Ryan Vigus leads CSAA Insurance Group's personal lines products, including auto, home, umbrella, and pet.  His team develops and manages insurance products and product experiences that serve the needs of AAA Members. Ryan's responsibilities include Product Strategy and Development, Product Management, Actuarial, and Data Science.  CSAA Insurance Group is a AAA insurer that serves AAA Members in 23 states and the District of Columbia.  Ryan has served on the board of directors and various committees for the Insurance Institute for Business and Homes Safety (IBHS) since 2018 and currently serves as the chair of the board of directors.  He has a master's degree in applied mathematics from Bowling Green State University (Ohio) and is a Fellow of the Casualty Actuarial Society. Highlights from the Show California is a massive economy that has had a history of difficult insurance situations. Back in the day, Auto Insurance became a problem, with rates jumping and profitability suffering. California's insurers looked to Homeowners to make up the difference to remain profitable. And then the wildfire situation changed dramatically, putting great pressure on the industry, leaving many with the need to dramatically increase rates, pull out of the state, or both. Homeowners Associations often put in place rules to govern how homes in the development look to uphold standards and consistency across homes. But what happens when those standards are at odds with the decisions that make a home more resilient to things like hail, hurricanes or wildfire? Can you install a better roof, plant different vegetation (or remove it), etc., if it means your home will still be standing when others may not? Colorado has made laws that ensure HOAs cannot restrict a homeowner from doing something that makes their home safer from losses like hail or wildfire. If your home falls victim to a flood or hail damage, and your insurer pays to repair the damage, what if there was a way to enhance how you rebuild so your house is less likely to suffer a loss in the future? Wouldn't the time to make such upgrades be when you're working on those items anyway, like upgrading the type of roofing materials you use when replacing a roof destroyed by hail? That's not how insurance works today. But what if it could be? Ryan shares an interesting perspective as we discussed ways to combat the spiraling cost of buying homeowners insurance by homeowners and providing it to them by insurers. What can you do to materially impact the chance a home suffers a loss in a weather-related event like a hurricane, flood, hail storm or wildfire?At PLRB, we see the impact of better building codes on losses, and many areas have seen the benefit in how newer construction stands up to these weather events. Ryan  discusses one hold up to making your home more resilient at a cost to the homeowner is the availability of subsidized insurance through state FAIR plans that allows people to still get coverage at a low enough cost to discourage investing in hardening your home to loss. This may be contributing to some of the issue states like California have in insurance affordability and viability. What is the long-term solution to making insurance affordable to buy and viable for insurers to sell? Do we have an insurance affordability problem? In California, Ryan  believes we don't. Instead, he says we have a “homes burning down” problem, and we in the insurance industry need to stretch beyond our traditional role of paying after a loss to thinking about how we stop the losses upfront and facilitate that. The Indiana Department of Natural Resources released 25 endangered ground squirrels at Kankakee Sands nature preserve. Indiana lawmakers took their first steps last week in exploring whether changes are needed in the ways homeowners associations operate. Adopted by some police departments and their supporters after 2020′s mass protests over police brutality, the flag depicts a black-and-white American flag with one blue stripe, and has been tied to the “Blue Lives Matter” slogan used by supporters of law enforcement... Springfield Township officials banned its employees from displaying the flag on township property in January, saying that the flag had become central to tensions between marginalized communities and law enforcement, and adding that it had been adopted by white nationalists since its introduction. She is a Beach High graduate and lived in Miami Beach for 22 years before moving to Miramar in Broward County in 1996. Her commitment to help the insurance industry mixed with her vast knowledge and great leadership skills have resulted in a lot of value and betterment for everyone involved with her. Dulce specializes in personal lines and commercial habitational risks, such as Condominiums and Homeowners Associations. She is a Vice President and Sales Producer of Acentria Insurance in Miami, Florida. She is a consumer advocate, insurance educator, and proven leader. She has won many awards and recognitions. In the National Association of Insurance Women (NAIW) of Florida she won the Kay Cooper Memorial Award (1994) and Insurance Professional of the Year (1999). The Latin American Association of Insurance Agencies (LAAIA) recognized her with the Insurance Professional of the Year -Woman- in 2002 & 2006. She won the LAAIA-Broward-Lifetime Achievement Award in 2018. She won the AAMGA Association Achievement Award in 2002. She was named one of 95 in the 2018 Elite Women in Insurance of the Insurance Business America.Dulce currently serves as the Citizens Property Insurance Corporation liaison for the LAAIA and has been appointed to the Agents Round Table since 2007. In 2015, she was appointed to the Citizens Depopulation Modernization work group that helped pass legislation that created the depopulation process in place today in Florida. In 2016, she was chosen as 1 of the 10 finalists out of 77 applicants for the position of Insurance Commissioner of the State of Florida. In 2006, she was appointed by then CFO Alex Sink, to the Financial Literacy Council where she served on the Florida Alliance on Hurricane Insurance. She is the Past President of the local chapter of the NAIW and of the LAAIA, and has chaired the Legislative Committee of both associations and therefore she makes annual trips to Tallahassee and Washington, D.C. Dulce has also been a Board Member of the American Insurance Marketing and Sales Society since late 2016 and she is currently their Board President.Dulce is a trusted and credible voice. Probate is another unusual source that most agents don't think of often.   Probate is a legal process where the validity and authenticity of a will are determined.  It also refers to the administration of the deceased person's estate who did NOT have a will.  Typically the fate of the property will be decided by the beneficiaries or a probate attorney.  States differ in how this is handled, but it's a simple process to learn.  Notice of Default properties. Remember that just because someone has missed a payment or multiple payments does not necessarily mean they will be a short sale.  The average homeowner with a mortgage has more than $150,000 in equity in their home.  This means you can sell a house for someone who is in a distressed situation, likely without having to negotiate a short sale.  (You should still learn how to do short sales when necessary). The local HOA for Providence Village determined last month that housing choice vouchers will no longer be accepted in their community and landlords who do will be fined for doing so. The bulk of recipients of HCVs in the area are Black families and the majority population of Providence Village are white, non-hispanic families. After major pushback from county officials, the situation on the ground has shifted, but voucher holders in Providence Village are still in danger of displacement. Ann tells gives us the details of what is happening in North Texas, and how ICP, Texas Housers, and local residents are fighting back against this discrimination and civil rights violation.

