Master Corporal (Ret'd) James Gendron's story is one of service, sacrifice, and the healing power of music. Over a 29-year career in the Canadian Armed Forces, James performed 63 ramp ceremonies in Afghanistan—solemn farewells for fallen soldiers making their final journey home. Those experiences left deep scars, leading him to put down his bagpipes altogether.Years later, the pipes returned to him in the most unexpected way—culminating in a powerful moment at the 2023 Invictus Games in Düsseldorf, where Prince Harry publicly honoured James for transforming what once haunted him into a source of healing. In this conversation, we explore:James' path from cadets to 29 years of military serviceThe stark contrast between combat operations in Afghanistan and humanitarian missions in Sri LankaThe emotional toll of ramp ceremonies and the burden of remembranceHow music became both a trigger and a lifelineHis Invictus Games journey, the moment with Prince Harry, and life after serviceJames now serves his community as a volunteer firefighter and continues to share his story to help others navigate trauma, healing, and resilience.Thank you for listening! This Day in Legal History: Fourteenth Amendment RatifiedOn July 28, 1868, the Fourteenth Amendment to the United States Constitution was officially adopted, reshaping the legal and constitutional landscape of the nation. Ratified in the wake of the Civil War, it was one of the Reconstruction Amendments designed to integrate formerly enslaved people into American civic life. Section 1 of the amendment granted citizenship to "all persons born or naturalized in the United States," effectively nullifying the Supreme Court's decision in Dred Scott v. Sandford (1857), which had held that Black people could not be citizens. The amendment also introduced two foundational legal principles: the Due Process Clause and the Equal Protection Clause. These clauses placed new limitations on state governments, barring them from infringing on individual rights and mandating that laws be applied equally to all people. The Due Process Clause would later become a cornerstone in expanding civil liberties, providing the basis for numerous Supreme Court decisions involving privacy, marriage, and bodily autonomy. The Equal Protection Clause became instrumental in the fight against racial segregation and discrimination, notably underpinning Brown v. Board of Education (1954), which dismantled “separate but equal” doctrine in public education.Initially resisted by many Southern states, the amendment's ratification was made a condition for reentry into the Union. Over time, its scope grew far beyond the post-Civil War context, influencing legal battles on gender equality, LGBTQ+ rights, and immigration. It also played a critical role in the doctrine of incorporation, through which many protections in the Bill of Rights became applicable to state governments. The Fourteenth Amendment remains one of the most litigated and interpreted sections of the Constitution, central to the American concept of civil rights and liberties.A&O Shearman has postponed the start date for some of its incoming associates until January, according to a source familiar with the matter. The firm typically offers new associates a choice between two start dates and provides a salary advance to those opting for the later one. The decision comes amid broader industry trends of delaying associate onboarding as a cost-management strategy in response to uneven client demand, despite overall revenue growth among top firms.Formed through the May 2024 merger of Shearman & Sterling and Allen & Overy, A&O Shearman is now the fourth-largest law firm by revenue. While the firm's revenue has benefited from broader sector gains, it faces challenges tied to economic uncertainty and trade tensions. Internally, a cohort of associates had reportedly resisted leadership shortly before the firm joined other legal powerhouses in agreements involving legal services to President Trump—moves seen as efforts to fend off sanctions and settle federal investigations into workplace diversity practices. The firm also experienced a recent exodus in its London office, with nine lawyers, including eight associates, departing in June.A&O Shearman Pushes Start Date to January for Some AssociatesA New York state appeals court has ruled that social media companies cannot be held legally responsible for the 2022 mass shooting in Buffalo that left 10 people dead. The court reversed a lower court's decision, finding that platforms like Facebook, Instagram, YouTube, and Reddit are shielded by Section 230 of the federal Communications Decency Act, which grants online platforms immunity from liability for user-generated content. The lawsuit alleged that these platforms were designed to addict and radicalize users, including the shooter, Payton Gendron.Justice Stephen Lindley, writing for the 3-2 majority, argued that holding platforms liable would threaten the open nature of the internet and contradict Congress's intent to foster innovation and limit government interference. He acknowledged the