Judge Nkosinathi Chili has dismissed former president Jacob Zuma's argument that he cannot be tried by prosecutor Adv. Billy Downer. Former President Jacob Zuma was back in court this morning to hear Judge Nkosinathi Chili's reasons why he refused to approve the removal of lead prosecutor, Billy Downer. Zuma's defense lawyers have indicated that they would file an appeal. Judge Nkosinathi Chili of the Pietermaritzburg High Court has refused Advocate Dali Mpofu's demand that State Advocate Billy Downer and journalist Karyn Maughan sit in the dock during today's court proceedings. The former president's private prosecution of state prosecutor Advocate Billy Downer and journalist Karyn Maughan is continuing. Zuma is charging them with leaking a confidential doctor's letter during his arms deal fraud and corruption trial. Today's appearance comes as Zuma has filed for leave to appeal in the Supreme Court of Appeal against a High Court ruling that set aside the private prosecution. In the run-up to their last appearance in August, Downer and Maughan obtained a court order that first ruling be executed pending an appeal. Zuma lost that case and is now approaching the Constitutional Court.  SABC reporter, Nonkululeko Hlophe has more.

Reacting to judgment in the President Cyril Ramaphosa and former president Jacob Zuma court case, former ANC member Carl Niehaus said the judiciary will lead the country to collapse. Ramaphosa had applied to the Johannesburg high court to set aside his prosecution as unconstitutional and unlawful. He asked the court to interdict any “further steps” in pursuing the prosecution and to excuse his appearance in court on January 19, as demanded by the former president. Zuma filed a case against Ramaphosa, arguing he is an “accessory after the fact” in relation to charges Zuma is pursuing against prosecutor Billy Downer and journalist Karyn Maughan. The court granted Ramaphosa the interdict which means he does not have to appear in the dock on Thursday. Jacob Zuma Foundation spokesperson Mzwanele Manyi said their suspicions were vindicated by the appointment of three judges instead of one. Manyi had said the appointment of a full bench confused and intrigued the foundation.

President Cyril Ramaphosa wants the Pretoria High Court to issue an order declaring the summons served on him by his predecessor Jacob Zuma for his private prosecution unlawful, invalid, and set aside. On Monday, Ramaphosa filed papers in court seeking an urgent hearing, listing Zuma, the director of public prosecutions in KwaZulu-Natal, the National Prosecuting Authority (NPA) and the High Court Registrar in Johannesburg as respondents in the case. Ramaphosa wants an interdict to prevent the respondents from giving effect to the NPA's nolle prosequi certificate and the registrar's summonses issued on 15 and 21 December. Despite allegations of improper conduct against Billy Downer, Zuma has instituted a private prosecution against Ramaphosa. Prof Andre Duvenhage, a political analyst, joined Mufti Yusuf Moosagie this morning to provide an analysis of the case.

The charge will likely lead to calls by Ramaphosa's political opponents that he must “step aside” in line with the ANC's step-aside rule and not stand for president of the  ruling party. In terms of the rule, when an ANC member is charged with a serious criminal offence, they should step aside from their position. In a statement issued in the early hours on Friday  the presidency said Ramaphosa rejected the prosecution “with the utmost contempt”.

The judge presiding over former president Jacob Zuma's arms deal-related trial has indicated he is considering recusing himself. Judge Piet Koen has given the parties until November 3 to file submissions in this regard,  and has adjourned the trial to January 30 next year. The judge first raised the issue of his possible recusal on Monday when the state argued the trial should proceed in early November. This was opposed by Zuma's lawyers, who pointed to the fact their client had lodged an appeal with the Constitutional Court against Koen's ruling, in a “special plea” by Zuma,  that lead prosecutor Billy Downer had “title to prosecute” him and any allegations of bias should be dealt with during the trial. In that ruling he also dismissed Zuma's complaint that Downer had “leaked” court documents containing Zuma's confidential medical records to journalist Karyn Maughan. Zuma has initiated a private prosecution against Downer and Maughan, and indicated he will again fight to have Downer removed from the trial on the basis he cannot be prosecuted by someone he is prosecuting.

