Let's start with a question: Why is Real Property law a critical component of the Bar Exam? The simple answer is that Real Property touches on many aspects of our lives - from the ownership of our homes to the zoning laws that dictate what can be built in our neighborhoods. It's a foundational area of law that every attorney should be familiar with, whether you specialize in real estate transactions or not. Now, to lay the groundwork, let's clarify two terms you've probably heard a lot: Real Property and Personal Property. At its core, the distinction is quite straightforward. Real Property refers to land and anything attached to it. This can include buildings, trees, minerals, and even the rights associated with the land, like air rights. On the flip side, Personal Property is essentially everything else. It's the movable objects that you own. Your car, your laptop, your clothes - these are all examples of Personal Property. The key difference lies in mobility and permanence. Real Property stays put; Personal Property can move with you. Understanding the types of Real Property interests is crucial for navigating Real Property law. These interests determine what rights you have over a property. There are several types, but today we'll focus on three main ones: Fee Simple Absolute, Life Estate, and Leasehold Interest. Fee Simple Absolute gives you the most complete ownership of property possible. You own the land and can do with it as you please, subject to laws and regulations, of course. It's the most common form of property ownership and, unless specified otherwise, what people usually mean when they talk about owning property. Next, we have the Life Estate. This is a bit more specialized. A Life Estate gives someone the right to use and benefit from a property for the duration of their life. However, they can't sell the property, and upon their death, it passes to another designated person, known as the remainderman. Lastly, there's the Leasehold Interest, which you're likely familiar with if you've ever rented an apartment. This gives you the right to use and occupy the property, but only for a predetermined period. Unlike Fee Simple Absolute, you don't own the property; you just have a temporary right to use it. Along with understanding these interests, it's important to get comfortable with key legal terminologies in Real Property law. Terms like "easement," which is the right to use someone else's land for a specific purpose, or "encumbrance," which refers to a claim or liability attached to the property, like a mortgage or lien. These terms are the building blocks for more complex Real Property concepts we'll cover in later episodes. So, why does all this matter for the Bar Exam? Well, these concepts form the basis of many Real Property questions you'll encounter.    Slam the Gavel welcomes Diane Berkebile to the podcast. Her Mother,Jane Stickle was made a Victim of Lawrence County's, "I Care A Lot" scheme." Diane soon realized this is a real life monopoly after seeking help from an attorney after receiving an inheritance from her uncle in 2010.    However, a year later her father died, TARGETING her mother by this attorney and his partner's son, Assistant District Attorney who joined forces with her sister who had medical issues.     Diane received a call from her sister that she was taking their Mother out for lunch. That would be the last time Diane saw her Mother. Several weeks later she was allowed to see her mother in an assisted living home. Her Mother was wearing an ankle bracelet and did not have her cell phone.    Prior to this happening, Diane was to move into her Mother's home in 2017 per documents her sister and the attorney signed in full agreement to live with her mother. However, 8 weeks prior to the targeted move in date her Mother was stripped from her home and from her life as she knew it....     After telling everyone in town for months that her Mother had Alzheimer's, on 8/4/2017 her sister then took her to an attorney to sign papers to remove Diane as POA. 96 hours after signing the paperwork, her sister dropped her off at Glen Moore Place Assisted Living, like a dog on 8/8/2017 and had her fitted with an ankle alarm.     What happened next was her sister permitted the facility to chemically restrain her every time she went near the door, cashed in interest bearing annuities prior to Mother's passing, having her loser home to go to tax sale (after refusing to pay Property Taxes the POA was responsible for) and is now suing Diane for $800,000.00 for ruining her name and career while still employed to Diane's knowledge.    Diane's goal is to save her home from foreclosure scheduled March 8, 2023 resulting from the, "I Care A lot" scheme. Diane would like to obtain help to pursue reimbursement from Lawrence County for selling her Mother's home illegally and deter others from ever taking part in being named in a Life Estate, to never tie up their home in that kind of Red Tape as it is a doorway for corrupt attorneys. Some elder care attorneys handle subjects that most people know something about, such as probate, guardianship, estate planning. Other eldercare lawyers focus their practice on other areas of law such as special needs planning, VA benefits planning, and Medicaid planning. So, what is Medicaid planning? Medicaid planning is a way to protect people's assets from the threat of long-term care expenses. Many clients are between 65 and 95, own their own homes, and have between $25,000 and $750,000 worth of assets in addition to the house. What many people don't realize is exactly how expensive long term care expenses can be – In 2020 the average costs of a skilled nursing facility, in New York is $14,250.00 per month. Someone can be solidly middle class or upper-middle class, have saved their whole life, and think that they'll have plenty of money for whatever happens only to suffer a stroke, major heart attack or get an Alzheimer's or Parkinson's diagnosis and need help with their activities of daily living. If they have this six-figure per year care expense, many people spend everything. Medicare does not pay skilled nursing home expenses after 100 days. An elder care attorney, who handles Medicaid planning, is able to legally and ethically protect people's assets to get them qualified for Medicaid. Medicaid, unlike Medicare, has excellent long-term care benefits. This helps them supplement their lifestyle with their own assets (to improve the quality of their life while alive) and make it more likely that they will have something to pass onto their heirs after they pass away. In English common law, fee tail or entail is a form of trust established by deed or settlement which restricts the sale or inheritance of an estate in real property and prevents the property from being sold, devised by will, or otherwise alienated by the tenant-in-possession, and instead causes it to pass automatically by operation of law to an heir determined by the settlement deed. The term fee tail is from Medieval Latin feodum talliatum, which means "cut short fee" and is in contrast to "fee simple" where no such restriction exists and where the possessor has an absolute