horrific nature of the shooting and the hateful content that influenced it but warned that allowing liability would cause the internet to collapse into tightly restricted message boards.Dissenting justices contended that the platforms actively pushed extremist content through targeted algorithms, suggesting that this behavior went beyond neutral hosting. Other platforms used by Gendron, including Amazon, Discord, 4chan, Snap, and Twitch, were also named in the lawsuit. Gendron is currently serving a life sentence without parole after pleading guilty to state charges, and he still faces federal charges that may lead to the death penalty.Social media companies not liable for 2022 Buffalo mass shooting, New York court rules | ReutersA federal judge in Massachusetts has reaffirmed a nationwide injunction blocking President Donald Trump's executive order that sought to limit birthright citizenship. Judge Leo Sorokin ruled that only a nationwide halt could fully protect the coalition of 22 Democratic-led states challenging the policy, rejecting arguments from the Trump administration that a narrower ruling would suffice following a recent Supreme Court decision. The executive order, signed on Trump's first day back in office in January, directed federal agencies to deny citizenship to U.S.-born children unless at least one parent was a U.S. citizen or lawful permanent resident.Judge Sorokin found that allowing the policy to take effect even in some states would harm immigrant families and disrupt federal benefits programs like Medicaid. Plaintiffs argued it would create a confusing and unfair patchwork of citizenship rules and overwhelm states not enforcing the order. The Trump administration maintained that the Constitution was being misinterpreted, and signaled plans to appeal.Although the Supreme Court recently limited the use of nationwide injunctions, it allowed exceptions under certain conditions—exceptions Sorokin found applicable here. Meanwhile, a separate federal appeals court in California also ruled that Trump's executive order violated the 14th Amendment's Citizenship Clause and blocked it nationwide.US judge reaffirms nationwide injunction blocking Trump executive order on birthright citizenship | ReutersCalifornia has dropped plans to require Internet service providers (ISPs) to offer $15-per-month broadband plans to low-income residents, following pressure from both the Trump administration and major telecom companies. Assemblymember Tasha Boerner, who led the effort, said her office was warned that enforcing such a law could jeopardize California's access to $1.86 billion in federal Broadband Equity, Access, and Deployment (BEAD) funding. The administration's revised BEAD rules prohibit states from setting explicit or implicit broadband pricing requirements.Despite earlier court wins by New York upholding a similar law, Boerner chose to pull the bill after the National Telecommunications and Information Administration (NTIA) confirmed that even applying for BEAD funds could exempt ISPs from state pricing rules. Advocates and lawmakers criticized the move as a giveaway to large corporations, arguing it undermines efforts to ensure affordable internet access. Boerner had already watered down the bill in negotiations with ISPs, reducing required speeds and allowing ISPs to handle eligibility verification—both points that drew backlash from digital equity groups.Advocates argued the BEAD funding was intended for new broadband infrastructure, while the California bill focused on existing networks, meaning the NTIA's restrictions shouldn't apply. Critics also pointed out that the proposed speed standards were below the federal definition of broadband, and that delegating verification to ISPs risked privacy and access issues. While Boerner acknowledged the need for affordable broadband, she said the risk of losing billions in federal funds wasn't worth pushing the mandate. A separate Senate bill aims to encourage, but not require, ISPs to offer low-cost plans by linking them to subsidies.California backs down to Trump admin, won't force ISPs to offer $15 broadband - Ars Technica This is a public episode. Mike Gendron joins the podcast to discuss the critical issue of salvation and the teachings of the Catholic Church. He shares his journey from being a devout Catholic to becoming a biblical apologist, emphasizing the stark contrast between Catholic doctrine and scriptural truths regarding salvation. Gendron argues that many evangelicals are leaving their faith for Catholicism, often due to misunderstandings of scripture and the allure of tradition. Through his extensive experience, he aims to equip listeners with the knowledge to respond biblically to the growing influence of Catholicism in society. Ultimately, he encourages a return to the authority of Scripture as the foundation for understanding faith and salvation.Takeaways: Mike Gendron emphasizes the importance of relying solely on Scripture for understanding salvation, contrasting it with Catholic teachings that include additional requirements. The episode discusses the alarming trend