Former President Jacob Zuma has launched a Constitutional Court appeal application aimed at ensuring his prosecutor Billy Downer's removal and his acquittal on Arms Deal corruption charges – days before his trial is due to resume. Late last month, the apex court unanimously dismissed the former president's arguments that then Supreme Court Appeal President Mandisa Maya had grossly misdirected herself by refusing to reconsider his failed legal bid to force Downer's removal. Maya had found there were no exceptional circumstances justifying her reconsidering her court's previous dismissal of Zuma's attempted challenge to Pietermaritzburg High Court Judge Piet Koen's ruling that Downer had the title (legal standing) to prosecute him. Zuma has since launched a private prosecution against Downer and journalist Karyn Maughan for allegedly violating the National Prosecuting Authority (NPA) Act through the sharing of court documents submitted by his own lawyers and the prosecution, which contained a note from one of his doctors. Maughan received the documents from advocate Andrew Breitenbach SC, who was acting for the NPA. Zuma contends that his medical information was leaked, despite the fact that he failed to claim confidentiality when he filed the letter to the court. Koen found that the letter was submitted to Downer “without any specific restrictions as regards confidentiality”. The judge further held that the letter was vague and general and did not disclose anything that could be said to amount to a violation of Zuma's rights. Zuma is now seeking to challenge that ruling. He argues that Koen failed to consider “the impact of the alleged criminal acts and prosecutorial misconduct by the prosecutor in conjunction and in concert with those associated [with] the institution assigned to conduct the prosecution on behalf of the State, the National Prosecuting Authority on the requisite title to prosecute and my guaranteed constitutional rights”. Should he convince the apex court that Downer lacks the title to prosecute him, Zuma argues, “then I would be entitled to demand an acquittal”. “The implications of this application and/or appeal upon my rights are therefore far-reaching."

When former president Jacob Zuma appears in court in his arms deal-related fraud and corruption trial, he sits in the dock at the Pietermaritzburg high court. On Monday lead prosecutor in the case Billy Downer and seasoned News24 journalist Karyn Maughan found themselves sitting in that very same dock on the first day of Zuma's “private prosecution” of them. This follows allegations that they broke the law when Downer “leaked” court documents to Maughan which disclosed his private medical condition. Zuma sat with his lawyers. Both Downer and Maughan have filed applications — to be heard by a civil court judge — in a bid to have the charges dropped, both claiming an abuse of process. The two applications, it emerged on Monday, will now be heard together in early December — and the private prosecution will be put on hold until the outcome of those, in early February.

Former president Jacob Zuma's private prosecution of News24 specialist legal journalist Karyn Maughan and senior State advocate Billy Downer got under way in the KwaZulu-Natal High Court in Pietermaritzburg on Monday. The matter was adjourned to 2 February 2023, with an urgent application by Maughan to be heard in December. Maughan's urgent application was postponed due to a conflict of interest on the part of Judge Rishi Seegobin. He did not elaborate on what these are. Downer has launched his own application to have the private prosecution declared an abuse of court processes. The applications by Maughan and Downer will not be joined, but are likely to be heard one after the other. During Monday's proceedings before Judge Nkosinathi Chili, Zuma's advocate Dali Mpofu conceded that the private prosecution was "unique" and "even strange" for him as a legal practitioner. He said it was also "unique" because Zuma, a former president, was the private prosecutor. Mpofu said Zuma had put down a R500 000 deposit to continue with the prosecution. Advocate Wim Trengove SC, representing Downer, told Chili they had launched an application against the private prosecution and would ask the court to hear it. Zuma has accused Maughan of colluding with the State to publish his medical records without his permission. Zuma wants Maughan's urgent application to be dismissed, arguing that he was entitled to prosecute the journalist. The charges against Maughan and Downer relate to News24's publication of an update on Zuma's medical condition. The medical document was attached to court papers lodged at the High Court in 2021. Documents filed with the court are deemed to be public records unless a judge instructs otherwise. There was no instruction in this instance. It didn't reveal details of Zuma's condition. Last month, Maughan filed an urgent application asking the court to set aside Zuma's prosecution. She argued that the summons issued against her by Zuma's legal team was a gross abuse of court processes and, therefore, should be thrown out. She said the former president had not obtained a nolle prosequi (a Latin phrase that translates to "not wishing to prosecute") certificate from the Director of Public Prosecutions to entitle him to institute a private prosecution against her. In addition, she said Zuma lacked standing to institute the private prosecution. "He has no substantial and peculiar interest in the issue of the trial since he has personally suffered no injury as a consequence of the offence he alleges I have committed."

