuse Democrats of cheating in the midterms. Polis was censured by the Colorado legislature and responded by showing up to a public event with his mouth duct-taped shut. Brian and Glennis are speechless, and then they are not.We also check in on the AI IPO wave, with SpaceX, Anthropic, and OpenAI all signaling public offerings at a combined valuation approaching three trillion dollars, and what that level of speculative concentration in the market actually means for the rest of us.Then Keith Edwards joins the pod. He makes the case that authoritarianism, while real, has not fully landed the way some feared, and that Democrats are in a stronger political position than they have been in a decade. He tracks Trump's health with his signature forensic attention, flags six days without a public presidential appearance, and wonders out loud why the mainstream media is not pressing harder on the story. He and Glennis dig into the Patagonia versus Pattie Gonia lawsuit, the online mob dynamics that made it impossible to read clearly at first, and why trademark law exists to protect small businesses too, not just outdoor apparel giants. And he and Brian go back and forth on gerrymandering, with Brian now firmly in the outcomes camp and Keith holding the line on means. Also, Keith did not respond to Pattie Gonia's DMs. Glennis is wearing what may or may not be a Proud Boys jacket. Brian does his Rick Devens impression. And the gang has some things to say about Susan Collins' continued presence in the United States Senate. If you are enjoying the show, leaving a review wherever you listen goes a long way and helps more people find us. Circuit to appoint adversarial counsel to fight the dismissal. In response, Proud Boy defendant Zachary Rehl has filed his own counter argument, pro se, and my buddy Bill Shipley has filed his own counter argument in defense of his client Oath Keeper Robert Minuta. Rehl's argument comes across as personally compelling, while Shipley brings the technical legal expertise one would expect of a career DOJ prosecutor who went on to defend more than 90 January 6 defendants. We'll break down both of those in today's show!Join me LIVE at 11 AM ET!Episode #1303.

Today's Headlines: The Department of Homeland Security is threatening to cut customs staffing at major international airports in sanctuary cities like New York, LA, Chicago, and DC — which would affect not just tourism but cargo shipments and the broader economy — because DHS Secretary Markwayne Mullin apparently thinks international trade can just reroute to Florida. Trump, meanwhile, said he's "in no hurry" to end the Iran war while also telling reporters he might skip his own son's destination wedding in the Bahamas because of "this thing called Iran," which is either a convenient excuse or the most relatable thing he's ever said. The Traitor Fund — formerly known as Trump's $1.776 billion slush fund — is getting wilder by the day: Proud Boys leader Enrique Tarrio wants $2-5 million, Mike Lindell is asking for $400 million, a January 6th rioter who compared herself to Jesus during sentencing wants $10 million, George Santos might file, and the couple who pointed guns at BLM protesters is reportedly interested. Acting AG Todd Blanche went to Congress to lobby Republicans not to block the fund — and offered to cut them in on it, specifically noting that senators whose records were secretly subpoenaed are eligible to file claims, which is a sentence that exists. The Senate responded by going home for a few weeks rather than dealing with it, which is technically a dereliction of their constitutional duty to approve funding, but here we are. Mortgage rates also hit a nine-month high this week at 6.51%, Trump is claiming he can build his DC arch without congressional approval, and a design commission approved the arch's look, which is one of many steps still required — Congress included, no matter what Donald says. On the Epstein files, Jeffrey Epstein's former personal assistant Sarah Kellen testified before the House Oversight Committee in a session described as deeply informative and genuinely harrowing — revealing she was recruited at 21, sexually and psychologically abused by Epstein for over a decade, and was "being paid in part to be raped." She also told the committee that the federal government included her name in Epstein's 2008 nonprosecution agreement without ever speaking to her, effectively branding her a criminal in a secret deal made with her own abuser. Trump Plummets in Polls with Independents, $5 Gas, and War With Iran He Can't Spin. We're Not The Spoilers! The Surging Knicks. $1.8B for Insurrectionists and Violent Proud Boy Extremists? Is Cuba Next? Memorial Day Pain is a Reminder. The Real Spoilers are the Parties. Thank you, Stephen Colbert.  