of evangelical Protestants converting to Catholicism, often due to dissatisfaction with modern Protestant practices. Gendron shares personal experiences that led him to abandon Catholicism, focusing on the transformative power of the Gospel as revealed in the Bible. The dialogue stresses that true assurance of salvation is found in faith alone in Christ, rather than in religious rituals or sacraments that Catholicism promotes. In these dark times, we must fight evil with the most powerful weapons we have. The Rosary is foremost among them.Join the Great Rosary Campaign today at: www.GreatRosaryCampaign.com.The Great Rosary Campaign is a yearlong mission for the conversion of cultural leaders. We will announce a weekly call to pray every Sunday for specific fallen-away Catholics and non-Catholics.THIS WEEK of the Great Rosary Campaign we are praying for Mike Gendron, a former Catholic who is now a prominent anti-Catholic apologist. Unfortunately, Gendron often egregiously misrepresents the Faith, and basic facts of history. We hope and pray that he comes back Home to the Catholic Church. The SUGGESTED PENANCE this week is a 24 hour water fast (adjust per your circumstances).Countless Saints and Popes have told us that the Rosary is incredibly powerful for three things in particular:Keeping the FaithMoral renovationConversions of non-CatholicsThe Great Rosary Campaign is also based on several biblical themes and principles.First, PRAY FOR OUR BRETHREN. “Pray for one another…” (Jas. 5:16). “So then, as we have opportunity, let us do good to all men, and especially to those who are of the household of faith" (Gal. 6:10).Second, PRAY FOR OUR ENEMIES. “You have heard that it was said, ‘You shall love your neighbor and hate your enemy.' But I say to you, Love your enemies and pray for those who persecute you, so that you may be sons of your Father who is in heaven" (Matt. 5:43-44).Third, PRAY FOR ALL MEN, PARTICULARLY LEADERS AND THOSE IN AUTHORITY. “First of all, then, I urge that supplications, prayers, intercessions, and thanksgivings be made for all men, or kings and all who are in high positions…” (1 Tim. 2:1-2).Fourth, GOING INTO BATTLE WITH THE ARK. When the ancient Israelites came to Jericho, God didn't tell them to besiege the city. Instead, He told them to march around it with the Ark of the Covenant seven times, and on the seventh the walls would fall. We will now "march" in prayer for seven days with the New Ark of the Covenant, Our Lady, through the Rosary. We pray in hope that on the seventh day, a day especially devoted to Our Lady (Saturday), extraordinary graces of conversion will be given to those we are praying for.Fifth, EVANGELISM AND APOLOGETICS = LOVE + ARGUMENTS + PRAYER + PENANCE. Ultimately it is God who reveals Himself to a soul, and empowers them to say "yes" to Him by His grace. He chooses to use us, but He does not have to. We must remember that as we evangelize and defend the Faith, our arguments will be fruitless unless informed by love (charity), and reinforced by prayer and penance.Sixth, RETURNING GOOD FOR EVIL. “Do not return evil for evil, or reviling for reviling; but on the contrary bless, for to this you have been called, that you may obtain a blessing" (1 Pet. 3:9).Sign up to take part in the Great Rosary Campaign today: www.GreatRosaryCampaign.com

ARTivist Jil Love and comedian Jamie Gendron joined Mark and Hannah on The Dark Mark Show. Jil followed up her protest where she put a gold toilet on Donald Trump's star on Hollywood's Walk of Fame by actually building a wall adjacent to the star. With the help of prosthetics master Cleve Hall her naked body was made up to look like it was made of concrete so that she could look like she is bursting from the wall. She also left art supplies, tomatoes and eggs and let the tourists in Hollywood do what they wanted and wait until you hear what they did. Jamie spilled the tea on some men she was with, both in the Hollywood scene and in New Orleans. She finally settles the long awaited question: who is bigger in the pants Eddie Murphy or River Phoenix. She also spills the tea on everyone from Robert D'Zar of Maniac Cop fame and Larry Linville aka Frank Burns from MASH. She also has a lot of things to say about Donald Trump, Kevin Hart, Ellen Degeneres and Louis CK. The Context of White Supremacy welcomes the return of Cameron McWhirter, Racist Suspect. An author and reporter for The Wall Street Journal, McWhirter is a White man and Atlanta, Georgia resident. He covers politics and US news for the WSJ. McWhirter visited The C.O.W.S. back in 2011 to discuss his book Red Summer: The Summer of 1919 & the Awakening of Black America. This work examines the myriad of terrorist attacks against black people across the US and how this terrorist start to the 20th century birthed a number of attempted counter-racist organizations. The great Carter G. Woodson was nearly killed by a Racist White mob in the nation's capitol during this macabre 1919 White pogrom. In 2023, McWhirter teamed up with Zusha Elision to write American Gun: The True Story of The AR-15. The book provides