title (although subject to the allodial title of the monarch) in the property which he can bequeath or otherwise dispose of as he wishes. Equivalent legal concepts exist or formerly existed in many other European countries and elsewhere. Purpose. The fee tail allowed a patriarch to perpetuate his blood-line, family-name, honor and armorials in the persons of a series of powerful and wealthy male descendants. By keeping his estate intact in the hands of one heir alone, in an ideally indefinite and pre-ordained chain of succession, his own wealth, power and family honor would not be dissipated amongst several male lines, as became the case for example in Napoleonic France by operation of the Napoleonic Code which gave each child the legal right to inherit an equal share of the patrimony, where a formerly great landowning family could be reduced in a few generations to a series of small-holders or peasant farmers. It therefore approaches the true corporation which is a legal body or person which does not die and continues in existence and can hold wealth indefinitely. Indeed, as a form of trust, whilst the individual trustees may die, replacements are appointed and the trust itself continues, ideally indefinitely. In England almost seamless successions were made from patriarch to patriarch, the smoothness of which were often enhanced by baptizing the eldest son and heir with his father's Christian name for several generations, for example the FitzWarin family, all named Fulk. Such indefinite inalienable land-holdings were soon seen as restrictive on the optimum productive ability of land, which was often converted to deer-parks or pleasure grounds by the wealthy tenant-in-possession, which was damaging to the nation as a whole, and thus laws against perpetuities were enacted, which restricted entails to a maximum number of lives. In common law and statutory law, a life estate (or life tenancy) is the ownership of immovable property for the duration of a person's life. In legal terms, it is an estate in real property that ends at death when ownership of the property may revert to the original owner, or it may pass to another person. The owner of a life estate is called a "life tenant". In the combined jurisdiction of England and Wales since 1925 a freehold estate intended to be 'held' as a life interest takes effect only as an interest enjoyed in equity, specifically as an interest in possession trust. The other type of land ownership is leasehold and although most long leases are for a period of between 99 and 999 years 'leases for life' will be interpreted in often unpredictable ways as either as a license or a lease. Principles. The ownership of a life estate is of limited duration because it ends at the death of a person. Its owner is the life tenant (typically also the 'measuring life') and it carries with it the right to enjoy certain benefits of ownership of the property, chiefly income derived from rent or other uses of the property and the right of occupation, during his or her possession. What is a life estate? In this FAQ, we talk about life estates. Law students, grumble that they will never see one and don't know why they should learn all about such archaic things happening in the fictitious estate of Blackacre. But as an estate planner, we use life estates fairly regularly. We use life estates to avoid taxes or to avoid creating situations where just the wrong person or the wrong type of people or a class of people end up with the estate. They allow you to make gift to a person for his or her lifetime. Then, on that person's death provide that the property is to go to other beneficiaries - not the beneficiaries of the person who's getting the life estate. In common law and statutory law, a life estate (or life tenancy) is the ownership of immovable property for the duration of a person's life. In legal terms, it is an estate in real property that ends at death when ownership of the property may revert to the original owner, or it may pass to another person. The owner of a life estate is called a "life tenant". In the combined jurisdiction of England and Wales since 1925 a freehold estate intended to be 'held' as a life interest takes effect only as an interest enjoyed in equity, specifically as an interest in possession trust. The other type of land ownership is leasehold and although most long leases are for a period of between 99 and 999 years 'leases for life' will be interpreted in often unpredictable ways as either as a license or a lease. A defeasible estate is created when a grantor transfers land conditionally. Upon the happening of the event or condition stated by the grantor, the transfer may be void or at least subject to annulment. (An estate not subject to such conditions is called an indefeasible estate.) Historically, the common law has frowned on the use of defeasible estates as it interferes with the owners' enjoyment of their property and as such has made it difficult to create a valid future interest. Unless a defeasible estate is clearly intended, modern courts will construe the language against this type of estate. Three types of defeasible estates are the fee simple determinable, the fee simple subject to an executory limitation or interest, and the fee simple subject to a condition subsequent. Reverse mortgages are akin to the Centuries Old principle of a Life Estate or an annuity. A life estate is where typically relatives who live together would pass title to a home, during the life of often an elderly person who owned the home in fee simple, who would then live out his or her life in the home, as if still owning the home. While technically a tenant, the person in a Life Estate would have full access to the home. Reverse mortgages are similar to a Life Estate in that typically elderly persons, who have often built up a lot of equity in their homes, are able to continue to live at the home, without paying a mortgage. So in essence the mortgage is a mortgage loan, using the equity in the property to cover what would otherwise be montly payments needed to cover the loan. The loan is typically due at the sale of the home, or upon the death of the homeowner. Reverse mortgages, like regular mortgages, are subject to foreclosure if found to be in default. The Consumer Financial Protection Bureau sees a lot of loan fraud issues in these types of loans, and the reverse mortgages are based on underlying loans, which if securitized in the early to mid-200s era, and often even before or later than that, have the same fraud-origination and assignment problems as similarly securitized loans. Attorney Marshall is litigating a reverse mortgage lawsuit in California at the moment, and the fraud securitization issues, are in essence identical to non-reverse mortgage situations, as long as the originating loan documents had the typical securitization defects. Marshall will then provide a covid-19 update, with a focus on force majeure issues, specifically how a borrower who was otherwise current on mortgage loan payments, is arguably not in default if the reason for defaulting on payments was solely due to unemployment caused by covid-19 shutdown and lockdown rules.