Trump is in the 20s with independents, gas is over five bucks a gallon in some states, Memorial Day is about to remind Americans of the human cost of his Iran war, and Cuba is looming over the horizon. Meanwhile the administration is funneling what looks like $1.8 billion in taxpayer money to January 6 insurrectionists and violent Proud Boy extremists — including a reported $2-to-5 million ask from Enrique Tarrio. Paul Rieckhoff calls it Plan C: if the military won't invoke the Insurrection Act and ICE can't carry the water, you green-light the angry mob and promise pardons in advance. This is what corruption looks like, and it's the most immediate threat to free and fair elections this fall. In this special quick-fire episode, Paul takes you out of the studio and into the streets of Midtown Manhattan with highlights from two back-to-back media hits — one left of center on MSNOW, one right of center on NewsNation — same independent read on both. He breaks down why ten thousand Americans are walking out of the Republican and Democratic parties every single week, why Thomas Massie just got elevated by Trump's attacks, why the Democrats are the actual spoilers in Senate races in Nebraska, Montana, and South Dakota, and why the rigged two-party system is finally cracking. Like a foreclosure auction, except the property is a democracy and the bidders live in a different country. This week, Thomas Massie, a seven-term Republican who voted with Trump 94% of the time, was primaried out of Congress in the most expensive House primary in U.S. history. His crime? Pushing the Epstein files. Fighting the war in Iran. Introducing a bill to make AIPAC register as a foreign agent. His replacement is a man with no public platform, no public birthday, and $34 million in outside money from pro-Israel lobbying groups and three billionaires who have never been to Kentucky.Meanwhile: The DOJ created a $1.776 billion taxpayer-funded "Anti-Weaponization Fund" that could pay out January 6th defendants, Proud Boys, and Oath Keepers, and gave Trump permanent IRS audit immunity as a bonus. The legal architecture that turned 7% Black voter registration in Mississippi into 60%—dismantled, decision by decision, by a Supreme Court that was never neutral and was never on our side. But that's not even the whole story. Because while the courts were killing the VRA, the Justice Department was being turned into a weapon. FBI agents raided a Black state senator's office mid-day—Fox News already on the scene—while allies under federal investigation had their evidence destroyed. Ballots from Fulton County are in federal custody. Arizona. Michigan. They are building the architecture of election interference before the midterms. In public. Two major rallies are set to take place just one mile apart in central London this weekend but politically, culturally and ideologically - they could scarcely be further apart. On one side is Tommy Robinson's “Unite The Kingdom” march, presented by organisers as a demonstration about British identity, immigration and national culture. On the other is a large pro-Palestine march, whose organisers say they are protesting racism, war and the rise of the far-right. The competing demonstrations come amid growing political polarisation in Britain, following dramatic local election results that saw major gains for both Nigel Farage's Reform UK and the Green Party. It is safe to say populist movements on both the right and left are reshaping British politics, with tensions over immigration, Israel-Gaza, national identity and free speech increasingly dominating public debate. Piers Morgan is joined by host of The Crucible, Andrew Wilson, founder of The Proud Boys, Gavin McInnes, leader of Advance UK, Ben Habib, Green Party activist & Birkbeck University associate professor, Ashok Kumar, and political commentator with Joe, Ava Santina, to discuss. The Supreme Court waives its standard thirty-two day hold and immediately remands the Louisiana redistricting case back to the lower courts, clearing the path for maps to be redrawn before the midterms while the ACLU files an emergency motion using arguments that directly contradict what their own attorneys argued in Virginia. Georgia's Brian Kemp continues to refuse compliance, and Ghost unpacks exactly what that signals about his ambitions. The Democrat Party's structural collapse is mapped out in detail: funding drying up, 24-plus House seats in redistricting jeopardy, and Maine's incumbent governor dropping out for lack of money. A federal magistrate judge apologizes on the record to Cole Allen, the White House Correspondents' Dinner shooter, while comparing his conditions favorably to J6 defendants. CannCon and Ghost dismantle the double standard in real time and ask why Jocelyn Ballantyne, who prosecuted Flynn and the Proud Boys, is still at DOJ. Plus, the DOJ indicts 10 current and former Mexican government officials for Sinaloa cartel ties, Mexico's president refuses extradition, and Ghost explains the UAE's OPEC exit and why oil prices are about to drop.

