In this episode we'll be discussing the results of the recent French legislative elections, which defied the predictions of most analysts. More than that, we'll be discussing the trends that have been shaping France's society for years now, from politics to the media industry. More specifically: what can explain both, the expectations of Marine Le Pen's far-right National Rally party winning these elections, on the one hand, and the final success of progressive parties, on the other hand? The lead guest of this episode is Johan Weisz-Myara, founder and producer at Street Press. Born 15 years ago, Street Press is an independent media organisation which has broadly covered the life of young French citizens in the outskirts, or banlieus, of French metropolitan areas. In relation to the French elections, Street Press launched dozens of investigations into the French far-right over the past year and co-organised the biggest anti-far-right protests in the country, in Paris, ahead of the legislative elections. But, in this episode, we'll also hear from Nikita Rathod, Europod's Social Media Officer. Nikita discusses how she, as a young Indian woman, has been living the runup to the elections, these months. The Archive Is All in Present Tense (Barrow Street Press, 2022) attempts to capture the feeling of archival research, which, despite being an attempt to access information about the past, has a way of infusing the present; research unfolds in real time as you touch and handle objects that radiate with presence. In the archive we follow a researcher who is exploring a fantastical, limitless archive and though she attempts to research the history of war crimes, she keeps encountering objects from her personal past and memory. Ultimately, it explores both the falling in love with big institutions of learning (libraries, archives, museums) and the exhilaration of discovery, but also the ways these institutions violently exclude and how to reconcile that love with the past wrongs these institutions have committed.  The Archive Is All in Present Tense is an intensely cinematic collection of poems, intensely erotic and equally cerebral, where you will descend into archival folds making the body negative space in a restless, inescapable, eternal now. To write is to rewrite with alphabets of the past, surging into the present, being remade, where the self is both trapped and sublime. Elizabeth Hoover is the author of the archive is all in present tense, winner of the 2021 Barrow Street Book Prize. Her creative nonfiction has appeared in the North American Review, the Kenyon Review, and StoryQuarterly. She teaches in the English Department at Webster University in St. Louis. Ngày 13/10/2023, một giáo viên tại Arras, một thành phố nhỏ ở vùng Pas-de-Calais, miền bắc Pháp, đã thiệt mạng và 3 người khác bị thương do bị một thanh niên Hồi giáo cực đoan người gốc Kavkaz tấn công bằng dao ngay trước trường học. Chính phủ Pháp sau đó đã nâng báo động khủng bố lên mức cao nhất, triển khai 7.000 lính thuộc lực lượng Sentinelle tuần tra chống khủng bố để tăng cường an ninh. Bộ trưởng Nội Vụ Pháp Gerald Darmanin hôm thứ Bảy 14/10/2023 đề nghị giải pháp « trục xuất có hệ thống mọi người nước ngoài bị các cơ quan tình báo xem là nguy hiểm ». Để đối phó với nguy cơ khủng bố từ Hồi giáo cực đoan, chính phủ Pháp liên tục thông báo về chủ trương đẩy mạnh việc tước thẻ cư trú, trục xuất những người nước ngoài