Two murder cases. Two very different defense strategies. Defense attorney Bob Motta joins True Crime Today to break down both.Aaron Spencer's trial just got a new judge after the Arkansas Supreme Court removed Barbara Elmore for constitutional violations—the second time in seven months. Spencer faces second-degree murder for killing Michael Fosler, the man out on bond for allegedly raping his 14-year-old daughter. The defense is arguing he saved his child. The prosecution has prior statements suggesting premeditation. And now a retired judge from the other side of the state is inheriting the most divisive case in Arkansas.Michael McKee pleaded not guilty to four counts of aggravated murder in the deaths of his ex-wife Monique Tepe and her husband Spencer Tepe. His lawyer is Diane Menashe—who got Dr. William Husel acquitted of fourteen ICU murders by calling one witness and watching the state's case crumble. The prosecution has ballistics, surveillance, vehicle tracking, a suppressor. Menashe doesn't present defenses. She destroys prosecutions.Bob Motta analyzes both cases: what judicial removal means for Spencer, how to defend a father who killed his daughter's alleged abuser, whether Menashe's Husel playbook works against different evidence, and what both cases tell us about murder defense strategy in high-profile trials.#BobMotta #TrueCrimeToday #AaronSpencer #MichaelMcKee #MoniqueTepe #JudgeElmore #DianeMenashe #MurderDefense #HuselAcquittal #DefenseStrategyJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Breaking down the defense strategy in the Michael McKee case. The vascular surgeon accused of killing Monique and Spencer Tepe in their Columbus home has retained Diane Menashe — arguably Ohio's most successful defense attorney. Her resume includes walking Dr. William Husel after 14 murder charges and saving multiple clients from death row against overwhelming evidence.Today on True Crime Today, we analyze what Menashe might do with a case that looks unwinnable on paper. The ballistics match through NIBIN that defense attorneys know isn't courtroom-proof science. The murky Ring camera footage that could become a battle of experts. The eight-year gap between McKee's divorce and the alleged murders that complicates the premeditation narrative. And McKee's documented spiral — malpractice suits he allegedly dodged with fake addresses, an expired medical license, colleagues saying he "just disappeared" — that could support a diminished capacity argument.Prosecutors haven't disclosed a motive. They've called it "targeted domestic violence" but haven't explained why a surgeon would drive 325 miles to kill an ex-wife who left him eight years ago. Menashe will exploit that gap.McKee isn't fighting for acquittal. He's fighting to avoid the harshest sentence — life without parole versus life with parole eligibility after 32 years. That's the game now.The Tepe children — ages 4 and 1 — were in the house that night. They'll grow up without their parents. And the man accused of taking them has hired the best defense money can buy.#TrueCrimeToday #MichaelMcKee #TepeCase #DianeMenashe #SpencerTepe #MoniquTepe #CrimeNews #MurderTrial #DefenseStrategy #BreakingCrimeJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Dr. Michael McKee is facing four counts of aggravated murder for allegedly killing his ex-wife Monique Tepe and her husband Spencer in their Columbus home on December 30th. The prosecution has ballistics. Vehicle tracking. Video footage. A suppressed weapon. No forced entry. And McKee just hired Diane Menashe. If that name doesn't mean anything to you, it should. In 2022, Menashe co-counseled the defense of Dr. William Husel — the Mount Carmel physician charged with murdering 14 patients with fentanyl overdoses. The prosecution called 53 witnesses over six weeks. Menashe called one. Husel walked on every count. She also kept Reagan Tokes' killer Brian Golsby off death row when eight jurors wanted him executed. She saved cop-killer Quentin Smith from lethal injection.Diane Menashe doesn't do hopeless cases. She does cases everyone else thinks are hopeless — and finds the fractures in the prosecution's fortress.Today we analyze her potential defense strategy: attacking the NIBIN ballistics match that isn't as ironclad as it sounds, questioning the shadowy Ring camera identification, exploiting the missing motive, and potentially presenting McKee's documented spiral — malpractice suits, disappearing from colleagues, expired licenses — as evidence of psychological deterioration rather than cold premeditation.McKee isn't walking free. The evidence is too damning. But the difference between life with parole eligibility and life without parole? That's what Menashe fights for. That's what money buys. Two orphaned children. A thousand mourners. And the best defense attorney in Columbus.