details on Eugene Stoner's iconic black rifle that changed military and world history. This book mentions so many familiar, tragic events and people in the history of White Supremacy: the Columbine massacre of 1999; the Buffalo, New York TOPS massacre of 2022; the Uvalde school slaughter of 2022; the 2017 Las Vegas music festival slaughter; the 2020 Wisconsin protests where Kyle Rittenhouse killed two White people and wounded another. All these abominable events - except Columbine - involved the firearm of our times, Stoner's AR-15/M16 assault rifle. Gus is curious why there are no pictures of non-white people in this text and why McWhirter and his co-author mostly provide extra details about shooting victims who are classified as White. We learn lots of extra tidbits about a German White Woman who survived the Vegas carnage and the White parents who lost a child at Sandy Hook. American Gun provides no insight to the anguish the AR-15 has wreaked on the family and friends of Katherine Massey and the other TOPS victims or the non-white parents in Uvalde. When asked about this discrepancy, McWhirter highlighted the book went to publishing prior to Gendron's conviction and shortly after the 2022 massacres in Uvalde and Buffalo - which limited their access to information about these still developing cases. Gus also emphasized that McWhirter and Elision frequently fail to explicitly identify White people as the target audience to purchase assault rifles as well as the primary obstacle to sensible gun regulation. #FireArms #TheCOWS15Years INVEST in The COWS – http://paypal.me/TheCOWS Cash App: https://cash.app/$TheCOWS CALL IN NUMBER: 605.313.5164 CODE: 564943#
The U.S. Justice Department has announced its intent to seek the death penalty for Payton Gendron, the individual responsible for a racially motivated shooting that claimed the lives of 10 people at a Tops Supermarket in Buffalo, New York, in May 2022. This decision marks a significant development in a case that has gripped the nation. Federal prosecutors filed a court document outlining their rationale for pursuing the death penalty, stating, "United States believes the circumstances in Counts 11-20 of the Indictment are such that, in the event of a conviction, a sentence of death is justified." Gendron had previously signaled a willingness to plead guilty to federal charges if the death penalty were off the table. The indictment against Gendron included 27 counts, with 14 violations of the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act, encompassing hate crimes resulting in death, attempts to kill injured individuals, and attempted killings of additional Black individuals in and around the supermarket. In addition to these hate crime charges, Gendron faced 13 firearms offenses. The motivations behind the attack were deeply rooted in racist ideology, as Gendron subscribed to a far-right conspiracy known as replacement theory. His goal was to "inspire others to commit similar attacks," as stated in a criminal complaint. The rifle used in the shooting bore markings with phrases such as "here's your reparations" and "the great replacement." The decision to seek the death penalty by the Justice Department follows over a year of deliberations. Attorney General Merrick Garland had previously expressed concerns about the death penalty, and President Joe Biden had campaigned on abolishing it at the federal level. However, in the absence of a formal policy, the DOJ had engaged in discussions regarding a "worst-of-the-worst" threshold for cases involving extreme acts of hate-fueled violence. In response to the DOJ's announcement, the defense team expressed deep disappointment. Sonya Zoghlin, an assistant federal defender, conveyed their frustration, suggesting that the government's efforts could be better spent addressing the underlying issues that facilitated the crime, including easy access to deadly weapons and the failure of social media companies to moderate hateful rhetoric online. Gendron had previously faced sentencing on state charges, resulting in a life imprisonment without parole sentence in February 2023. During that sentencing hearing, Gendron briefly offered an apology, acknowledging his actions and the pain he caused. He pleaded guilty to 15 charges, including domestic terrorism motivated by hate, murder, and attempted murder. While the pursuit of the death penalty has been met with mixed reactions, some family members of the victims welcomed the decision. Mark Talley, the son of shooting victim Geraldine Talley, expressed his desire to see Gendron suffer and stated, "As long as I'm alive, I wanna be able to see him suffer." Others in the community echoed the sentiment that the death penalty should serve as a deterrent against such heinous crimes. Buffalo Mayor Byron Brown and New York Gov. Kathy Hochul also expressed support for the DOJ's decision, highlighting the gravity of the attack and its impact on the community. The next court date in the case is scheduled for February 2, where the legal proceedings will continue to unfold. Want to listen to ALL of our podcasts AD-FREE?
