The U.S. Department of Labor recently released its proposed rule that updates its definition of an independent contractor (IC) under the Fair Labor Standards Act. This proposed rule proves what we already knew to be true: the DOL strongly favors finding a worker is an employee vs. an IC, making adhering to compliance with IC status rules more critical now than ever. In this brief but information-packed podcast, our host, Nick Hancock, chats with Openforce General Counsel Doug Grawe to learn more about what the new DOL rule actually is and what it means for transportation companies that utilize independent contractors. Although AB5 was signed into law in 2019, it resurfaced again when the U.S. Supreme Court declined to take the California Trucking Association's challenge to California's AB5 independent contractor status test. Which means AB5 still stands, even in transportation. This is not ideal for drivers who want to be independent and for companies that like the service they receive from independent contractors. However, this is not the end of independent contractor work as we know it. The impacts of the gig economy are impossible to ignore. 68 million people were, at least for one shift, self-employed in 2021. Economists predict that the majority of the workforce will be independent contractors by 2027. This means the insurance industry must evolve with the new American dream to protect everyone's best interests. At the forefront of this movement is Matthew Bagley, Vice President of Crum & Forster's Accident & Health Division. Our host, Nick Hancock, interviews Matthew about this shift in the economy and the role technology plays in managing insurance for independent contractors and gig workers. Matthew shares his insight for business owners who engage with ICs on how to find partners and providers that remove burdens from management and drive the business forward. About Truckers Against Trafficking Truckers Against Trafficking (TAT) is a 501(c)3 that exists to educate, equip, empower and mobilize members of the trucking, bus and energy industries to combat human trafficking. Modern-day slavery, or human trafficking exists whenever people are bought and sold for forced labor or commercial sex. Around the world, it is estimated that there are over 40 million slaves today. Human trafficking has been reported in all 50 states, and the number of victims in the United States is estimated in the hundreds of thousands. While illegal, human trafficking is a booming business. Traffickers recruit out of our schools, online, in shopping malls, as well as the streets and other locations. A large percentage of the people trafficked are women and children. Many of them are used in the sex industry. They are the prostituted people on the street and in private homes, and in legitimate businesses such as restaurants, truck stops and motels. They need to be identified and recovered. Truckers Against Trafficking recognizes that members of the trucking, bus and energy industries are invaluable in the fight against this heinous crime. As the eyes and ears of our nation's highways, you are in a unique position to make a difference and close loopholes to traffickers who seek to exploit our transportation system for their personal gain. Being a typical big brother, he made Rob do most of the work! In 1976, from his dorm room at Siena College, Rob started his first courier company L.E.D.F.O.O.T Express (Light Express Deliveries for Operating On Time). In 1980 Rob served as the Transportation Manager for the 1980 Winter Olympics in Lake Placid. 14 years later, his 17-office, 700-driver courier operation went public on the NY Stock Exchange along with several industry friends as US Delivery. In 1996 Rob invested in a startup, SCI. In 1999 Rob became the Senior VP of NextJet out of Dallas, TX, and left in 2001 to become active with SCI, serving as President and COO for over 16 years. He is the recipient of the CLDA Distinguished Service Award and was inducted into the Courier Hall of Fame in 2002. Doug Grawe, General Counsel at Openforce For Doug, law school essentially changed the way he analyzed problems which has proven to be an invaluable skill for corporate transportation companies over the last 17 years. A quick study, Doug grew most of his career with Dart Transit Company, one of the top-performing and established trucking companies in America. Dart is known for building one of the best owner-operator business models, where Doug had the opportunity to learn from some of the great industry pillars. From there, Doug founded the Grawe Group, LLC, a law and consulting firm specializing in transportation. He has advised several businesses to help them achieve their goals through practical, sustainable risk management solutions. Doug thrives on serving as a partner to transportation business leaders and collaborating with them to figure out solutions, not just telling them what they can and cannot do. Doug attended Iowa State University and holds a law degree from Hamline School of law. He is currently a board member for the Minnesota Trucking Association and chair of its Government Affairs Committee. Believing rules are made by those who speak up, Doug is active on a variety of policy issues impacting the transportation industry, but most notably protecting the rights of drivers to choose independence or employment in the transportation industry. Doug has written many trade articles on the independent contractor issue and submitted amicus briefs to the U.S. Supreme Court to protect the rights of drivers and carriers to choose. At the age of 23, he quickly became one of the youngest store managers in its history. With experience and drive, he mastered customer service, sales, merchandising and management skills as he climbed the corporate ladder. After ten years with The Home Depot and two years with Lowe's Home Improvement, Giaccone realized that the demand for assembled merchandise was growing. He observed that with assembled displays, products like grills, mowers, and patio furniture sold more quickly than their non-assembled counterparts. Assembly service companies were already in place, but they simply did not meet the demand of the stores Giaccone managed. So he created Assemblers, Inc. About Assemblers Inc. Founded in Chattanooga, TN in 1998, Assemblers, Inc. has grown into a nationally recognized company with retailer partnerships across the United States.