When you set lofty goals that not only don’t serve your larger objective, but actually work against you, you might want to reflect on this episode about Homeowners Associations, lawn gnomes, and setting pointless rules. Why is that important for business?  When you are establishing rules and culture, make sure that you are not setting yourself up for an impossible task of compliance. When you target with incredible specificity and end up micromanaging, you might actually obscure your message completely, or worse – ensure everyone not only misses the point, but actively fights the bigger picture goal.   You are also often setting yourself up for failure by establishing an expectation of enforcement that is impossible to adhere to. It’s important to establish just enough of a boundary to stabilize and make clear what you need and no further. Overreach makes people react against the bigger goal. If you don’t enforce these arbitrary rules that you have set, you show yourself as powerless to live up to your own standards. Companies set themselves up with aspirational policies.  Look for opportunities to get buy-in through collectively deciding what people care about. Don’t let the fear that you have to have a consensus or have to listen to every opinion stop you from engaging the people affected by the policies you are setting up. Courts entertain some bizarre cases brought by HOA’s David and Arna Orlando never thought they’d get sued by a homeowner’s association for parking at their own house. The couple were the target of a lawsuit filed by the The Kimry Moor Homeowners Association just outside Fayetteville, NY. The HOA sought an injunction in Onondaga County, NY Supreme Court to stop them from parking their 2014 black Ford150 truck in their own driveway. The association asserted its regulations only allow residents to park “private, passenger-type, pleasure automobiles” in driveways. The association owns the driveways in the development. The association argued the couple’s pickup did not qualify as a private passenger-type vehicle. The Orlandos contended their pickup was a personal passenger vehicle and not a commercial vehicle of any sort. The couple eventually moved to Florida and the lawsuit was subsequently settled to the satisfaction of both sides. The Orlandos are prevented from discussing details of the settlement, but cases like theirs are not so rare. What is an HOA? Independent American Communities, an HOA watchdog blog operated by Deborah Goonan, describes them this way: “Homeowners, condominium, cooperative, and property owners associations are collective legal entities – usually incorporated. Governing documents of HOAs – which include Declarations of Covenants, Conditions, and Restrictions (CC&Rs), By Laws, and Articles of Incorporation – are legally binding on both individual members and their Association, with U.S. courts generally viewing the relationship as contractual between and among the parties.” The blog explains for homeowners the risk of entering into a homeowner’s association. “But that contract is usually written by and for developers, making it one-sided in favor of the HOA,” IAC reports. “In addition, governing documents are not subject to state or federal review, and state laws impose very few restrictions on the terms of HOA contracts. A buyer or heir to HOA property must agree to all terms without any opportunity for negotiation before taking title to that property.” HOA loses case, homeowner loses privileges  Even when an HOA loses in court, it could take vindictive measures. A Florida homeowner took his HOA to court so he could review information that should have been public record. He won his summary judgment case, gaining access to the management contract and financial records of his HOA, including the specific compensation of its manager. As reported by Jan Bergemann, president of Cyber Citizens For Justice, Inc.: In an order granting plaintiff’s motion for summary judgment, Circuit Court Judge William L. Roby ruled against Piper’s Landing, Inc. in Martin County, Fla. in a case where the homeowner’s association refused to allow a member to inspect the management contract and the financial records indicating the specific compensation of manager Brian Reich. Not long after, the homeowner received the following letter: Bill Peters, of Bel Air, MD was sued by a neighboring HOA over a 2-foot span of his driveway. The case started when Harford County issued permits for Peters to build the driveway. He said he gave the neighboring homeowners’ association, which his property is not a part of, a month’s notice, according to wbaltv.com. He spent $15,000 to build his driveway, which passed county inspection. Then, the Emerald Hills Homeowners Association took him to court. Peters won the case, but it cost him $50,000 in legal fees. How to protect assets  The Homeowners Protection Bureau, LLC offers information and resources regarding disputes and asset protection. If sued by an HOA, it is best to consult an attorney.

