In a speech today in Istanbul, Turkey's President Recep Tayyip Erdogan praised the “courageous decision” of the International Criminal Court to seek the arrest of Prime Minister Benjamin Netanyahu and former defense minister Yoav Gallant. The ICC issued the warrants against the Israeli leaders and Hamas military chief Mohammed Deif on Thursday on charges of crimes against humanity and war crimes in the Gaza conflict. We discuss how this as a new line in the sand for Israel-supporting countries. Yesterday, new Defense Minister Israel Katz announced an end to administrative detention orders for West Bank settlers. Almost on the heels of this announcement, several dozen Jewish extremists in Hebron for an annual pilgrimage tried to attack the head of the IDF Central Command Maj. Gen. Avi Bluth. Five were arrested. Horovitz weighs in on this announcement and other unsettling news regarding settlers this week. In a highly unusual move, the State Prosecutor's Office on Friday published a rebuttal to allegations that it has been selectively enforcing the law concerning leaked intelligence information with the grave charges it has brought against Eli Feldstein, a spokesman for Prime Minister Benjamin Netanyahu, and an unnamed IDF reservist, in relation to the leak of a stolen, classified document to German newspaper Bild. A second PMO spokesman, Jonathan Urich, was questioned by the Israel Police's Lahav 433 major crimes unit for a second time on Wednesday as part of the probe. Horovitz discusses the prosecutor's unusual move to publish a Q&A on the case and raises other outstanding questions surrounding it. Corruption Buster Paul O'Sullivan has revealed how a Hawks police officer and a senior State Prosecutor “filled out their own arrest warrants” when they completed and signed hunting permits for a weekend with a fraud accused. He speaks to BizNews following their appearance in court - and his safe return from Brazil where he thwarted machine gun-toting armed robbers. O'Sullivan has words of praise for the police's handling of the corruption case involving one of their own, and says there is “a golden thread of goodness in our criminal justice system, and if we have hope, which I have, otherwise I would have been long gone, if we have hope, I think justice will prevail and we'll see these people go to prison, and I'm hoping that all three of them will get a minimum sentence of 15 years.” Meanwhile, he urges the millions of poor in South Africa “to take a strong, hard look at who is committing the corruption, why the corruption is being committed” - and says the best way to deal with it “is when the elections come around”. - Chris Steyn
Judge Nkosinathi Chili of the Pietermaritzburg High Court has refused Advocate Dali Mpofu's demand that State Advocate Billy Downer and journalist Karyn Maughan sit in the dock during today's court proceedings. The former president's private prosecution of state prosecutor Advocate Billy Downer and journalist Karyn Maughan is continuing. Zuma is charging them with leaking a confidential doctor's letter during his arms deal fraud and corruption trial. Today's appearance comes as Zuma has filed for leave to appeal in the Supreme Court of Appeal against a High Court ruling that set aside the private prosecution. In the run-up to their last appearance in August, Downer and Maughan obtained a court order that first ruling be executed pending an appeal. Zuma lost that case and is now approaching the Constitutional Court. SABC reporter, Nonkululeko Hlophe has more.
The state prosecutor in the Senzo Meyiwa murder trial, George Baloyi, says the recording of an alleged confession by one of the accused should form part of the evidence before court. PROTESTERS MARCHED in the streets of Israel again this week, protesting the judicial reform bill being pushed through the Knesset by a conservative coalition led by Prime Minister Benjamin Netanyahu's Likud party. What most outsiders don't understand is that secularists in Israel orchestrated what amounts to a coup through the court system years ago, when the growing influence of religious Jews became obvious. In a piece published this week by the Jewish Press, journalist David Israel recalled a remarkable 2016 interview with MK Israel Yitzhak Eichler of the United Torah Judaism party that explains what's happening: “I complained once to a former justice minister about the activism of the courts, who were intervening in legislation without the authority to do it, disregarding the separation of powers. So he told me, ‘Listen, forget this nonsense. When we realized that [religious Jewish parties] are getting stronger, we realized you were going to conquer our state. And we had two options: either declare a military coup d'état, or a judicial coup d'état… ‘So we decided,' he told me, ‘to shift the balance in all the government ministries to favor the judicial system' — empowering the Attorney General, the State Prosecutor, the government legal advisers, the attorneys, because the legal system doesn't rely on the masses — ‘And that's how we'll save our country.' And they did it.” In other words, liberals in Israel, realizing that they couldn't get the votes for their agenda, took over the country through the courts. The bill in Knesset would rein in the power of Israel's Supreme Court, and that's why activists, many of whom have flown to Israel from other nations, are trying to turn the country upside down. The same thing has happened in the United States through the backing of George Soros for radical left-wing district attorneys, who have enormous power to decide which cases to prosecute at the local level. Without winning a majority in Congress or on the Supreme Court, the laws of the United States have been fundamentally shifted to favor certain groups over others. And the U.S. State Department is doing the same thing through its Global Equality Fund, sending taxpayers' money to groups pushing the LGBTQI+ agenda in other countries. Pietermaritzburg High Court Judge, Piet Koen has conceded that his continued involvement as presiding judge in the arms deal trial against former president Jacob Zuma needs in the interest of justice to be addressed. Judge Koen also noted the possible injustice of continuing with the trial while the former president seeks a constitutional ruling in relation to pending application for the recusal of State Prosecutor, Advocate Billy Downer. Reading his judgement on Wednesday, Judge Koen postponed the continuation of the trial to the 30th of January 2023.