Former president Jacob Zuma has failed to convince the Constitutional Court that Mandisa Maya, the former head of the Supreme Court of Appeal, grossly misdirected herself by refusing to reconsider his bid to force the removal of prosecutor Billy Downer from his corruption trial. The apex court unanimously dismissed Zuma's argument that Maya - who President Cyril Ramaphosa has since appointed as the deputy chief justice - grossly misdirected herself when she found there were no exceptional circumstances justifying the reconsideration of her court's dismissal of Zuma's challenge to a ruling that Downer had the title (legal standing) to prosecute him. Zuma had also asked that the Constitutional Court to grant him leave to appeal Judge Piet Koen's dismissal, in the KwaZulu-Natal High Court in Pietermaritzburg, of his special plea to the Supreme Court of Appeal. While stating that it had not decided whether Maya's decision was, in fact, appealable, the country's highest court said it had "concluded that it would not be in the interests of justice to grant leave to appeal" Maya's decision, given that Zuma would be entitled to seek leave to appeal Koen's decision "to this court". Zuma's foundation tweeted on Thursday that the ruling confirmed the former president "can exercise his right to appeal the adverse decision of the High Court to the Constitutional Court", but did not confirm that he would, in fact, do so. Zuma is due back in court on 17 October. He is pursuing a private prosecution against Downer and News24 journalist Karyn Maughan, who are both are challenging it as an abuse of court process.

State advocate Billy Downer wants former president Jacob Zuma to put up an additional R1-million as security for costs ahead of his private prosecution of Downer. Zuma launched the private prosecution against Downer and News24 journalist Karyn Maughan and has apparently already deposited R90 000 at the Pietermaritzburg Magistrate's Court as security. But Downer said in papers filed in the KwaZulu-Natal High Court in Pietermaritzburg, that R1-million was necessary to "provide security that is sufficient to meet the probable costs which may be incurred in respect of my defence in the private prosecution" if the prosecution fails. Downer said he and the National Prosecuting Authority (NPA) had engaged the services of senior counsel and two junior counsels for his defence. The senior counsel's charges in the matter amount to R54 000 per day and R5 400 per hour, and the combined charges of both junior counsels are R45 000 per day and R4 500 per hour. Therefore, Zuma should fork out an additional amount as security for private prosecution, he submitted. The security should either be paid in cash or be provided using a bank guarantee, he added. "I submit that in the circumstances, a bank guarantee is not only required to secure the additional amount but that it is necessary due to the fact that this court has, as recently as August 2022, granted the curator of VBS Mutual Bank an execution order for the private prosecutor's outstanding debt that is due to VBS Mutual Bank. "I have no confidence that the private prosecutor will in future be able to settle the costs incurred for my defence in the absence of the security that I require." In an interview with Newzroom Afrika in June, Gerrie Nel, the head of AfriForum's private prosecution unit explained that Zuma would have to deposit guarantees for the costs of the accused in the matter "should the prosecution fail". The charges against Downer and Maughan relate to News24's publication of an update on Zuma's medical condition. The update was attached to court papers lodged at the High Court last year. But Zuma contends that it violated sections of the National Prosecuting Act. The former president was granted medical parole by then head of the correctional services department, Arthur Fraser, shortly after he was incarcerated in July 2021. Zuma's legal team claims Downer leaked the information to Maughan. The summons was served on Maughan and Downer this month, and they are expected to appear in the KwaZulu-Natal High Court in Pietermaritzburg on 10 October 2022. Zuma was in prison to serve a 15-month sentence for contempt of court after he refused to comply with a Constitutional Court order to appear before the State Capture Inquiry. He was sent to the Estcourt Correctional Centre. However, a month later, Brigadier Mcebisi Mdutywa wrote a letter informing prison and prosecuting authorities that Zuma had suffered a "traumatic injury" in November 2020 and needed "extensive emergency treatment" with six months to recover. Maughan wrote about the letter because it was part of court documents that had already been filed, making it public record. In June this year, Zuma cited Downer and Maughan as respondents in his court papers, and the NPA issued a nolle prosequi certificate, declaring that it would not prosecute Downer, the lead prosecutor in Zuma's corruption case. This opened the door for the charges against Maughan and Downer. The NPA has rejected Zuma's charges against Downer, calling it "an abuse of process" and reiterating that it has confidence in Downer's prosecution of Zuma.