bị các cơ quan an ninh xếp vào diện nguy hiểm, nhất là những người có tư tưởng cực đoan về tôn giáo, có thể gây hại cho an ninh quốc gia.Quyết tâm của chính quyềnĐích thân tổng thống Pháp Emmanuel Macron đã yêu cầu các tỉnh trưởng xem xét, rà soát hồ sơ những người cực đoan đủ điều kiện để bị trục xuất khỏi Pháp, bảo đảm rằng không « bỏ sót » bất cứ trường hợp nào, đồng thời thúc đẩy các thủ tục trục xuất. Một cố vấn của điện Elysée cho AFP biết, theo yêu cầu của tổng thống Macron, bộ trưởng Nội Vụ Gérald Darmanin phải đặc biệt chú ý đến việc trục xuất các thanh niên đến từ vùng Kavkaz của Nga trong độ tuổi 16-25.Không phải vô cớ mà chính phủ Pháp lưu ý nhiều đến nhóm đối tượng này. Theo vị cố vấn của điện Elysée, chính quyền biết rõ là nhóm người này có « một mối liên hệ đặc biệt với bạo lực », « các hình thức cực đoan hóa rất mạnh », « và một nền văn hóa Hồi giáo rất cực đoan ». Điều thường được nhắc đến là trong cả hai vụ sát hại thầy giáo Samuel Paty, cách nay 3 năm, và thầy giáo Dominique Bernard hôm 13/10, thủ phạm đều là người có xuất xứ từ vùng Kavkaz.Bộ trưởng Nội Vụ Pháp Gérard Darmanin lần này tỏ ra rất cứng rắn, kiên quyết, kể cả là phải đối mặt với Tòa án nhân quyền châu Âu, bởi theo ông, điều quan trọng hơn là bảo vệ được người dân Pháp. Câu hỏi đặt ra là chủ trương của chính phủ Pháp về trục xuất liệu có khả thi hay không ? Đây vốn là một chủ đề bị xem là « gót chân Achille trong chính sách nhập cư của Pháp », bởi bất chấp các tuyên bố cứng rắn dưới thời nhiều tổng thống, ngoài các tranh cãi, đấu đá về chính trị, việc trục xuất người nước ngoài tại Pháp vẫn bị xem là rất khó thực hiện, cả về thủ tục pháp lý và lý do nhân đạo.Trên đài RFI Pháp ngữ ngày 17/10/2023, nhà báo điều tra độc lập Vincent Nouzille, tác giả cuốn sách « Mặt trái của quyền lực - Điều tra về sự chệch hướng của bộ Nội Vụ và cảnh sát » (NXB Flammarion, 2023) nêu lên vài ý kiến :« Tôi xin kể lại chuyện về những người Chechnya bị Pháp trục xuất : Từ sau vụ giết hại nhà giáo Samuel Paty cho đến khi nổ ra cuộc chiến Ukraina hồi tháng 02/2022, có vài chục người đã bị trục xuất. Nhưng không thể trục xuất người như thế về bất cứ nước nào. Thứ nhất là cần có giấy phép lãnh sự để quốc gia nơi chúng ta muốn trục xuất họ đồng ý tiếp nhận, điều này rất hiếm khi xảy ra, đặc biệt là ở Pháp. Họ có lệnh bắt buộc rời khỏi lãnh thổ Pháp nhưng không phải lúc nào cũng có thể thi hành lệnh đó, nhất là vì các nước Algerie, Maroc, Tunisie, Nga hoặc nhiều quốc gia khác từ chối tiếp nhận lại người nước họ. Ngoài ra cũng cần cân nhắc một điều thứ hai : Đó là ngay cả khi họ là người nguy hiểm tại Pháp, thì việc gửi trả họ về một nước, chẳng hạn, gửi trả về Nga những người chống đối Putin hay chống nhà độc tài Chechnya Khadirov, theo thỏa thuận đạt được giữa hai bên, thì những người này bị chuyển thẳng vào nhà tù ở Nga, họ bị tra tấn, một số đã chết. Có một cuộc điều tra tư pháp đã được mở ở Pháp về việc đưa những người này đến chỗ chết. Như vậy là dù chúng ta có thể xem việc đã thoát khỏi những người Hồi giáo cực đoan là điều tốt, nhưng thứ nhất, họ có thực sự là Hồi giáo cực đoan, thứ hai là dẫu sao thì cũng có những khái niệm về luật pháp quốc tế cần « được áp dụng ». Dẫu sao chúng ta cũng vẫn có Hiến pháp, chúng ta vẫn có Nhà nước pháp quyền, chúng ta vẫn có những công ước quốc tế cần phải tôn trọng. Nếu chúng ta xóa bỏ quy chế tị nạn đối với những người nước ngoài đó và gửi trả họ trở lại những quốc gia mà về cơ bản