In short, an HOA, or homeowners association, is an organization of homeowners that retains the right to create and enforce regulations, rules, and restrictions on a particular subdivision, condo unit, or planned unit development. These rules will vary between each HOA and may stipulate anything from the required size of homes to where you can park your vehicle. That said, there is a good reason for these rules. HOAs help the properties within them maintain a certain level of care. This, in turn, helps to protect the homes’ market values.You should be well aware of what you’re signing up for before you purchase any given property.Of course, an HOA can’t operate without funding. This is where the matter of HOA dues come in. Those living within an HOA are required to pay a certain monthly fee that will ultimately be applied toward the care and keeping of the neighborhood. If you neglect to pay this fee, however, the HOA is within their legal right to take action. They may even foreclose on your property. The bottom line is that you should be well aware of what you’re signing up for before you purchase any given property. This includes checking to see if it’s within an HOA and, if it is, what rules you’ll be expected to follow and what fees you’ll be expected to pay. In many cases, an HOA is well worth the cost. Homeowners associations can include single-family residences in a community or a townhouse or condo community. Before you purchase a property within a homeowners association, there are five things you should know. First, what is the monthly cost of the HOA? For condos and townhomes, that can range from $250 to $450 or even $500, depending on what the community offers. “What is covered by the HOA and what benefits are available?” You need to be comfortable with that monthly payment. Plus, your lender will qualify you based on your mortgage payment, taxes, and HOA fees, so it’s important to know what that amount is in order to qualify to buy the property. What is covered in the HOA? Homeowners associations may cover general upkeep of the area, landscaping, pool maintenance, tennis court upkeep, and other amenities. Some HOAs cover trash removal, water bills, and insurance for the property—which is not the same as your personal policy. Figure out what the HOA offers and what benefits are available to you. What are the rules and regulations in the HOA? Different homeowners associations will have different rules, such as where you can park, how many people you can have over, and other things like that. Are you happy with the outside of the house? The great thing about HOAs is the community will be uniform. There are specific colors for the outside of the house and the front door. There are also rules about mowing the lawn and landscaping. Some people may view these regulations as a downside because there is less freedom for what you can do with your property. Finally, how can you get involved with the HOA? You may want to get on the HOA board to make the rules and regulations and further improve the property and the community itself. You may end up shelling out $10,000 or $15,000 in cash when you could have originally gotten a home that cost $10,000 or $15,000 more and not had to deal with any problems. 3. Not rooting out all restrictions. You want to make sure that you call the local municipalities and see what restrictions there are, if any, on the house. 4. Not checking if past work was up to code. Even if a homeowner has had a basement or attic finished by a professional contractor, they still need to have the proper permits. You don’t want to run into any issues here either. 5. Not getting the scoop on the HOA. Homeowners Associations are there to be supportive, but some are harder to deal with than others. Before you decide to purchase a property within an HOA, you need to review the financial documents during your contingency period. You want to make sure you are moving into a community that is financially secure. Obviously, there’s an HOA fee due. Whether that fee is $50 or $350, you need to know what that money is going toward. What are you getting for that fee? The HOA fee covers amenities such as parks, pools, and landscaping, but a portion of that money goes to the reserve fund.“Pay attention to the reserve fund.”As time goes on, fences, roofs, and landscaping may need extra repairs. The reserve fund is there for any major repairs. Every year, the HOA conducts a reserve fund study. Look at those studies to see how the reserve fund is doing so you know what is going on in the community in the long run. If your reserve fund is 50% funded, 100% funded, or 150% funded, you’re in pretty good shape. If the reserve fund is only at 35%, that is a red flag. The HOA may even need to order a special assessment and, depending on the number of homes in the community, that could run a few thousand dollars. There's a few reasons why homeowners associations are so popular.For one, buyers want HOAs for the amenities that come with them. They also help with affordable housing on smaller lots that don't have room for pools, basketball courts, and so on. Since buyers still wanted these types of amenities, they were put into a common area that everyone in the HOA has access to and can enjoy. Since many cities require or encourage communities to have these common amenities, but they don't want to be responsible to maintain them, they require communities to form HOAs in order for the burden of collecting dues to be placed on members of the HOA.Lastly, stormwater runoff basins are being required in order to prevent flooding and other damages. This is also considered a common amenity that needs to be paid for by all members of the community. There are many benefits associated with being part of a homeowners association. The most obvious benefit is the amenities themselves! Many of these communities have pools, spas, basketball courts, parks, play areas and workout areas, among other things. These are private amenities that are limited to people who pay into the HOA! If you're living in a condo or townhome community, HOA fees might be a bit higher, but they cover the exterior of the building, the roofs, and the many other things that make these properties look nice. Beware that HOAs have restrictions and rules, which are liked and disliked depending on who you're asking. The rules are often in place to ensure home values in the area are maintained. In order to do this, there might be rules that stipulate that lots and homes are maintained. Whether or not HOA rules are desirable for you depend on your goals and on the particular rules of a given area, so it's definitely something to look into before making a purchase.