The charges relate to News24's publication of details of Zuma's medical condition, which were attached to court papers lodged at the KwaZulu-Natal High Court in Pietermaritzburg, last year. Zuma contends that it violated sections of the National Prosecuting Act. He was granted medical parole by then head of the department of correctional services, Arthur Fraser, shortly after he was incarcerated in July last year. Zuma's legal team claims Downer leaked the information to Maughan. The summons was served on Maughan and Downer on Tuesday morning and they are to appear in the KwaZulu-Natal High Court in Pietermaritzburg on 10 October 2022. News24 editor-in-chief Adriaan Basson said the development was "clearly an attempt by Mr Zuma to bully Maughan and News24 when he knows we did nothing wrong". "There is absolutely nothing strange or wrong about being given access to court papers that are about to be filed at court, for public viewing. Court papers are inherently public documents. This is a cornerstone of open justice in a democracy. Maughan was just doing her job and threatening her with private prosecution is a blatant and cynical attack on media freedom in this country. Maughan will continue to report on Mr Zuma's criminal cases and we will defend her to the hilt," he said. Zuma received a 15-month sentence for contempt of court after he refused to comply with a Constitutional Court order to appear before the Zondo Commission. He was sent to the Estcourt Correctional Centre. His track record of prosecutorial integrity and professionalism speaks for itself," the NPA said in a statement on Tuesday. The NPA added that it expects attacks on its prosecutors to intensify as state capture cases reach the courts, and that it will defend itself from "unjustified attacks and intimidation." "Prosecutors need to act without fear or favour as they deliver on their constitutional mandate to ensure accountability for crime in our country. The people of our country, all victims of state capture, expect nothing less of members of the NPA," the statement reads.

On Monday morning, Judge Piet Koen adjourned proceedings to 17 October, for the apex court's decision on Zuma's "special plea" appeal bid. If the Constitutional Court dismisses Zuma's appeal, the arms deal corruption trial will proceed on 7 November. Downer confirmed that the former president's attempt to persuade Supreme Court of Appeal President Mandisa Maya to reconsider her court's dismissal of his special plea appeal had failed. Zuma, who was excused from attending court on Monday, is now demanding that the Constitutional Court order Maya to reconsider her decision. Zuma is adamant that Downer lacks the impartiality and independence to prosecute him. While Zuma's Foundation has announced that he will privately prosecute Downer for, among other things, allowing court documents to be given to News24, Zuma has yet to issue summons against him. The former president is facing charges of corruption, fraud, money laundering and racketeering. French arms company Thales joins Zuma in the dock. It's alleged Zuma received millions in payments from his friend and former adviser Schabir Shaik to help Thales, then known as Thint, secure contracts linked to the arms deal. Shaik was convicted in 2005. Zuma and Thales have pleaded not guilty to all the charges.