là họ có nguy cơ bị kết án tử hình và bị tra tấn, thì đó là một vấn đề. Tôi không nói rằng chúng ta không nên cố gắng đàm phán về một số vấn đề nhất định, nhưng như hiện này thì gửi trả người về đất nước của Putin, tôi không biết liệu đó có phải là một tính toán đúng hay không ». Những ràng buộc pháp lý từ ngay tại PhápQuả thực, có rất nhiều rào cản pháp lý. Chẳng hạn, không thể trục xuất những người chưa đến 18 tuổi, những người trưởng thành là người nước ngoài nhập cư vào Pháp trước tuổi 13 và sinh sống liên tục ở Pháp từ đó đến nay, trừ khi người này bị kết án vì có hành xử, theo Serge Slama, giáo sư luật công tại Đại học Grenoble Alpes, được Le Figaro trích dẫn ngày 16/10, « có tính chất gây tổn hại đến những lợi ích cơ bản của Nhà nước, hoặc có liên quan đến các hoạt động có tính chất khủng bố, hoặc cấu thành các hành vi khiêu khích rõ ràng và có chủ ý phân biệt đối xử, gây thù hận hoặc bạo lực » …Để khắc phục những hạn chế như trên, bộ trưởng Nội Vụ Pháp ngay tối 13/10 trên đài TF1 đã nói đến dự luật sửa đổi luật Nhập cư để có thể « thẳng tay » trục xuất những người nước ngoài « không tôn trọng các quy định của Pháp », « không tôn trọng các giá trị của nền Cộng Hòa », tạo thành « mối nguy lớn » cho nước Pháp, « kể cả khi họ bắt đầu đến Pháp sinh sống từ năm 2-3 tuổi » chứ không chỉ những ai bị kết án hình sự mới bị nhắm tới. Dự thảo luật Nhập cư mới bắt đầu được thảo luận tại Thượng Viện từ ngày 06/11/2023 và các phiên thảo luận tại Hạ Viện cũng được đẩy sớm lên, bắt đầu từ đầu tháng 12/2023 để muộn nhất là đến cuối tháng 12 sẽ được thông qua, thay vì đợi đến tháng 01/2024 như dự kiến ban đầu.Trong cuộc họp báo ngày 14/10, bộ trưởng Tư Pháp  Éric Dupond-Moretti phát biểu : « Hiện nay, chúng tôi có thể trục xuất ra khỏi lãnh thổ quốc gia những ai bị cáo buộc khủng bố nếu phớt lờ điều vẫn được gọi là bảo vệ trật tự công ở Pháp. Nếu một người đến lãnh thổ quốc gia Pháp trước tuổi 13, hoặc nếu họ kết hôn ngay tại lãnh thổ Pháp với một người Pháp, hay nếu họ có con cái sinh ra ở Pháp, thì họ được hưởng những điều khoản bảo vệ đã được nêu rất rõ trong bộ luật của Pháp, theo đó họ không thể bị trục xuất, trừ khi họ xâm hại đến các lợi ích cơ bản của quốc gia, trong đó có tội khủng bố. Trong dự luật mới, chúng tôi dự trù xóa bỏ những điều khoản bảo vệ này đối với những ai phạm tội hoặc không tôn trọng các giá trị của nền Cộng Hòa. Chẳng hạn tất cả những ai đến lãnh thổ quốc gia Pháp trước tuổi 13, hay kết hôn tại Pháp với người Pháp, hay đã sinh con tại Pháp, nếu họ buôn lậu chất gây nghiện, hay tấn công một cảnh sát, hay nếu bị cáo buộc bạo lực trong gia đình (chứ không cần là phải bị kết án), thì luật mới sẽ cho phép tước biện pháp bảo vệ nói trên để có thể trục xuất họ ». Theo Le Monde, đạo luật bảo vệ người nước ngoài tại Pháp cũng cấm trục xuất họ đến nơi mà « tính mạng hay tự do của họ bị đe dọa ».Rào cản từ bên ngoàiNhìn rộng ra châu Âu, theo luật hiện hành của Liên Hiệp Châu Âu, các thành viên không được phép gửi trả di dân về những nước mà chính quyền thường tra tấn các nhà đối lập chính trị hay người thiểu số về tôn giáo, hoặc họ có nguy cơ bị đối xử vô nhân đạo. BFMTV ngày 15/10 trích dẫn Camille Escuillié, một luật sư về quyền của người nước ngoài và quyền tị nạn, theo đó những nước thường được nhắc đến là Nga, Sudan, Afghanistan, Yemen.Pháp đã hai lần bị Tòa án nhân quyền châu Âu phạt vì trục xuất người Chechnya, nhưng đây chỉ là án phạt tiền, không mang tính ràng