The U.S. Justice Department has announced its intent to seek the death penalty for Payton Gendron, the individual responsible for a racially motivated shooting that claimed the lives of 10 people at a Tops Supermarket in Buffalo, New York, in May 2022. This decision marks a significant development in a case that has gripped the nation.    Federal prosecutors filed a court document outlining their rationale for pursuing the death penalty, stating, "United States believes the circumstances in Counts 11-20 of the Indictment are such that, in the event of a conviction, a sentence of death is justified." His goal was to "inspire others to commit similar attacks," as stated in a criminal complaint. The rifle used in the shooting bore markings with phrases such as "here's your reparations" and "the great replacement."    The decision to seek the death penalty by the Justice Department follows over a year of deliberations. Attorney General Merrick Garland had previously expressed concerns about the death penalty, and President Joe Biden had campaigned on abolishing it at the federal level. However, in the absence of a formal policy, the DOJ had engaged in discussions regarding a "worst-of-the-worst" threshold for cases involving extreme acts of hate-fueled violence.    In response to the DOJ's announcement, the defense team expressed deep disappointment. Sonya Zoghlin, an assistant federal defender, conveyed their frustration, suggesting that the government's efforts could be better spent addressing the underlying issues that facilitated the crime, including easy access to deadly weapons and the failure of social media companies to moderate hateful rhetoric online.    Gendron had previously faced sentencing on state charges, resulting in a life imprisonment without parole sentence in February 2023. During that sentencing hearing, Gendron briefly offered an apology, acknowledging his actions and the pain he caused. He pleaded guilty to 15 charges, including domestic terrorism motivated by hate, murder, and attempted murder.    While the pursuit of the death penalty has been met with mixed reactions, some family members of the victims welcomed the decision. Mark Talley, the son of shooting victim Geraldine Talley, expressed his desire to see Gendron suffer and stated, "As long as I'm alive, I wanna be able to see him suffer." Others in the community echoed the sentiment that the death penalty should serve as a deterrent against such heinous crimes.    Buffalo Mayor Byron Brown and New York Gov. In May of last year, Tops Supermarket in East Buffalo was attacked by a lone white supremacist. Motivated by “great replacement theory,” the shooter targeted an area densely populated with Black residents, leaving this community grief-stricken. Into America visited Buffalo and spoke with residents shortly after the incident, so now, on the anniversary of the shooting, Trymaine Lee headed back to East Buffalo to revisit this community which has found strength and healing through each other.Trymaine Lee speaks with Trinetta Alston, a nurse who's made it her mission to look after the Tops survivors. Tops Friendly Market has now re-opened in East Buffalo, two months after a white supremacist walked into a the supermarket with guns blazing. Motivated by previous racist attacks and the false and insidious“great replacement theory,” the shooter live-streamed his killing spree, during which he took the lives of ten members of Buffalo's Black community. The victims included parents, the elderly, a beloved community activist and the security guard who died shooting back.Tops closed down for months, dealing another blow to the hard-hit community. Geraldine Chapman Talley, 62, died tragically May 14, 2022 when she was one of 10 people shot and killed by a mass shooter in the Tops Supermarket in Buffalo, NY where she was a longtime resident. Known as Gerri, she was born June 3, 1959, the eighth child of the late Fannie Beatrice and James Robert Chapman in Grove Hill, Alabama. She attended school in Grove Hill before moving with her family to Buffalo in 1971 where she graduated from East High School in 1977. She attended Bryant & Stratton Business School. On the afternoon of May 14th, Payton Gendron, eighteen years old and a self-proclaimed white supremacist, arrived outside a Tops Supermarket located in Buffalo, New York.  Armed with an AR-15 type rifle, Gendron began firing off rounds in the parking lot, fatally shooting three shoppers.  He then entered the grocery store where his killing spree continued.  When all was said and done, Gendron had murdered 10 people and injured three others.  Almost all of the victims were African-American.Perhaps not surprisingly, Gendron had purchased the assault rifle legally from dealers in New York and northern Pennsylvania.  Background checks came back negative.  Although he had undergone a psychiatric evaluation in 2021 after submitting a high school project in which he threatened to commit a murder-suicide at a high school, his actions did not trigger New York's Red-Flag law which prevents anyone who shows signs of being a threat to themselves or others from purchasing a firearm.  In this Episode of The Blame Game, we try to answer the question of, who, if anyone, is to blame for this shooting and the resulting tragic loss of life?  Who, if anyone, is legally responsible for the murders that were committed inside the Tops supermarket? And to help us answer these questions, we turn to the Dunleavy in Kramer, Dunleavy & Ratchik, Denise Dunleavy.  In 1999, Ms. Dunleavy received the Trial Lawyer of the Year award from Trial Lawyers for Public Justice for her work against the gun industry.  In her precedent-setting victory in Hamilton v. Accu-Tek, she convinced a jury to hold gun manufacturers liable for negligently marketing and distributing handguns in the New York City area.

This episode follows days after a tragic event in the United States--in Buffalo known as the City of Good Neighbors.  Eva M. Doyle writes her column of 44 years "Eye On History" for the nearly 100-year-old Black newspaper The Buffalo Criterion. Ms. Doyle--known as Mother Doyle--happened to change her plans from her routine 2pm Saturday grocery run to Tops Supermarket  and picked up her dry cleaning instead. She avoided death that day. But her colleague, fellow writer Katherine "Kat" Massey, did not. Tops is the lone supermarket in this part of Buffalo's East Side, and it is now temporarily closed.  The attack highlights how the city's legacy of institutionalized racism and segregation has given rise to food access and inequities in the communities affected.  In the aftermath, community-based providers are stepping in to address the food insecurity that continues to plague low-income communities of color.  We speak with Allison DeHonney, Founder and CEO of Buffalo Go Green, whose organization is working to address food inequities in Buffalo's East Side, and Craig Willingham, Managing Director for CUNY Urban Food Policy Institute.