#HiddenKillers #MichaelMcKee #MoniquTepe #SpencerTepe #DianeMenashe #TrueCrime #MurderDefense #WilliamHusel #OhioMurder #DomesticViolenceJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Defense attorney Bob Motta joins me for a two-part legal breakdown of the biggest murder case developments this week.First: Aaron Spencer. The Arkansas Supreme Court removed Judge Barbara Elmore from his second-degree murder trial—the second time they've reversed her on constitutional grounds in seven months. Spencer killed Michael Fosler, the man out on bond for allegedly raping his 14-year-old daughter. Now a retired judge is taking over, prior rulings could be reconsidered, and the defense has to figure out how to counter Rule 404(b) statements about what Spencer said he'd do if Fosler came near his daughter again.Second: Michael McKee. He pleaded not guilty to four counts of aggravated murder in the deaths of his ex-wife Monique Tepe and her husband Spencer Tepe. His lawyer is Diane Menashe—the same attorney who got Dr. William Husel acquitted of fourteen ICU patient murders by calling one witness. The prosecution has ballistics, surveillance, vehicle tracking, and a suppressor. Menashe doesn't present defenses. She dismantles prosecutions.Bob Motta breaks down both cases. What judicial removal means for Spencer. How defense-of-others works against premeditation evidence. Whether Menashe can replicate the Husel strategy against different evidence. Two murder trials. Two defense approaches. One expert analysis.#BobMotta #AaronSpencer #MichaelMcKee #MoniqueTepe #JudgeBarbaraElmore #DianeMenashe #MurderTrial #SelfDefense #HuselAcquittal #HiddenKillersJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? We're going live with defense attorney Bob Motta for comprehensive legal analysis on two of the biggest murder cases right now.The Arkansas Supreme Court just removed Judge Barbara Elmore from Aaron Spencer's trial—the father who killed his daughter's alleged rapist. This is the second constitutional reversal in seven months. A retired judge is taking over. Prior rulings could be reopened. And Spencer still has to beat a second-degree murder charge while the prosecution uses prior statements about killing Fosler against him.Meanwhile, Michael McKee pleaded not guilty to four counts of aggravated murder in the deaths of Monique Tepe and Spencer Tepe. His attorney is Diane Menashe—who got Dr. William Husel acquitted of fourteen murders by calling one witness and letting the prosecution's case collapse. The state has ballistics, surveillance, vehicle tracking, and a suppressor. But Menashe doesn't defend cases—she attacks them.Bob Motta walks us through both situations live. How rare judicial removal is. What the new judge changes for Spencer. How defense-of-others works in practice. Whether Menashe's philosophy can beat the McKee evidence. We're taking your questions and comments as we break down the legal realities behind these cases.#BobMottaLive #AaronSpencer #MichaelMcKee #MoniqueTepe #JudgeElmore #DianeMenashe #TrueCrimeLive #MurderDefense #LegalAnalysis #HiddenKillersLiveJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Michael McKee hired the attorney who got Dr. William Husel acquitted of fourteen murders. Diane Menashe called one witness in that trial. Husel walked on all fourteen counts. Now she's representing another doctor charged with murder—and the parallels are striking. Overwhelming evidence. Medical professional defendant. High-profile case. And a defense attorney who doesn't build cases—she dismantles prosecutions.McKee faces four counts of aggravated murder for the deaths of his ex-wife Monique Tepe and her husband Spencer Tepe. Police have ballistics linking a firearm from McKee's Chicago condo to shell casings at the crime scene. Vehicle tracking from Columbus back to Illinois. Surveillance footage allegedly showing McKee behind the Tepe home. A suppressor specification. No signs of forced entry. Family members say McKee was emotionally abusive and threatened Monique's life—but there's nothing in the official record for eight years between the divorce and the murders.Defense attorney Bob Motta joins True Crime Today to analyze Menashe's likely approach, how she could attack the ballistics evidence, and whether the eight-year gap creates reasonable doubt about motive. We examine what the no-forced-entry detail could mean for an alternative theory, how the suppressor specification affects the premeditation argument, and what it means that the lead prosecutor is trying her first felony case against a 27-year defense veteran.