Former president Jacob Zuma's private prosecution case against News24 journalist Karyn Maughan and state prosecutor, advocate Billy Downer will be heard in the Pietermaritzburg High Court today. Zuma opened a criminal complaint against Downer for allegedly leaking his confidential medical records to Maughan who then published the documents. The NPA declined to prosecute Downer for allegedly leaking the records and instead awarded Zuma a private prosecution certificate. ABOUT THE SPEAKERS David Schwendiman served for over twenty-five years as an Assistant U.S. Attorney in the District of Utah. He was the Chief Prosecutor of the Kosovo Specialist Prosecutor's Office in The Hague from 2016 to 2018 and previously oversaw investigation of war crimes and crimes against humanity committed in Kosovo in 1998, 1999 and 2000 as the Lead Prosecutor of the EU's Special Investigative Task Force (SITF). Schwendiman investigated and prosecuted atrocities committed during the war in the Former Yugoslavia as an international prosecutor in the Special Department for War Crimes of the State Prosecutor's Office in Bosnia and Herzegovina. He also served as the U.S. Justice Attaché in Kabul, Afghanistan from 2010 through 2013 and spent 2014 as the Assistant Special Inspector General for Afghanistan Reconstruction (SIGAR) and Director of Forward Operations for SIGAR. He is now an Adjunct Professor of Law at the University of Utah's S.J. Quinney College of Law. H. R. McMaster is the Fouad and Michelle Ajami Senior Fellow at the Hoover Institution, Stanford University and the Japan Chair at the Hudson Institute. He is also the Bernard and Susan Liautaud Fellow at the Freeman Spogli Institute and lecturer at Stanford University's Graduate School of Business. He was the 26th assistant to the president for National Security Affairs. Upon graduation from the United States Military Academy in 1984, McMaster served as a commissioned officer in the United States Army for thirty-four years before retiring as a Lieutenant General in June 2018.
Katlego Mokoena obtained her law degree from the University of the Witwatersrand. After obtaining her undergrad she studied and obtained her post graduate diploma in corporate law at the University of Johannesburg whilst completing the compulsory Practical Legal training (PLT). She started her legal career when she joined the National Prosecuting Authority under the Aspirant Prosecutor Program. She then started prosecuting in the district courts and shortly after went to act as a Regional Court Prosecutor. Having completed her PLT in order to be admitted as an Attorney Katlego left the NPA and pursued to complete her articles at Legal Aid South Africa. She is an admitted Attorney of the High Court. From Articles she went on to practice for her own account as one of the Directors under the name and style Mokoena and Dhlamini Attorneys Incorporated. 5 years after that she got an opportunity to act as a Magistrate stationed in Soweto. She was recently appointed as a permanent Magistrate in 2021. Katlego has been in the legal fraternity for 12 years and an admitted attorney for 9 years. When ones looks at her short track record she has literally been on all sides of the fence. A State Prosecutor, A Defence Attorney and now the bench being a Magistrate. Former president Jacob Zuma will plead not guilty to corruption charges and he wants the state’s lead prosecutor, advocate Billy Downer, out.Zuma’s legal team will file papers on Wednesday in support of the objection against Downer leading the trial against him.In the papers, Zuma will state reasons for calling for Downer’s recusal from the proceedings.Zuma’s trial was expected to start on Monday in the Pietermaritzburg high court, but the court was informed that Zuma planned to object to Downer prosecuting him.Zuma’s lawyer, advocate Thabani Masuku, told the court Zuma was ready to proceed with the trial and that his objection should not be seen as sign that he was stalling.