The Proud Boys is a far-right neo-fascist organization that admits only men as members and promotes political violence. It is based in the United States and has a presence in Canada, Australia, and the United Kingdom. The group was started in 2016 by Vice Media co-founder and former commentator Gavin McInnes, taking its name from the song "Proud of Your Boy" from the Disney film Aladdin. Proud Boys emerged as part of the alt-right, but in early 2017, McInnes began distancing himself from the alt-right, saying the alt-right's focus is race while his focus is what he defines as "Western values". This re-branding effort intensified after the Unite the Right Rally. The group sees men — especially white men — and Western culture as under siege; their views have elements of white genocide conspiracy theory. On January 6th, 2021, Pam Hemphill followed the Proud Boys to the Capitol, got trampled by the mob, was carried out by a police officer named Joe, and recorded every minute of it. The internet called her the MAGA Granny. She did 60 days in federal prison. And then, slowly, she woke up. When Trump issued sweeping pardons for more than 1,500 January 6th defendants, Pam did something almost no one else did. She said no. She filed a formal letter of rejection, returned to the Capitol to apologize to officers in person, received death threats, lost a 12-year relationship, and kept talking anyway. In a series about people who got pardons they didn't deserve, Pam Hemphill is the one who deserved consideration and walked away from it anyway. You've heard about January 6th. Mary and Andrew begin this week by welcoming former Assistant US Attorney Sunita Doddamani. A 20-year civil servant with an impeccable record of service, Sunita is one of the prosecutors who was recently fired as part of the DOJ's report about the prior administration's so-called “bias” against abortion protesters and religious rights in FACE Act cases. She talks openly about the "Article II" termination letter she received from Acting Attorney General Todd Blanche, with no warning and like many others, seemingly just for doing her job by taking the cases assigned to her. From there, Andrew and Mary look at the administration's moves to vacate the convictions of four Proud Boys who were convicted of multiple felonies related to the attack on January 6th. Then, on to a significant decision from Judge Mehta in a long-running civil lawsuit brought against Trump, finding that the president's January 6th speech was political rather than official in nature, which would rule out immunity for official acts. And before they wrap up, the co-hosts take up the latest ruling on Judge Boasberg's contempt inquiry into whether government officials violated his court orders around those deportation flights in March of 2025. Trump is a vengeful god… Or at least he plays one on TV, which as far as the Trump administration is concerned, is exactly the same thing. Donald is of the opinion that the Pope's God is a low-IQ loser, which as far as MAGA is concerned, all opinions are equal and just like facts, and everyone's allowed to have one, not just some "Vicar of Christ" elite. Every generation gets the Axis of Evil they deserve. This time, Dems come out against the Rapture, at least under Trump's timeline. Trump is a forgiving god. He supplied Byron Noem's beard with a beard in her time of need. Now his DOJ has moved to erase the convictions of Proud Boys and Oath Keepers who led the Jan. 6 attack, some of whom will require more forgiveness than others.

Today's Headlines: Trump is reportedly ready to declare victory in Iran and walk away — even if the Strait of Hormuz stays closed — because keeping it open would exceed his preferred timeline. Gas prices with a 4 or 5 as the first digit are the new normal, indefinitely. The U.S. simultaneously sent a third aircraft carrier to the region. Then the IRGC published a target list of 18 American companies — Apple, Google, Microsoft, Meta, Nvidia, Tesla, Oracle, Palantir, Chase, and Boeing among them — with strikes planned starting April 1st, prompting immediate evacuations of employees and anyone within a kilometer of their facilities. January 6th insurrectionists — including a pardoned Proud Boy who threw chairs at officers and a man convicted of child molestation after receiving his pardon — filed an $18 million class action lawsuit against the federal government for excessive force during the insurrection. With the DOJ already paying Babbitt's estate $5 million and Flynn $1.25 million, the math isn't crazy. On transvisibility day, the Supreme Court ruled 8-1 to strike down Colorado's conversion therapy ban for LGBTQ minors — a ruling that will overturn similar bans in 20+ states, with Ketanji Brown Jackson the lone dissent. Additionally, the Daily Mail published allegations that Kristi Noem's husband has been living a secret cross-dressing double life. Noem's team says she's "devastated and blindsided." In Shit With Trump's Name On It: a federal judge blocked the $400 million White House ballroom, ruling Trump is the "steward" not the "owner." Palm Beach airport was renamed Donald J. Trump International — the only one named after someone twice impeached and convicted of 34 felonies. Eric Trump unveiled a Miami skyscraper presidential library. A guerrilla art group installed a gold marble toilet on the National Mall with a plaque reading "A Throne Fit for a King." Finally, NASA's Artemis II launches tonight at 6:24pm ET — first lunar mission since 1972, no landing, just a test run for 2028 and an Army Apache was caught hovering over Kid Rock's pool after detouring from a No Kings protest flyover. Kid Rock said they'd be fine because his "buddy is the Commander-in-Chief." But after being silenced by the Oath Keepers leader, Stewart Rhodes, for his support of same-sex marriage, Van Tatenhove distanced himself from the group.