#MichaelMcKee #MoniqueTepe #SpencerTepe #TrueCrimeToday #DianeMenashe #BobMotta #DrWilliamHusel #AggravatedMurder #FranklinCounty #ColumbusOhioJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Michael McKee is now represented by the attorney who got Dr. William Husel acquitted of fourteen murder charges by calling one witness. Diane Menashe doesn't put on defenses. She tears apart prosecutions. She's said publicly that once defense attorneys start presenting evidence, they assume the burden of proving their client innocent—so she avoids it. She lets the state's case fall on its own weight.McKee faces four counts of aggravated murder in the deaths of his ex-wife Monique Tepe and her husband Spencer Tepe. The prosecution has ballistics through NIBIN linking a firearm from McKee's Chicago condo to shell casings at the crime scene. They have vehicle tracking data. Surveillance footage allegedly placing McKee in the alley behind the Tepe home. A suppressor specification carrying six additional years. No forced entry. And an eight-year gap between the divorce and the murders with no documented incidents between McKee and Monique.Defense attorney Bob Motta joins me to analyze how Menashe might attack each piece of evidence, whether the no-forced-entry problem actually helps the defense, and what the eight-year gap between divorce and murder means for both sides. We examine the prosecution's inexperience—Franklin County Prosecutor Shayla Favor is trying her first felony case ever—and whether that creates openings for a 27-year defense veteran. McKee is now represented by Diane Menashe—the Columbus defense attorney who got Dr. William Husel acquitted of fourteen murder charges in 2022 by calling one witness and letting the prosecution's case collapse. The evidence against McKee appears substantial. The man accused of murdering Monique Tepe and her husband Dr. Spencer Tepe pleaded not guilty on January 23rd to four counts of aggravated murder. Michael McKee, 39, Monique's ex-husband, appeared via video before a Franklin County magistrate and waived bond. He remains in custody. Prosecutors allege McKee, a vascular surgeon, traveled from Illinois to Columbus and killed the couple in the early morning hours of December 30th. Spencer was shot multiple times. Monique sustained a gunshot wound to the chest. Their two children, ages four and one, were found inside the home unharmed. Columbus Police Chief Elaine Bryant has called this a "targeted" and "domestic violence related attack." Investigators say surveillance footage places McKee's vehicle at the scene before and after the killings. When multiple firearms were seized from his Rockford property, preliminary ballistic analysis linked one weapon to three 9mm shell casings recovered from the Tepe residence. The charges carry firearm specifications for using a gun and a suppressor. McKee is represented by Diane Menashe, who previously defended Dr. William Husel. Monique divorced McKee in 2017. She married Spencer in 2019. If convicted, McKee faces a minimum of life with parole eligibility after 32 years—or life without parole.#MichaelMcKee #MoniqueTepe #SpencerTepe #TepeMurders #ColumbusOhio #AggravatedMurder #BallisticEvidence #DomesticViolenceHomicide #JusticeForTepe #TepeCaseJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? The surgeon accused of killing Monique and Spencer Tepe in their Columbus home entered a not guilty plea Friday. Michael McKee stood silent while his defense attorney, Diane Menashe, spoke for him. That choice of attorney tells you everything about how this case is going to be fought.Menashe is the same lawyer who defended Dr. William Husel in 2022 — the Mount Carmel physician charged with murdering fourteen patients through allegedly lethal fentanyl doses. She called one witness during the entire defense. Husel was acquitted on all counts. Now she's representing another doctor facing murder charges. The prosecution includes Franklin County Prosecutor Shayla Favor, taking on her first felony case after a career in property code enforcement. She'll be supported by veteran homicide prosecutors, but the matchup raises questions about experience and strategy in a case drawing national attention.Today we break down what the not guilty plea signals, how Menashe's defense philosophy could shape the trial, and the new details emerging about McKee's pattern of evasion — including a malpractice lawsuit that couldn't locate him for