It's been more than a month since former president Jacob Zuma's lawyers filed an application for appeal court president Mandisa Maya to reconsider the dismissal of his latest legal attack on prosecutor Billy Downer – but she has yet to even see it. This emerged in the KwaZulu-Natal High Court in Pietermaritzburg on Tuesday morning, when the long-awaited corruption case of Zuma and French arms company Thales was postponed to a holding date of 1 August to await Maya's decision, as well as further legal action from Zuma's lawyers, should she rule against him. After Downer informed Judge Piet Koen that he had twice confirmed that no decision on Zuma's reconsideration application had been made, Koen – who himself served as an Appeal Court judge – responded that he was "a bit surprised" because the application had been filed on 11 April "and normally these matters are dealt with pretty quickly". Koen then asked Downer, "Can you confirm that, as much as. the application was filed with the registrar, we have got the stamp, has it been confirmed that it's made its way to the desk of the president (Maya)?" Downer answered: "The last message that I received from the registrar was that it was on its way to the president. The reason for the delay is unclear to me. It's not our mandate to interrogate that. But it has been received, the papers are ready and they are on their way to the president." Koen asked: "And when was that Mr Downer?" Downer responded: "That was yesterday (Monday)". Downer subsequently confirmed that the National Prosecuting Authority (NPA) had chosen not to file a response to Zuma's multi-pronged appeal application – which primarily concerns the former president's campaign to have Downer removed as prosecutor – precisely "to speed along the process and we urged that the matter be speeded up". "We did, with respect, what we could to ensure that we had a result today, but be that as it may, we don't have a result today," he added. As a result of the potential delays caused by the finalisation of Zuma's ongoing and possible further appeals, Koen then suggested that it was advisable for his trial to be postponed to August, rather than the June date initially agreed on by the State and defence. Now that Zuma's reconsideration application was on Maya's desk and "without putting her on terms", Koen said he expected that a decision on it would be made "pretty shortly". "I am in the court's hands," Downer said, before adding that "naturally, the State is dismayed.with the length of the postponements, with the effect on the administration of justice." "I could stand here and make an argument that it's all too much," he said. Koen answered that he was "also concerned about the delays" and their impact. Nonetheless, he reiterated his belief that the provisions of the Superior Courts Act did not enable him to continue with the Zuma trial, while the former president was engaging in an attempted appeal process. This was despite the fact that he did not believe there was "any substance" to the attempted appeals, he said. "So all we can do is sit out this process of further appeals or further applications along the path of appeals. I can't affect that in any way. Obviously, it must just be pursued in accordance with the time limits and the rules of court," Koen said. In response, Downer stressed that the NPA did believe that Koen had a discretion to continue with its case against Zuma while he was attempting to appeal the special plea dismissal ruling given against him. As a result of Koen rejecting that argument, he said, "we are now in precisely the sort of situation that we wanted to avoid". Downer further stressed that it was important that, once a date for the trial to start was finally established, "it actually starts". Former president Jacob Zuma's corruption trial will go ahead after his special plea was dismissed. Delivering judgment on Tuesday, KwaZulu-Natal High Court Judge Piet Koen said the former president had failed to show that State advocate Billy Downer lacked the "title" to prosecute him. Koen said many of the allegations Zuma raised against Downer were based on speculation or suspicion or inadmissible hearsay – not on facts. "The allegations of bias against Mr Downer were based largely on the fact that he has allegedly not been independent and objective. On a proper interpretation of [Section] 106(1)(h) of the CPA (criminal procedure act), that does not deprive Mr Downer of the title to prosecute." Koen continued, "In the alternative and adopting a wider interpretation of the words 'title to prosecute', I am still not persuaded that Mr Downer lacks the title to prosecute or should be removed as prosecutor." "On the evidence before me, it has not been shown that Mr Zuma's rights to a constitutionally fair trial have been impaired, or that there is a real possibility that his rights will be impaired." The judge dismissed the matter and directed that the corruption trial should proceed. The former president had accused Downer of turning his criminal case into "a personal legacy project of his own". Zuma wanted Downer removed from the case, saying he did not have a "lawful title" to prosecute him. He also said Downer lacked the independence and impartiality to conduct the case lawfully. However, the National Prosecuting Authority (NPA) previously pointed out the courts had already conclusively found that an application for the removal of a prosecutor on the basis of bias or apprehension of bias could not be conflated with a challenge to the prosecutor's "title" to prosecute – which was often raised when non-State advocates were briefed to pursue private prosecutions. Advocate Wim Trengove, arguing on behalf of the NPA, previously told the court that Downer "stood up for justice and truth every time and stood up to his bosses every time". He told the court that Zuma had tried to "dress up" his fair trial complaints – which have repeatedly failed in other court cases – as a "special plea". He added: "There is nothing new about it. There is nothing exceptional about it." In May, Zuma pleaded not guilty to the charges against him, including corruption, fraud, racketeering and money laundering, News24 reported. The former president faces 16 charges relating to 783 payments he allegedly received from his former financial advisor, Schabir Shaik, as well as a R500 000-a-year bribe that the State said Shaik facilitated for him from French arms company Thales. Zuma's trial is expected to start on 11 April 2022.

The Jacob Zuma Foundation has announced that the former president will lay criminal charges against State advocate Billy Downer for allegedly leaking affidavits containing information about his health. The charges will be laid on Thursday, according to foundation spokesperson Mzwanele Manyi. In a tweet on Wednesday, the foundation said: "As indicated in court on 22/09/21 H.E Prez (sic) Zuma will be laying criminal charges against adv Billy Downer for his admitted conduct which is in breach of Section 41 (6) read with [Section] 41 (7) of the NPA Act." The foundation invited the media to a briefing outside the Pietermaritzburg SAPS on Thursday at 13:00. During Zuma's court case last month, his advocate, Dali Mpofu, SC, said, "Former president Zuma takes the strongest possible exception to what was done with his confidential information and the way it was treated in this court." Mpofu said it amounted to "criminal activity", and added that Zuma wanted to lodge a complaint of prosecutorial misconduct against Downer with Judge Piet Koen, who is deciding his application for a special plea.

Former President Jacob Zuma opened a criminal case against National Prosecuting Authority (NPA) advocate Billy Downer on Thursday for allegedly making public affidavits that relate to Zuma's medical information. Zuma was accompanied to a Pietermaritzburg police station by his daughter Duduzile Zuma-Sambudla as well as his foundation's spokesperson Mzwanele Manyi. The foundation says Downer's alleged conduct breaches sections of the NPA Act. Reacting to the charge against Downer, the NPA said while the law must be allowed to follow its course, it was concerned about the context in which the charges were laid. “Adv Downer SC is a highly respected prosecutor who has carried himself with integrity throughout his career in the NPA. His reputation speaks for itself. All NPA prosecutors are required to act without fear and favour and should feel confident to deliver on their mandates without fear of intimidation. However, we will allow the Director of Public Prosecutions in KwaZulu-Natal to deal with the matter as and when she receives the case docket from the police,” the NPA said.
