Legal Weed’s Advances and Lawsuits to Overturn Them. Paul Armentano, Deputy Director of NORML, talks about how and why lawsuits have been filed in three of the five states where some form of marijuana was legalized on Nov. 3rd. First the whyArmentano called these lawsuits frivolous attempts to undermine the democratic process. “Since 1996 when California legalized medical marijuana, voters in 35 states have gone to the ballot box to legalize adult-use or medical cannabis. Where they have done that, they’ve been successful. The reality is: when we are given the chance to vote for legal marijuana, we win.” In addition to the unprecedented actions of trying to overturn the will of the voters, opponents of legal marijuana have also tried to kick the issue off the ballot before it even got there. That tactic was unsuccessful in Arizona and unfortunately, it worked in Nebraska.  Sound familiar?Invalidating legally cast ballots after the elections seems to be the tactic de jour of losing opponents. Regardless, Armentano doesn’t think it will work. “They (prohibitionists) have lost the hearts and minds of the American people on this issue. There’s now a supermajority in this country who believe that marijuana should be legal and will continue to vote for it.”The new administration in the White House Vice President-elect Kamala Harris has said the Biden administration would decriminalize marijuana and automatically expunge all marijuana use convictions and incarcerations. Harris has also been the chief sponsor of the Marijuana Opportunity, Reinvestment and Expungement (MORE) Act in the Senate.  Armentano thinks that once cannabis is removed from its Schedule l spot on the DEA’s list of Controlled Substances and dealt with under the jurisdiction of individual states, like alcohol, the incoming Democratic administration will back that sort of cannabis reform…so long as the prohibitionists and obstructionists don’t stand in the way.

Marijuana and marijuana policy with Paul Armentano. Paul is the deputy director of the National Organization for the Reform of Marijuana Laws (NORML) and the NORML Foundation in Washington, D.C. Armentano has written on the subject of marijuana and marijuana policy. His work has appeared in over 200 publications, including more than a dozen textbooks and anthologies, and he is a frequent contributor to AlterNet, High Times, The Huffington Post, and the Washington, D.C. newspaper The Hill. Armentano is a 2008 recipient of the 'Project Censored Real News Award for Outstanding Investigative Journalism' and was selected as one of America's 'Top 20 Young Visionaries' by Who Cares Magazine, a national quarterly journal devoted to community service and social activism. He has co-written a book about cannabis and social policies, Marijuana is Safer: So Why Are We Driving People to Drink?, which was published in 2009 through Chelsea Green Publishing.

Green Zone Japan with Naoko Miki and Yuji Masataka. The two of them founded Green Zone Japan as a medical cannabis advocacy group. Its main focus is bringing evidence-based, accurate and up-to-date information on medical cannabis to Japanese medical professionals and the general public. Naoko Miki, Green Zone Japan's Program Director, is a translator by trade. She first became interested in medical cannabis when she translated one of Peter McWilliams' books, "LOVE 101," and learned the circumstances of his death. In 2010, Naoko translated "Marijuana Is Safer" by Mason Tvert, Steve Fox and Paul Armentano (who has been a guest on this show), and created an FB page for the book where she started advocating for legalization in Japan.

