Sam is live again from the Mass Torts Conference in Las Vegas! Cameron Stephenson is the next attorney to join, diving into the recent proliferation of GLP-1RA drugs, from the FDA's approval of Ozempic as a diabetes medication in 2017, through the now sixth variation between Novo Nordisk and Eli Lilly that focuses more on medical (or even cosmetic) weight loss, and the pharmaceutical industry's complete failure to properly warn some millions and millions of patients about serious risks and side effects associated with the drug class – namely gastroparesis. After expanding on the particular role off-label marketing of cosmetic uses played in contributing to the pervasion of GLP-1RAs – despite the relatively minor financial penalties associated with it – Stephenson wraps up the interview by unpacking the impact of this pharmaceutical malpractice, and the importance of civil law in pushing for genuine change. After touching on the important distinction between mass torts and class action lawsuits, Sam is joined by Attorney Kim Adams with Levin Pappantonio to discuss her ongoing litigation against the Canadian porn company formerly known as MindGeek (now Aylo) for encouraging, facilitating, and helping to disseminate child pornography on their site, unpacking the law (Section 230) that protects platforms from legal liability for third-party content and the tension between that and the active production, curation, boosting, and highlighting of said liable content, not to mention the heightened responsibility for pornography companies to be aware of the content the platform and sponsor. Next, Andy Birchfield from Beasley Allen joins, diving right into the ever-ongoing case against Johnson & Johnson for their manufacturing, sale, and promotion of their Talc-based baby powder formula despite internal awareness of the presence of asbestos and the devastating medical impact it can have on mothers and their children, with a particular focus on J&J knowingly marketing this toxic powder as a feminine hygiene product and the resulting development of ovarian cancer amongst consumers. Next, Birchfield dives deep into J&J's implementation of the “Texas Two-Step” legal maneuver to avoid responsibility, splitting off all of its liabilities from its assets into a separate company, before immediately moving said company to the asbestos-liability haven of North Carolina, where it would attempt to declare bankruptcy and render any attempts at accountability or compensation null. You may know Fred Levin as the father of the Florida tobacco lawsuits. He rewrote the Florida Medicaid Third Party Recovery Act in 1993 to allow the state of Florida to sue the tobacco industry, eventually settling for $13 billion and forever changing the face of tobacco litigation in the United States. But if not for a stubborn client who refused to settle an insurance case nearly 60 years ago, Fred might not have become a trial lawyer. Among his many honors, is the Perry Nichols Award - the FJA’s most prestigious. It’s given to an attorney whose perseverance, commitment, and unmatched dedication to the civil justice system is at the forefront of his or her life. Fred Levin, now age 80, sat down with Florida Justice Association Radio host Harvey Bennett in late August 2017 to discuss the keys to his success, his few regrets, the ethics problems he sees in the trial bar, and his advice to those practicing trial law today – or thinking about it.