buộc hình sự. AFP ngày 18/10/2023 cho biết cánh hữu « đề nghị cải cách Hiến Pháp để cho phép nước Pháp không tuân thủ luật pháp quốc tế về các vấn đề di dân, nhân danh lợi ích quốc gia ». Tuy nhiên, những vướng mắc pháp lý không phải chỉ liên quan đến nước Pháp hay Liên Âu. Có thể nói là chính quyền Pháp không thể toàn quyền đơn phương thực hiện việc trục xuất. Chẳng hạn, đối với một người nước ngoài không có hộ chiếu của nước nguyên quán, chính quyền Pháp cần có được một loại « giấy thông hành » do cơ quan lãnh sự nước nguyên quán của đương sự cấp thì mới có thể gửi trả người về nước đó. Vấn đề nằm ở chỗ một số nước đang có khủng hoảng ngoại giao với Pháp sẽ từ chối cấp giấy phép đó.Đơn cử là trường hợp Algerie hồi cuối năm 2021. Theo tiết lộ từ bộ Nội Vụ, được trang mạng điều tra độc lập Mediapart và Street Press, trích dẫn, Alger đã yêu cầu các lãnh sự quán ở Pháp không cấp bất cứ giấy thông hành lãnh sự nào cho phía Pháp, cản trở việc Paris trục xuất người Algerie. Trong bài viết đăng trên báo Le Figaro ngày 23/10, François-Henri Briard, luật sư tại Tham Chính Viện và Tòa phá án cho biết Algerie chỉ cấp 22 giấy thông hành cho phép Pháp trục xuất người Algerie trong khi có tới hàng ngàn người Algerie bị Pháp ra lệnh rời khỏi Pháp. Ngoài Algerie thì các nước Bắc Phi Maroc, Tunisie cũng thiếu thiện chí hợp tác với Pháp về vấn đề này, đôi khi vì các lý do chính trị.Một điều kiện khác là phải có chuyến bay thẳng nối Pháp với nước đó. Nếu phải nối chuyến bay thì thủ tục sẽ rất phức tạp, sẽ phải xin visa quá cảnh ở một nước thứ ba, không chỉ cho người bị trục xuất mà cả phái đoàn áp giải. Ngày 16/10, Le Monde cho biết vào ngày 11/10, Tòa phúc thẩm Paris đã buộc phải trả tự do cho một người Nga vì cơ quan chịu trách nhiệm tổ chức chuyến bay trục xuất người này từ Pháp đến Nga đã không tìm được giải pháp, kể cả là chuyến bay quá cảnh tại một nước thứ ba.  Không phải cứ muốn là được ! Dù chính phủ Pháp đang rất quyết tâm trong việc đẩy mạnh khả năng trục xuất người nước ngoài nguy hiểm, nhưng trong bối cảnh hiện nay, rào cản pháp lý từ nhiều phía là không ít và cũng không dễ được khắc phục.

Mardi 24 janvier, on apprenait qu'Emmanuel Macron invitait secrètement 10 éditorialistes de 10 médias différents à déjeuner à l'Élysée. Dans quel but, vous demandez-vous ? Leur transmettre les éléments de langage de la macronie, destinés à influencer une opinion publique hostile au projet de réforme des retraites. Alors, hasard du calendrier, ou pas, cette entrevue a eu lieu 48h avant la manifestation historique du 19 janvier. Les réactions ont donc été nombreuses. Beaucoup d'indignation de la part des internautes sur les réseaux sociaux sur cette entrevue aux airs de briefing de campagne. Une sale histoire, qui sert encore à nourrir la méfiance envers les médias mainstream les réduisant, avec leurs journalistes à des « perroquets du pouvoir ». Une bonne opportunité pour vous rappeler qu'ici, au Média, on parle de politique mais on n'en fait pas. Mais les réactions de l'autre camp se sont aussi fait entendre, prenant la défense du principe de Off, longtemps pratiqué dans le milieu du journalisme politique. Chaque semaine dans ce club de la presse, l'un-e des prétendant-es a la mandature suprême sera cuisiné-e par des journalistes de Le Média, Regard, Radio Parleur et StreetPress.L'invité : Anasse Kazib, cheminot, délégué syndical à SUD Rail, il est le candidat du parti Révolution Permanente.
