The Boston City Council held a hearing yesterday on a proposed law that would ban the wearing of masks meant to conceal a person’s identity in public, The ban is in response to violence against police by masked protesters during the so-called Straight Pride Parade event earlier this year. The law is being proposed by Councilor Timothy McCarthy who says the ordinance would cover wearing a “mask, hood or other device” designed to “conceal a portion of one’s identity” on public or private property, but not apply to “traditional holiday costumes" nor a variety of professional, medical and religious exemptions. Is this a good idea?

Boston City Councilor Tim McCarthy is advocating for the banning of masks at public gatherings as it presents a public safety concern. This comes after masked protesters at the Straight Pride Parade a couple weeks ago, were carrying out violent acts against police while demonstrating their dislike for the parade. The Supreme Judicial Court today ruled in favor of Suffolk County District Attorney Rachael Rollins against a Boston Municipal Court judge who denied her efforts to drop charges against a Straight Pride parade protester. In the underlying case, Judge Richard Sinnott denied the prosecutors’ request to drop the prosecution of Roderick Webber who was charged with disorderly conduct after being arrested in the Aug. 31 Straight Pride Parade. The single justice held “Fundamentally, the judge had no authority to “deny” the Commonwealth’s entry of a nolle prosequi." Was this a good decision?