months before the killings. Process servers found fake addresses, TVs turning off when they knocked, and colleagues who said he "just disappeared."The battle lines are drawn. Michael McKee entered his not guilty plea Friday. Silent. Stoic. His attorney did the talking. And if you want to understand what's coming in this case, you need to understand who that attorney is.Diane Menashe defended Dr. William Husel — the Mount Carmel physician accused of murdering fourteen ICU patients with lethal fentanyl doses. She called one witness. One. Husel walked on all fourteen counts. That's the playbook. That's who McKee hired. The prosecution team includes Franklin County Prosecutor Shayla Favor, who has never tried a felony case in her career. She's third chair behind experienced prosecutors, but the optics are impossible to ignore. The heavyweight versus the newcomer. The doctor-defender versus the property code attorney. This episode goes deep on the legal chess match ahead. We break down Menashe's philosophy — why she believes presenting a defense shifts the burden to prove innocence. We examine what the suppressor allegation means for premeditation charges. And we dig into McKee's pattern of vanishing: fake addresses, expired licenses, process servers who couldn't find him for months before the murders. The evidence police have described sounds substantial. But Diane Menashe has beaten substantial before. The ballistic match that prosecutors say connects Dr. Michael McKee to the murders of his ex-wife and her husband is now central to the case against him. McKee, a 39-year-old vascular surgeon, pleaded not guilty on January 23rd to four counts of aggravated murder in the deaths of Monique Tepe and Dr. Spencer Tepe. The couple was found shot to death in their Weinland Park home on December 30th. Spencer had been shot multiple times; Monique sustained a gunshot wound to the chest. Their children, ages four and one, were in the home but physically unharmed. Columbus police say surveillance footage tracked McKee's vehicle to the neighborhood during the timeframe of the killings. When investigators seized firearms from his Illinois property, preliminary analysis through the National Integrated Ballistic Information Network tied one weapon to three 9mm shell casings recovered from the Tepe residence. McKee is represented by defense attorney Diane Menashe, who previously represented Dr. William Husel in the Mount Carmel hospital deaths case. The prosecution team includes newly-elected Franklin County Prosecutor Shayla Favor. Monique and McKee divorced in 2017. She married Spencer in 2019. A 911 call from April 2025 captured someone at the Tepe address saying she and her partner "got into it" before declining police assistance.#TepeMurders #MichaelMcKee #MoniqueTepe #SpencerTepe #ColumbusOhioMurder #DomesticViolenceHomicide #WeinlandPark #TrueCrimePodcast #JusticeForTepe #HiddenKillersJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? On December 5, 2018, Mount Carmel Health System in Columbus, Ohio fired Dr. William Husel after an investigation into his treatment of patients as the late shift physician in the hospital’s intensive care unit. The investigation had started less than two months prior, when the first of three formal reports regarding Husel’s care were submitted to hospital administration. These reports, filed by two hospital pharmacists, raised concerns over Dr. Husel’s use of excessive painkillers in his treatment of patients. In all, the hospital found that at least 35 patients were affected by Dr. Husel’s actions over the course of four years. These patients, most of the gravely ill, had received oversized doses of fentanyl, at two hospitals in the Mount Carmel Health System, Mount Carmel West and Mount Carmel St. Ann’s. In the case of female one patient, the investigations found that she was given about 20 times the upper end of a dose recommended by Food and Drug Administration guidelines. Of these 35 patients, care provided to 29 were determined to be potentially fatal. Five of the patients were found to have had the opportunity for treatment that may have improved their conditions. The Mount Carmel investigation would lead to the firing of at least 23 employees, the resignation of two executives, and Dr. William Husel being arrested and charged with 25 counts of murder. So on today’s episodes, we will be discussing the case against Dr. William Husel and try to decide if what occurred at Mount Carmel was compassion care or was it murder. --- Send in a voice message: https://anchor.fm/crimepedia/message Support this podcast: https://anchor.fm/crimepedia/support