On January 4th, 2018, Attorney General Jeff Sessions rescinded Obama-era policy instructing federal prosecutors not to prioritize prosecutions against violators of federal drug laws in states that had decriminalized marijuana at the state level. This announcement came days after new legalization measures took effect in California. While many states have legalized at the state level, the drug is still illegal everywhere in the United States under federal law. On Lawyer 2 Lawyer, host, Craig Williams joins Paul Armentano, deputy director of NORML and Paul Larkin, senior legal research fellow for the Heritage Foundation's Meese Center for Legal and Judicial Studies, to discuss Attorney General Jeff Sessions' efforts to rescind the Obama-era policies on marijuana, the impact on state’s marijuana legislation, and how this announcement will impact marijuana litigation and the marijuana business. NORML (National Organization for the Reform of Marijuana Laws) deputy director Paul Armentano joins PanAm Post English editor David Unsworth for a discussion of Jeff Sessions recent repeal of the Cole Memo, which prohibited the Justice Department from using federal resources to prosecute the production or consumption of marijuana in states that have legalized marijuana. Armentano sees an immediate backlash for the Trump administration, and suggests that Republicans will target state marijuana laws at their own peril. Ultimately, he holds out hope for a bipartisan approach to ending federal marijuana prohibition, noting that polls consistently reveal that voters in both parties are no longer enthusiastic about treating marijuana as a criminal justice matter. Several bills are currently working their way through Congress that seek to end classification of marijuana as a Schedule I drug, and treat marijuana as a public health, not a criminal justice matter. Ultimately, the principles of self-ownership and non-aggression are key to changing the philosophical mentality of politicians on both the left and the right that seek to regulate the behavior of adults in the privacy of their own homes. Americans should be free to make their own decisions for their own lives as long as they do not violate the Constitutional or human rights of others.

What does this year hold for legal cannabis in America? Adding to this confusion is our new President and Attorney General offering confusing messages about the plant, and about federal involvement in state sanctioned marijuana programs. Today, Mr. Armentano addresses what he describes as the ignorance and political apathy on the part of lawmakers, and political inertia that continues to maintain this flat earth policy regarding federal legalization and scheduling. But what does the science and research really show? Mr. Armentano shares with Dr. Kelly today some of the common misconceptions about cannabis, as well on going research on its public health benefits (including helping curb the opiate epidemic). Listen NowThis past November, voters in seven states legalized marijuana either for medical or for recreational use.  Twenty-nine states have now legalized cannabis for medicinal use (and of these eight, along with the District of Columbia, for recreational use).   Despite growing state legalization, the debate concerning marijuana's health effects continues.  Recently, the National Academy of Sciences (NAS) published an extensive scientific review of research literature published since 1999 to reach nearly 100 conclusions about its therapeutic benefits including in the treatment for chronic pain in adults, chemotherapy-related nausea and vomiting and Multiple Sclerosis-related spasticity.  Despite state approval and demonstrated health benefits, at the federal level, marijuana is still classified as a Schedule I controlled substance (along with, e.g., heroin), and its use illegal.  Mr. Paul Armentano is the Deputy Director of NORML, the National Organization for the Reform of Marijuana Laws.  He is also a faculty member at Oaksterdam University in Oakland, California.  His is the author of over 200 publications including more than a dozen contributions to textbooks and anthologies.  His most recent book-length work is, The Citizen's Guide to State-by-State Marijuana Laws (2015) and he is co-author of the 2013 volume, Marijuana is Safer: Why Are We Driving People to Drink?  Mr. Armentano was the principle investigator for the defense counsel in US v Schweder, the first federal evidentiary hearing since 1973 to challenge the constitutionality of cannabis as a Schedule I controlled substance.  He also served as an expert in a successful Canadian constitutional challenge, Crown v. In a recent decision, the Drug Enforcement Administration ruled that marijuana will remain a Schedule 1 substance under the Controlled Substances Act. Substances in Schedule 1 are determined by the Food and Drug Administration to be drugs with no currently accepted medical use and a high potential for abuse.   On Lawyer 2 Lawyer, host J. Craig Williams joins Paul Armentano, deputy director of NORML and Ben Cort, business development manager for the Center for Addiction Recovery and Rehabilitation (CeDAR), to discuss the recent decision by the DEA to keep marijuana on the Schedule 1 list. Paul Armentano is the Deputy Director of NORML and the NORML Foundation. Recently reports proliferated that in the House of Representatives, during the government shutdown, while meeting late into the night, the smell of booze was rampant.  Perhaps if they had been smoking pot, instead of drinking alcohol, the government would never have been shut down and there might be a whiff more bipartisanship.Sound ridiculous? Well if it had been the Colorado or Washington legislature, it might very well be the case.  In fact the legalization of marijuana seems to be an idea whose time has come.
